Gift/Hiba Deed

We file a suite for partition in ,2010. The case is on hearing stage.

On 26th November we came to know that my brother had got Hiba/gift deed registered in 2002 from my mother(my mother died in 2003)and the same is registered on 2010 by paying the balance stamp duty as it was pending.

In the witness one fellow was crimnal who was jailed for murder and other fellow was comon person of other locality. Both of them died. One fellow who jailed was purchased for Rs.5000.00 and the whole of my locality knows even his son and wife also knows.

I am the elder brother who occupied a room since the inception and living time to time recently my younger son is also living permanently for graduation and study at Surendra Nath Collage. I have a ration card and voter ID too.

My point is the gift deed is not registered within 4months.

If the same is registered after 4 but did not paid the penalty on stamp duty which is ten times of the stamp duty.

The entire possession was not handed over to the donee as I the Elder brother lives in one room and my step Sister also having one room.(she is from my mother's side who's first husband died)

The signature's shows that my mother was not in mentally and physically sound, and the fact is that she died with serious sickness within one and half year time (June'2002 and December'2003.

She was a heart patient, Sugar and Artheratis and always lives in parda.

Our properties belonged to my Grandmother (my father's Mother) the said property was duly WASIYAT transfered by my Father to my mother in 1966 " mentioning that my mother would be as caretaker and the inheriter's are his three sons.(which are named)

Thus considering all the points the Hiba/Gift is valid or invalid as the case is on hearing stage?

Query regarding ready possession flat

Hello Sir,
I have taken new flat in Pune on Jan/2015 in the PMC limit of Pune cooperation.
building completion date is March/2013.
I have moved to new flat but PMC tax is on builder name & he advised to me PAY all tax from March 2013 to March 2016 otherwise Name will not transfer to my Name.
Can you Please guide me in that case.

No offer letter given

Hello team ,
I have given interview on October 30 2015 at a consultant place . I was selected n asked to submit the documents to get offer letter .since there was lot of documents required. I submitted my documents by Nov 9 . When I asked the hr for offer letter they said will have to wait for another week . I called up my consultant they said he will get it done in 2 days . Since then every day he says within 2-3 day offer letter Will come to u in email . Finally I called up the h.r of tcs bpo on 7-12-2015 . I was surprised she said it will take another week and not sure of time when offer letter will be given . I called up consultant n said sir offer letter still he is saying 2-3 days . He wasted my entire month m not on a job from 6 months .I don't understand if a particular company don't have job why do they ask people to give interview and submit document. Now pls suggest me what can I do in this case .

To deprive a son or daughter from share in property through is fair and legal ?

Should a father through will deprives his son/daughter from getting a share in property ? if so ,is it legal and fair to do so? i think a person has no right or control over his wealth after death.
A person has no control and use of wealth after his death.Doing so will deprive his progeny source of lively hood and creat enemity among his own offsprings

Sc land purchase by a general.

Sir,
I purchased a plot on my mother's name on 3 Mar 2015 from a farmer through a broker near Unnao,U.P. I was told that the land owner(Farmer) is not a SC/CT and the same has been mentioned on the registry papers as well. but now after about 8 months I got to know that the land owner is an SC. Now I know in July-2015 there have been some new rules laid to allow the purchase of SC/ST lands. I am not sure if these apply to me as well because I bought it in Mar-2015. The "Dhakil/Khariz" of my plot has still not been done. Please advise me what I should do?

Tamilnadu grama natham

Sirs/Madam,

I am 26 years old from coimbatore, tamilnadu. We are residing at our home (5 cents) which is under village panjayat.
The land falls under grama natham. My fathers grand-father,My gran-father, my father, and me are residing there continuously.(i.e more than 60 years and more). we dont have patta. my father pays electricity,land tax, water tax etc. Our home is located at a main street of the village.(residential area). Is it possible to get patta for the land? Is there any complication in that? is that complication could be solved by court? Please advice.

Need advice / suggestions

Hello All,

I am looking for some legal advise. I have been married for 11 months now. When I look back at the past year, I feel like I have made a huge mistake in choosing my partner. My wife picks up fight for no reason and this has been going on from the time we have married. I have given enough time for her to change her attitude but things seem to be going from bad to worse.

Due to constant fights our marriage has not consummated. She always complains that it us painful to have sex. So there has been no intercourse. I have taken her to a gynecologist but to no avail. At this point of time I am no longer interested in the relationship.

I have read that non consummation of marriage is a strong reason for divorce. I have all the medical prescription from the gynecologist. How do I prove that she is not willing to have sex with me? Can I apply for a divorce now ? Do I have to wait for 1 year ?

Maintenance divorce alimony

Dear Experts,
My sisters husband filed a case of divorce on my sister 14 months ago on basis of medical history of my sister.My sister was having a medical condition which is not severe or dangerous.It was an arranged marriage and my sister is healthy but she kept it confidential and didn’t tell anything about medical condition to her husband before marriage and after marriage because it is not severe.After marriage she was under treatment and her husband came to know and on basis of that he filed a case of divorce.They stayed together for 12 months and one day some argument took place so my father suggested my sister to come and stay together with us for 2-3 days so that things will settle down.Later her husband kept delaying to stay together and immediately filed a case.My sister has not filed any case because she is accepting her mistake in front of him but not publicly or in written statement and at the same time she is not interested in separation.We have not filed any case but just trying to defend this case of divorce through written statement/smart story suggested by our lawyer and say.Now the case is at the stage of interim injunction and order is pending.
1)According to my sister we have not filed interim maintenance case because my sister is well educated and getting rs.32000 monthly salary and therefore she is not eligible for maintenance and it will be rejected which I totally disagree because my sister is staying at my fathers place which is on rent and my sisters husband is having his own property on loan and a handsome salary of 65000 monthly. We are aware that contested divorce takes lot of time and we are prepared to some extent as I am worried for my sister as I am living in a different city.Is this the right time to file for maintenance?How much maintenance she can expect?Is there any chance of permanent alimony on our side.
