Under constitution 226/227

My client has obtained a home loan without creating any security interest/mortgage deed. The financial institution has sent notice U/s 13(2) and 13(4) of SARFASI Act and has approached the Magistrate Court U/s 14 of SARFASI act for physical position.

My client has contested the case in the Magistrate Court, which has been accepted.

Before issue of any order from the Magistrate Court can my client file a writ for a stay.

Land acquisition

dear sir,
My house is situated adjacent to NH 37 in Assam. Recently NHAI has acquired land upto the entrance of my house for which my house may have no entrance and will face many problems like vehicular traffic and pollution because of adjacent to national highway which touches the steps of my house. is there any provision for compensation because this acquisition has made my house unsuitable for living.if they acquire my house i may get compensation for making a new house and leave that place.

Item misplaced by courier company and less money offered in claim settlement

Hello everyone. I am an I.E.S. officer 2012 batch. I have joined the Indian Railways. It's my first posting at Gonda city, 120km from Lucknow towards Gorakhpur. I ordered a led TV on 2/7/15 from snapdeal.com. I received the TV on 11/7/15 through GATI Courier services. The TV turned out to be defective and I requested for a return from snapdeal.com. snapdeal.com could not come and pick up the product from my place so they told me to manually courier the TV back to them. I booked the TV through GATI Courier services on 14/7/15 for destination address at Lucknow. They gave me an assured delivery date of 16/7/15. I tracked my docket online through the docket number provided to me in the courier receipt I got.16/7/15 my docket containing the led TV had reached destination city i.e. Lucknow.18/7/15 undelivered due to holiday (eid).22/7/15 undelivered due to received only docket at destination city. This is the tracking record of the GATI courier services of my docket. When I talked to the customer care,after enquiring,they told me that they have misplaced my docket and are ready to refund me for the loss. The cost of the TV was Rs 33600 and this was the value declared by me too but the claim they are offering me now is Rs 10000 only. They say that I had signed the docket receipt in which it is mentioned that courier is being sent at shippers risk and not at carriers risk so they would not be able to provide me with the full declared value settlement but only a fraction of it. I was not asked at the time of booking my courier about the risk coverage. The courier charges has been refunded to me by snapdeal.com which was Rs 550 only. If I would have known about the risk coverage I would have chosen for the carriers risk as the full courier bill would have been refunded to me by snapdeal.com. kindly help me experts. How can I legally claim my full declared value by the GATI courier services. Please advise me as soon as possible. I am attaching the docket copy of the courier send by me through GATI. Please help me

problem in possession/use by purchaser

Sir
I want to sell my share in undevided share in land, I make sale agreement/sale , and purchaser goes for actual use of land and other co sharer creats trouble in possession/use.what the purchaser should do.partition suit who has to file and till then what will happen.Whether the purchaser will remain without using aftercpayment or what.

Pending writ petition

Dear Sir/Madam,
One of our villager filled a writ petition in High court claiming our agriculture land as a government land, he submitted affidavit to the high court and deliberately hide many facts about the assignment and earlier court judgement. High court gave interim order and asked the petitioner lawyer to give personal notices to us.
Our advocate and government advocate (GP) responded to the WP with facts and details of earlier judgements and prayed to dismiss the baseless petition.
This case is pending in the court POSTING STAGE : INTERLOCUTORY(REVENUE), and we have been told as court is not picking up this case for further processing due to courts busy schedule.
Despite court didn't give any stay, petitioner illegally claiming the interim order as a stay order as not to do any cultivation in the lands which is in our sole enjoyment in past 60 years, which is causing huge financial loss and mental tension to our family.
We have been filling police cases every time they interfere in our agriculture activities, however they are getting a bail on the day and doing the same things repeatedly and again all police cases are pending in the courts.
Since this baseless petition we are struggling a lot, could you please advise what can be done to lift this WP by the court either dismissal or argument.

Government demanding bond for superspeciality

dear sir,
my son was selected on merit for Mch plastic surgery in MMC tamil nadu(non service).The government is asking to execute a bond for five years after completion of the Mch course to work in govt service with salary on par with any fresh recruits (equvalent to MBBS) they insist to deposit the MS degree certificate and all other certificates including 10th mark list. They also ask three surities to sign the bond one from spouse another by parent and another by non blood relative.They also insist in providing copy of propery equivalent to the bond amount. The bond is for 25 lakhs.In case if the candidate does not want to work they demand 25 lakhs along with stipend amount received with interest. Is it under law to hold students selected on merit as bonded LABOURS..In fact government hospitals are functioning mainly on pgs hard work. how could the impose such slavery rules when on one hand government is all againt bonded labour. is this kind of bonded education exists in any other streams of education such as engineeering, law etc.Do any other sreams of education students work and help in running of the insitution? Moreover when there is a government ruling that cerificates should not be withheld , how can GOVT add these terms in the bond? does is not tenamount to disrespecting court's verdict?
