Promissory note to attach assets

Dear Sir/Madum,
I loaned a longterm to my family friend for Rs 5L on promissory note. He dont have income or assets on his name, But his father was millionaire. Can I attach his father assets to claim the amount?

Undue calls disturbing me

Dear Sir/Madam,
As I have received about 15 calls from different numbers[from different H.R. recruitment agency(may all be working for same position/company)] for the same vacancy,same company(A BPO company) and same job location.
Every time I refused/showed disinterest due to office timing(6.00 PM to 3.00 AM.)AND unsuitable location.

Calls are still in process.

How an agent or a company itself or through hired H.R.recruitment agency can puzzle me by making undue so many calls,as each time I have to attend the same,even while working,eating,travelling etc.

Is there any legal safeguard or action against such a case,please let me know.
I shall be thankful to you.

Illegal occupancy on our land by uncle

My parents given right to cultivate and grow crop on our agricultural land in UP to My Uncle (My mom's brother) few years ago around the year 2004-05 (no written contract as it was in relation), he made a small hut on the land and done the said activity continuously.

But now the problem is, he is denying to vacant the land and claimming it his land.
My questions are,
1) Can we file a criminal case against him for illegal occupancy? or it's a matter a civil suit?

2) What are the difference between both type of cases?

Property registration

Hi,

I have brought 1 BHK in 2003. Now i want to sell this apartment. I am 4 owner and previous 2 documents are registered. Tripartite agreement between1st & 2nd owner with builder has done and stamp duty paid but not registered. what should i do ?

how to cancel a registered sale agreement

The registered sale agreement was made in January 2010 and a time of 2 years was given and it ends in January 2012.Till now ter is no move from me or him(buyer). The property is in my possession. In agreement its clearly mentioned that the agreement itself will be invalid and he will loss the advance money if the buyer failed to full fill the agreement.Now what shall I do.can I cancel the agreement in the absence of buyer and does sub register can do that.

Must i get this agreement registered or not?

I am a Naredeco Certified Realtor. One of my client's land had been acquired 50 years back. According to him no compensation received. I checked the records and found him right.

Now he has offered to hire me either to get the land back or get the compensation from the Govt. To which I have agreed upon.


I have prepared an agreement,
The gist is, he will pay me a certain percentage of the benefits, whatsoever he gets from the Govt.


If he gets back the same land back or any other land, he will sell this property in the open market and then will pay my fee and if he gets some cash in compensation then he will pay my fee on the same day of the receipt.


Now the dilemma is , should I get this agreement registered or even the unregistered one will suffice?


I tried to understand by researching on internet and got this---

17. Documents of which registration is compulsory
(1) The following documents shall be registered, if the property to which they relate is situate in a district in which, and if they have been executed on or after the date on which, Act No. XVI of 1864, or the Indian Registration Act, 1866, or the Indian Registration Act, 1871, or the Indian Registration Act, 1877 or this Act came or comes into force, namely:-

(b) other non-testamentary instruments which purport or operate to create, declare, assign, limit or extinguish, whether in present or in future, any right, title or interest, whether vested or contingent, of the value of one hundred rupees, and upwards, to or in immovable property.

BUT COULD MAKE NO HEAD NO TAIL.

U,p. rent control & civil matters

Lawyer needed who is well versed (and updated with latest rulings) in U.P. Rent Control Act, T.P. Act and general civil matters.

I would file no less than 100 cases in Bulandshahr court. First step would involve notices u/s 106 etc. followed by institution of suites.

Since I do not live in Bulandshahr I would be available in the courts ‘only’ when matters reach evidence / final arguments stage and not during regular hearings.

He could be ‘from anywhere (areas nearby Bulandshahr/NCR)’ who can prepare cases & represent me in Bulandshahr session court.

rule 16/order xviii - code of civil procedure, 1908

Rule 16/ORDER XVIII - CODE OF CIVIL PROCEDURE, 1908
Sir, I am foreign citizen of Indian origin. My case is adjourned for next date for ex parte divorce witness and evidences and which in this case is only myself.

Now can I apply under above rule since I need to leave India? Do i need to first apply to the District family court or direct to the HC under above rule?
