After that guy filed a petition that cross examination should be done. My question is will it be done to me after it was closed. And if not does it mean that case is in my favour?

Family law, civil law expert's advise needed

I am an Australian citizen live in Perth, Australia(right now in India). I got married in 2010 in India and at that time I applied for my wife's Australian residency. My wife and I didn't have any contacts because of family problems and she and her family always refused to talk. my x-wife got permanent residency on my basis. After she got residency in 2013 I don't know when she left for Australia and started living there. I found out about it after nearly two years that she lives in Sydney, Australia and nobody from her family or she even bothered telling me about it and during those two years I was just wasting my time in India trying to solve the problems and convince my in-laws. so when I found out about her I went to Perth, Australia as well and filed for divorce there in may 2015. court found I had enough ground to seek divorce and I got divorce order in august 2015. after divorce we stayed in Australia ( me in Perth and she in Sydney) for 4 months, no contact no nothing. In October 2015 my mother wasn't well in India so I came to India and stayed with my parents. she came to India in January 2016 and the very first day she reached India, her father had all the fake cases ready against me and she & her father filed all the fake cases against me in police station, civil court and family court like 498,420, 125,maintance,domestic violence, etc. we haven't stayed together or talked to each other since 2012 plus we are divorced where we actually live i.e Austrlia. she and her father just want to torture and harass me and my family. in their cases for domestic violence and harassment they have mentioned names of some of my family members which she has never met in person or even talked to them, they actually were not present in our marriage too. They just know names of my family members and they have mentioned in their case that I and my those family members(who she has never met) were included in domestic violence and asking dowry. In her cases she says that she doesn't accept Australian court's divorce order.

how can I save my family and myself from this fake cases and mental torture.
need expert advice on this please.

I want to change property name (parents to me)

Hi Sir,

The home where I am residing is in my mothers name and she had forced my father to transfer it to my name (Prabhu Mayavan- youngest one in the family). My mother is no more now, she died after one month in 2005. At that point of time everyone in my family had signed a Stamp Paper, through lawyer IE; (Two elder brother, elder sister and my parents).

-->The notary was not done.

"Note: - It comes under brighten Mumbai Mahanagar Palika, Collector place"
Home Passbook with which we pay rent to MCGM have my parents name. (Which i want to change it to my name).

Now when I am going to the government office to change home into my name, government staff is asking for NOC from all the member in the family, Which is not possible right now because right now we don't have cordial relation in our family.

Is it possible sign a sell document from my father and then change it to my name
Or do I need to sell it with my father confirmation so that I can move elsewhere.

Most important thing is my father gave separate house to all the members in the family.

Now I am in depression because of this..

Kindly advice the best possibility to change the name or give me solution.

Awaiting for best reply

Transfer of Property

Mr. D owns a land. He dies without executing a will. Post death his land is inherited by his sons. The land is equally divided among 5 sons in a mutual agreement and no paperwork is done. This implies that there is no deed defining the share of 5 sons and their rights in the property. The elsdest son Mr. K possesses a deed which was executed when D acquired the land. A copy of such deed was given to rest four. On a piece of paper it the share of land was agreed upon and signed by the brothers. Now one of the brothers Mr. M wants to sell his share of land. On consulting a legal practioner Mr. M is advised that he needs the signature of all the other 4 brothers (in case any brother isn't alive , signatures of their legal heirs is reuired). Besides he is advised that the legal heirs of Mr. M ( I.e. a son and two daughters) should relinquish their rights in the property in a relinquishment deed). And only after satisfying these conditions the property can be sold.
Please guide if the legal practioner is correct. Who actually have the rights in the property ? what is the best possible way to sell this property ? Is it possible to reverse mortgage the said property ?
