Defamation

DEAR EXPERTS,

I HAVE SENT A MAIL TO A COMPANY AS A SHARE HOLDER INQUIRING ABOUT SOME EAR SAY COMMENTS ABOUT THE COMPANY.
YESTERDAY THEY SENT ME A NOTICE IN THEIR LETTER PAD,WHY NOT THEY FILE A CASE AGAINST ME FOR PROVIDING FALSE INFORMATION AND USING HARSH LANGUAGE AGAINST THEIR CMD. THEY WANTED ME TO RESPOND BEFORE 15TH OF THIS MONTH OTHERWISE THEY WILL FILE A CASE AGAINST ME,WITH A COPY TO THE CHAIRMAN SEBI AND MD ,BSE.
DEAR EXPERTS,I AM NOT HAVING ANY MALAFIDE OR ANY PERSONAL INTENTION AGAINST THE COMPANY OR ITS CMD. JUST I WANTED TO KNOW THE TRUTH.SO IMMEDIATELY I REPLIED TO THEM AS FOLLOWS:

1.REPLY TO THE COMPANY.

DEAR SIR,

RECEIVED YOUR MAIL AND NOTED THE CONTENTS.FIRST OF ALL I TENDER AN UNCONDITIONAL APOLOGY TO YOUR CMD,FOR ANY PAIN OF MIND AND OR LOSS OF REPUTATION AND /OR DEFAMATION OF CHARACTER MAY HAVE

ACTUALLY I CAME ACROSS VARIOUS SHARE BROKERS WHILE DEALING IN SECURITIES TRADING.

The expression "save as otherwise provided" in sec 403 crpc

Sec 403 Crpc:- Save as otherwise expressly provided by this Code no party has any right to be heard either personally or by pleader before any Court exercising its powers of revision; but the Court may, if it thinks fit, when exercising such powers, hear any party either personally or by pleader.

Q1. I found that many sections under various Act uses the double meaning word like "Save as otherwise expressly provided by this Code" What it actual means everytime it is there in any section or in agreement.

Q2. According to my understanding it means when there is no provision in the law or in the ACt this section will come into play for executing it.
OR
When the Act not contained specific provisions in the Act these words will attract to apply that section where "Save as otherwise expressly provided by this Code" is mentioned in the section or agreement.

Q3. How you define "Save as otherwise expressly provided by this Code" in your own words when u found in any section in any Act.

Dtcp approval and covered car parking

What is the meaning of DTCP Approval


1. While providing Approval , whether DTCP will insist for Good Roads , Drinking Water facilities - for any ventures

2. What are the mandatory points required for DTCP Layout approval ??
3. Covered Car Parking in the ground floor is permitted by Chennai Tamilnadu government ?

Minutes not recorded in mc meeting - co- op hsg society

In monthly meeting of the Managing committee of the society, it was decided to draft a letter to the builder/developer for society conveyance and to release the illegal hold on society’s stilt premises. Unfortunately the minutes of such decisions was not got recorded in the minutes book, though the decision was taken with the majority of the MC members (There are 3 MC members with developer’s side). According to the decision our H’nable secretary has drafted the letters.
However due to call from developer’s office for a meeting in connection with our society’s unsolved matters, the letters has not been dispatched immediately. In meeting with developer nothing was done fruitful and hence the above letters were dispatched with old date after three months i.e. date mentioned in letter of Dec. 14 and dispatched in March 15.
Now the developer replied that he has been informed by 3 MC members that they are neither informed about these letters nor any resolution has been passed in our meeting and he further added that secretary is acting illegally against the interest of the society by misusing designation, letterheads and seal of the society.
As our secretary is loyal and not acted any wrong and we need to reply these allegations, please suggest way to tackle this in proper way.

Regarding distribution of muslim property.

Respected experts,
please help me out with three queries with regard to division of property among Muslims under personal law-
1.if a Muslim women has certain property in her name say 100 rupees earned by the women, and if such women dies intestate leaving behind only daughter and a husband, what would be the share of each them.will the daughter would be entitled to the whole property or husband is also entitled to some share, if yes what would be his share.

2.if a Muslim husband and a wife is living separately for more than 20 yrs, would there marriage be subsist and is annulled? note- they are living seperately without judicial separation or under any provision, they have not seen each other for 20 yrs.

Pf withdrawal

Sir,
I resigned my job from the company in Jan 2012.Though i tried several times with the company for the withdrawal of PF, no response from the company till date.
I checked my PF balance online and balance amount intimation i got on my mobile recently.
Can you pls suggest the ways to get my PF directly from PF authorities.
Is there any possibility for the company to take my PF amount?
Kindly advise me to proceed further.
If required i will furnish all details.

Tresspassing

A dispossessed B from a piece of land on forcibly by threatening him to kill as A was lass with arms. On the same day, after this act, A released a statement to Press/ Reporters of News papers that district court has passed an order in his (A) favour to make this possession. After two days B approached the High Court and High Court passed an order and directed the Deputy Commissioner to maintain law and order and also directed to take action for restoration of possession of B. B is now in possession of such land with help of district police and administration. Now my question is whether the act of suffering false statement to press/ newspapers by A is punishable under the IPC or any other act or not.

Re non occupancy charges

I am paying Non Occupancy Charges to society since lats 2 years as I have given my flat on rent. Also I still do not have any reserved parking allotted to me and hence now finding difficult to find high rent from the property.
My question is is there any provision in society act/laws where we can deny/by-pass the additional non occupancy charges basis the basic COMMON SERVICES & AMENITIES ( like car parking) not been provided to me.

wife sending emails to company managemen

Dear sir
I am in ksa.
I am working with a corporate here.
I am facing courtcases of dvc, 498a , crpc 125 and lateat rcr.

I have given gpa to my father attested by indian embassy and my parents who are also in the accused list. A2-mother, a-3 father. They r attending all of them.

when matter is subjudies she is forwarding emails to my management informing them abt cases, even she has sent emails to my colleagues. .! My reputation and job is at stake. Managent has asked me to leave.

Please let me know if this amounts to cruelty? Will this be helpful to apply for divorce on cruelty? ?

Plz suggest.
