Dear Sirs,
Can you possibly help?
• My grandfather has some agricultural land in Banga, Punjab.
• I am the sole-named person in his will.
• We both live in England.
• My grandfather is unwell and cannot give a Power of Attorney due to mental incapacity. I will be applying for a Court of Protection in England so that I can manage his affairs. I will have this notarized and attested by the Indian High Commission in London.
• What is the process to have this used in India for the sale of my grandfather’s land? I understand that you need to obtain an Order under the Mental Health Act 1987 from the local District Court, is this correct or is there another way of doing this?
• What would it roughly cost to successfully complete the Indian part of the above?
Many thanks for your help.
Kind regards,
Aj Mann

Hi Friends,
I have taken a under construction flat and it was suppose to be completed this month end ie Aug 2016. However, as there was a hugh / unimaginary mis-appropriation of funds by the builder and his employees i dont hope for next 5-6 months the project will be completed. Keeping this in mind, I have following questions for you-
1. I sense the builder will run away or suicide. What should i do in both the case.
2. My banker has a internal tue with builder and has released more money than required. What action can i take against bank and how.
3. Recently municipality has issued noticeto the buider. considering which my last floor is illegally constructed. What action can i take against builder and agaist the bank 2ho has aapproved the Loan without proper check ?
4.Builder is Not paying the rent due to delay in project, and if he pays also it is going to br very less as he doesn't have money. What is the solution you suggest for me.
5.Incase of illegal construction of my floor, can i ask the bank to repay to me all my EMIs paid so far and unless the illegal floor is made legal I m not responsible to pay the EMI and the same has to be waived off ? Because the floor itself is illegal and how the bank can grant loan and charge EMI on the flat which is illegal ? How the bank's legal department be so irresponsible in its procedures.
Please provide me remedy as I am un-necessarily loosing 80% of my salary in paying EMI and Rent.

Dear Sir (s)
I am Ms Fauziya filed DV and 498a on my husband on November 5, 2015.
In 498a husband got anticipatory bail however he did not attend 1st DV date hence, we got ex-party order on the 1st date itself.
After some days my husband applied dismissal of DV on the grounds of limitation of DV, perjury and no domestic relation and no say aside with written statement. Wherein, he came up with bar council letter that I am practicing advocate.
I had 40 days of domestic relation with him. After that I stood with my parents and the cases were filed after two years of separation.
Bases on the advice of my council and police “DYSP” I approached my husband for settlement and talaq. Husband agreed accordingly, we filed joint application in DV that we wish to settle the matter our own and no further grievance is left also full & final amount is mentioned in the application. However, the order and my oral statement are pending.
I took khula on stamp paper mentioning full n final settlement done and receipt of payment confirmation. Accordingly notary had been done at the court premises itself.
Further, police took my statement and prepared C report but yet to file in the court.
Now I realized that I shouldn’t have settled the matter. I do not want this settlement; I want to continue DV and 498a. I feel my husband should be punished.
Please guide me how would I proceed since, in DV order is not yet done and C report is not submitted to court.
I wish to run both cases.
Whether maintenance granted to wife in divorce proceedings is added to income of wife for the purpose of Income Tax calculation?

Currently I am working for one of the reputed MNC run Bangalore. It comes under service Iindustry. As per company standards eeveryone's working hours is 9 hours and 30 minutes. However ccompany has asked us to fill time report as 9hours per day and calculates the ssalary aaccordingly.
Can I know from what is the legal working hours in service industry in following two cases ?
1. With breaks (breakfast / lunch / dinner / other normal breaks)
2. Without breaks.
If I need to fill up time report to track my working hours, what is the time that I have to mention. Is it 9.30 or 9 hours ?
Thank you friends

When applied for CA COPY, court status of file is not traced... how to get the Judgement copy for that Case.. pls suggest...
I am working as a clerk in a unaided private school in haryana since 2009. Our management was not providing Esi facility to us so I complaint against school in Esi dep. Then Esi filed 3 case against school under 85a,85e,85g of Esi act. Now in Aug 2016 school started Esi for us from sep. 2015 contributions for avoiding court fine and punishment. From sep to July they showed less working days of staff and pay less contributions and played 420 game. What should we do for deduct Esi contributions from joining date or Esi notification date of educational institutions.
Can we file 420 case against school.
Parking encroachment
Sir
I am the secretary of our society and would like your expert opinion on the below issue
We have a total of around 58 flat with just 12 stilt parking which has been sold by the builder and its obvious with the increase in vehicle’s we are facing parking issues. Even though they are illegal as per HC ruling no one has objected till date. However the issues are
1. A few owners from these have put chains/poles and encroach. Is this allowed?
2. How can we know how much area belongs to them? They do not have any agreement with the builder.
3. A few have parked/kept old bicycles/scooters/scrap. Is this allowed?
4. The owners of these parking’s have just a receipt of the money paid to the builder. There is no mention of parking in the agreement of the flat nor any separate agreement with the builder. They just receive and pay property tax for the parking area separately. Can the society challenge this in court and take away the parking?
Thanks
Norm
