As per Sec 78(1)(i)of Finance Act,if sservicetax,interest and penalty@15% is paid by an assessee,should SCN be issued or can SCN be dispensed with ? Earlier Under Sec 73(4)(A)SCN was dispensed with on paying ST, interest and penalty@25%

meri sister ki shadi 11 june 2015 ko hui thi sadi ke 6 din bad 17 june ko unke husband ki ek accident me death ho gai hai ab ham unhe apne ghar bapas le aye hai mera question ye hai ki kya unhe apne pati ki property me hissa milega ya nhi hme kya krna chaiye kuki unke ghar wale to ab hamse bat hi nhi kar rhe hai please answer me

I need an expert advice on the following :-
If Indian Company doesnot have its iown manufacturing unit and it buys unlabeled garments from a supplier company in india and sell them in domestic market in India under its own brand name , does this Company then becomes a manufacturer indirectly?
Does this Company need to obtain any other licence for manufacturing or just Trade licence will suffice?
Please advise.

Dear Experts,
My mother wants to file a partition suit in the Hon,ble court for acquiring of property viz agricultural land situated in Bhagalpur district and Banka district in Bihar. My mother at present residing in Purnea district in Bihar. But co-sharer of land residing in Bhagalpur district. The dispute is on the land which situated in the Banka District as that land has been registered in the name of my mother's sister secretly by my mother's mother without consent of my mother whereas as per law my mother's share is also in that plot. Please advise me in which court i.e. Bhagalpur court, Banka Court, Purnea Court my mother can file suit. whether my mother can file suit in Bhagalpur Court or Purnea Court.

Dear learned lawyers,
I had booked a flat in Dahisar, Mumbai in 2010 which was to be completed by 2013 for which an agreement was made and duly registered and stamp duty paid with an agreement to pay in installments as per a schedule.
I regularly paid all the installments till the terrace slab of the building, but the final installment (the second out of five for the car park) got delayed by 3 weeks due to some confusion with the bankers from whom I had taken the loan; but still I send them check for the same which either got lost or they purposely did not present in the bank for obvious reasons. However, I cam to know about this after another one month as I had not checked by passbook during that time so I immediately made NEFT transfer of the installment along with the demanded interest to them, but I was shocked to hear from them that they have terminated my contract for delay in payment and they are not accepting my payment. They have sent me a notice of termination of agreement citing certain clause from the agreement. When I pleaded with them to take back the same, they said I will have to sign a new agreement to cancel the termination in which there is mention of me having to pay Rs. 1000 psf extra. I have paid almost 80% of the total amount and just for a single delay of car park installment worth 1 lac they are harassing me mentally and forcing me to sign the new agreement. FYI, they have delayed this project for above 3 years and still no work is progressing giving flimsy reasons for the same.
Now, I am in deep mental and financial strain as I am staying in rental accommodation paying high rent and my entire savings is blocked plus paying interest on bank loan.
I would urge you, learned lawyers, to advise me on what best course of action I should take to tide over this crisis which is being forcefully pushed on me without any legal backing.

With reference on the subject cited above, in this connection it is intimated that the applicant is working as IVth class in the O/o SDO/OP, S/Divn. Office and perform the duty at every night in the premises of UHBVN regularly. The applicant has joined the duty (on contract basis) on 29th January, 2015. Sh. Randhir Sandhu, Contractor to produce the correct bill in the O/o SDO/OP, S/Divn., office. Even the contractor did not provide any Provident Fund slip, facility of Employee State Insurance Card to the concerned employee till date and making the excuses for not paying the salary/wages on one pretext to another. Actually, the salary be released to all contract basis employee by ESCROW account but the contractor did not deposit the EPF amount in EPF Office, Karnal. The EPF amount of 4 months in his pocket and he did not agree to open EPF account of the IV class employee. The Superintendenting Engineer or XEN did not response properly. It is also known to any source that the contractor is leaving his contract after three months.
How can I get my money of EPF from Contractor. After leave the contract who will pay the EPF amount to the applicant.
The applicant is harassed every month for salary or EPF amount not deposited in EPF account. what can I do. please advise me.

An unregistered sale agreement executed by an power agent in 2003 march and the power agent exprires on 12th december 2003 without executing the sale deed, What will be the fate of sale agreement? will it become void.?

if collector was given exparty stay without given opportunity to oppent. so now that person can filed appeal against that stay order to commissioner or not
