Hi Experts,
Warm Greetings,
My grandfather had two wives, the first wife being my grandmother and the second wife is my grandmother's sister. Mt grandmother had 1.5 acres of land on her, bought in 1960 and my grandfather changed it to his name under the UDR in 1980's without getting my grandmother's consent. My grandmother passed away in 1992 & my father is the only surviving child (father's elder brother deceased at the age og 11). the second wife has 2 sons and a daughter. since my grandfather had not got consent from my grandmother for taking her 1.5 acres land, we are thinking of claiming it back as my father's step mother and step brothers are not coming to a consensus for dividing the property. for this we were asked to get a legal heir certificate for my father. we are not sure if it is necessary to include my grandfather's name in my grandmother's legal heir certificate. we are worried that if this might bring in ore trouble from my grandfather's second wife family.
We would be grateful for any help in this matter.
Thank you
shoaib

Sir,
An application has been filed by the applicant u/s. 11 of Arbitration & Conciliation Act 1996 before the High Court for appointment of Arbitrator.
Facts of the Case:
The applicant is a building contractor and there was a work contract between him and our company for construction of building. Work done by contractor and submitted his final bill which accordingly measured in presence of contractor and bears signature on joint measurement as per which payment certification form was derived for certain amount which us to be payable by us. The same has been accepted by the applicant. On the basis of same a cheque was made by us on that amount. But, thereafter the applicant disputes that amount and made false and tall claims.
Our main defense is that there is no dispute at all as the applicant already accepted the amount on payment certification form by way of his signature over same. Hence, the petition is devoid of any substance and therefore it be rejected.
Kindly guide and provide some rulings in my favour.

I purchased an area from a consuellor r in 2004 , this area was in absolute possession at that time in 2004 from the time the building was under construction in 1999, but at that time when all co- owners didnot object it as a common passage .but when they association came to know abt it, They started harassing me to vacate the area n provided that open the remaining area which was already constructed as two bathrooms. One was used by the consuellor and one by the watchmen . After a lot of arguments in meetings held back to back the association n the promoter n founder of the building decided to vacate the area instead they shall provide the area at a back side of the car shed which was also purchased by me. But that area already has a gate to come from common passage . This back side area consist a room like covered with four sides wall and a bathroom and a way to come out is been objected by the association stating u cannot use the common passage as a right to way .
Please suggest what is tha proper ways by which we can complete the work that was carried on in my place.

Hello, i m residing in mumbai, and i have property gifted to my mothers name by her real elder sister before a year ago through the act of deed of gift, and we have completed all the registration and stamp duty and society transfers before a year itself, now the donor asks us to give the property back to her without letting us know any reason to do so., the deed clearly mentioned that this "deed is irrevocable" , also it states that the Donor was staying with the donee since last 10 years and the donee has taken care of donor's day to day care and responsibilities and she is confident that the donee and her family will also take care of donor's in future and so with love and affection the donor is gifting her flat to donee.
My question is whether we can be leagally forced to give the property back to her or no?
Even though we have never done anything wrong to her, she is forcing us and threating us to go in court if we don't make a transfer back to her.
So are then any chances, that we can be affected as per the law.?
Thanks in advance!

My father purchased a land from his uncle 20 years back and we are paying panchayat taxes for it from last 20 years. We have the blueprint of the plan approvals fro panchayat too.and my uncle stayed in this land for almost 50 years. Now a person registered a complaint claiming that land belongs to him.. My father dont have any registration papers for our land but just a bond paper signed by my uncle. Experts can you let me know if its going to be a problem or not .? Will the land belongs to us ?
