Can res judicata apply on operation of pwdva for women

Further to my earlier query I need advise of experts on following:

The lady who is not allowed to enter home owned by her late husband has filed residence order complaint to magistrate under PWDVA

The current occupants her husbands brother and his family have produced a will that was rejected during probate proceedings and assiged for detaild trail for probate. The lasy has also filed a suit for declaring this forged will null and void and eviction order. Both clubbed cases are pendign in court.

Now question of law is -can PWDVA act operation be stalled if any civil suit for establishing ownership of house is pending because domestic violence act clearly mentions it is additional act for remedy and that domestic violence addresses right of residence and not right of ownership. he has right to even live in home rented out by her husband.

In one judgment Delhi high court bench has ruled that will if disputed has to undergo probate proceedings and till this happens it has no value.And the bench allowed residence order in mother in laws house to lady who was having will in her name.

Section 61, indian trusts act

Respected Sir,

I am female living in Tamil nadu, aged 40 yrs.

My younger brother (37 yrs), who is nominee for my late father's bank deposits, refuses to give my share of our late father's money lying in bank.

I wish to invoke Section 61 of Indian trusts act by which Honorable Court can compel him (trustee) to do his duty of transferring beneficiary's (my)rightful money to me.

I respectfully and humbly request Honorable Supreme Court citations.

sir,
my mother's grand father having property in our home town .that property was his own on that i am having one query that whether my mom had right on that property or not.whether it belongs to my uncles

Mr.X have fd in bank in single name without nominee,he died on may 2015,now there children are NRI.So there is any time limit for claim that fd from bank?

I am teacher kvs a central govt autonomous body . I had been on leave from 26-6-2013 for 6 months , my child was not well I gave medical certificate too but leave was not sanctioned by principal although I had informed principal about the absence of mine .I came school on 23-12-2013 but principal denied to join me and send me to the regional office to join , I went but due to absence of DC I could meet him only on 1-1-2014 and I received the joining latter to join on 13-1-2014 which was the first day after winter break .
Q1.
(a) is the winter break been counted as leave ?
(b) Will I get increment on 1-7-2014
(c) Can I ask why my CCL is not sanctioned even after producing the medical certificate from the govt hospital ?
(d) if I would have get the ccl would this period be counted as eligible service period

Property division

Dear sir, we are two sons one sister in a family. My father passed away in dec.2015. He had self earned home some gold some savings in bank. He made home in name of my mother since buying plot in 1972 and building it in 1975. Extention of this building was done in 1994, with my funds and my fathers fund. MY elder brother is in different city with father funded ssi. My sister got married in 1986 in kolhapur maharashtra. my father passed away without will . kindly let me know about partition of property.

Cat procedure

I have some matters in the Central Administrative Tribunal coming up for final hearing during next two weeks. One matter is for quashing the punishment awarded in disciplinary proceeding and others, related to expunging of adverse entries in the Annual Confidential Reports (presently, Annual Performance assessment Reports). The former matter is before the Division Bench, while the latter matters before the Single Bench. There are some common issues in all the matters. Is it necessary that I need to bring this aspect to the notice of the Court before the commencement of the hearing so that the possibility of the Benches deciding the same issue differently could be avoided.

Termination of service of a probationer.

Sir,
1. Please send me the SC of India citation:

(a) An adverse remark may not be communicated to a probationer, but if there is a statute, it has to be communicated.

(b) Government or government servants cannot act against any statute.

(c) A person on deputation may be reverted at any time, and where he completes the deputation, it will be termed as successful.

(d) Can backwages be claimed if termination simpliciter has been termed as illegal.
