Daughter share in parents ancestral property

Dear Sir,

My mother's father (my nana ji) expired in 1976 and my nani ji expired in 2007.As per jamabandi records and fard available on haryana government land record website, my mother alongwith her 2 sisters and 1 brother has share in ancestral property. my mother filed for partition suit in 2014 as her brother dont want to give share to any sister & tehsildar ordered in our favour for partition. Her brother filed appeal in sdm court and there also ordered was passed in our favour in September 2015.
I have recently read on internet that in November 2015 supreme court has ordered that no daughter is eligible for any share in her parents ancestral property if her father has expired before November 2015 so please confirm does that means that my mother will not get anything despite of court order and property appearing in her name on land records.

false case IPC sec 509, 502. how can I defend my self my

Dear Experts . A lady who is neighbor of my relatives has completed and registered a fake case 506, 509 in local police. Despite we were victims and we called on 100 no (PCR) police arrested my reletives ( my sister, her husband, her a neighbor and me.

By coincidence I was there at that day. That lady has been warning us if my sister and her husband not apologize her in front of public than she would suicided, and we would be responsible for that after here all this we called on 100 and informed to police over the call. and I went to local police station to inform them, police came with me on my relatives and that lady's home. After a long discussion police arrested three of our members, they did not give any chance to explain any clearyfication.
Next day we got the bail but we are still not aware what matter was registered in FIR. According to Investication officer IPC 509, 502 have registered against us .
I have been preparing for govt job for last four years, please guide me should I still continue my preparation or not. Can I not be gov't employee ever.

Regarding UP Vat in Lubricants

Dear Expert,
Greetings!!!!

i have registered my firm for a business of Engine oil (Lubricants) in UP. I have TIN and CST numbers. Now when i enquired about UP vat on lubricants from few Income tax lawyers they told me that Lubricants in UP is in Non Vat category on the other hand few told me and i have also read that there is 21% Vat on the sale of Lubricants. But on various bills of retailers i saw Non Vat Sales invoice written from whom they purchase engine oil.
and now when i contacted again with same Income tax lawyers they told me that if we import that engine oil from other state in UP then VAT is required otherwise to sell inside UP no VAT is required in Lubricants.

kindly provide me a better and vivid answer beco i am totally new and now rely upon ur answers. Hope someone can help me out.

Indian stamp act, 1899

Dear All,

While stamping the document as per Section 5 of Indian Stamp Act, 1899 (with respect to Delhi), where an instrument involves distinct matters is chargeable with aggregate amount of the duties with which separate instruments, each comprising or relating to one of such matters, would be chargeable under the Stamp Act.

Now I want to know that, while stamping the instrument, which involves distinct matters and chargeable with stamp duty under three or four different Articles of Schedule of the Stamp Act, So which Article would be mentioned on the stamp or all the Articles under which stamp duty is payable will be mentioned on the stamp.

Gratuity Payable or not

Dear Team,

Please advice on below scenario..

The management have decided to close one of our office and the employees will releived from their duties by FEB end.

Most of employees are employees for 3 - 4 years. As per gratuity Act they have not completed 5 years of service eligible but employees are asking gratuity.

Are we liable to pay grauity to the extend of amount accrued / deposited for these years.
Also furnish the relevant section from the Payment of Grauity Act.

I am working in bpo (Pvt. Ltd. Company) , but getting only 12-leaves per year.
1. I want to know the actual number of annual leaves by law in Mumbai.
2. I have complained about this in BMC shop and establishment department, now what will be there (labour commission) procedures and effects on this company as I have complained? Will they charge penalty / they will seal the company / what will be the outcome of this complaint ? As this problem (I.e. Just 12 annual leaves) is with all the 350 employees will I be fired from the company?
I am tensed please assist.

Cheated by a vacation club

Please guide me with list of Sections in IPC to cite as proof on grounds of Fraud / Mischief / Cheating and Perjury. I am aware that the sections applicable are 425,420 and 191.
Here is my issue: on 2nd Jan 2016, we received several calls from Country fitness club to come n collect the gift voucher which we won in some lucky draw. Upon reaching their location, they made us to sit for a presentation to demonstrate us about their vacation club. The agent informed us that the membership is Refundable only with-in cooling period of 45 days of purchase in case if we did not like their services. The membership price was Rs 1,31,240/- which we had paid by credit card and cash both. Within 10 days we discovered that this is a fraud firm and there are several complaints about the company on internet. Hence on 15th Jan 2016 we planned to cancel the membership and mailed to the customer care cell of Country vacations. We tried reaching their customer service executives also and they said we can't cancel membership and its not refundable.
Points:
- Wrong information/ misleading customer at the time of demonstration and purchase
- False promises with respect to service and agreement
-Membership is not yet approved from their Hyderabad headquarters and we have not yet received our membership cards also. Still they say it can't be cancelled
- We have raised transaction dispute in Citi-bank regarding the Rs 97000 which we paid through credit card and it will take 50 days for investigation.
I require the sections of IPC and The Indian Contract Act, which I can cite for claiming my amount back from this Fraud Company. It will help in the investigation of Citi bank and will be beneficial in getting us the refund from Country vacations
I came to know that no firm can say that the paid amount is non-refundable because it is against th interest of consumer and what if the consumer is not satisfied with the product. I'd like to know if there is any section to justify this point.
Also, any kind of helpful tips in this regard are most welcome.
