Execution order in consumer district forum

I filed execution affidavit after opposite party did not respond to ex parte judgment. Now the EA case is listed under the head objections. Opposite party is not attending hearing and court continue to post next date without even hearing from complainant.

What should I do next?

Legal liability of a daughter in law towards mother in law and fathe in lawr

मित्रो मेरे Clients 64 और 69 साल के दंपत्ति ( पति – पत्नी)Senior Citizen ( वृध्द जन) हैं,जिनका ताल्लुक हिन्दू संयुक्त परिवार ( Hindu Joint Family ) से है .ये अपने भरण –पोषण ( Mintenance)के लिए अपने पुत्र (Son) जो कि केन्द्र सरकार के अधीन मंत्रालय में कर्मचारी(Cetral Govt. Employee) था पर आश्रित ( Dependants ) थे किन्तु पुत्र का आकस्मिक निधन(Death) हो गया.केंद्र सरकार के कर्मचारी के आश्रितों के कल्याण के लिए बनाये गए नियमों के अनुसार मृतक( Deceased) की पत्नी (Wife) को अनुकम्पा (Compassion)के आधार पर सरकारी नौकरी (Govt. Job) और अन्य क्षतिपूर्ति की रकम प्रदान कि गयी .अच्छी सरकारी नौकरी और क्षतिपूर्ति कि मोटी रकम पाने के बाद वृद्ध दम्पति(मृतक के माता –पिता)की बहु(Daughter in Law) ने उनसे किनारा कर लिया है .जिसके कारण मेरे Clients को अपने भरण –पोषण ( Mintenance) के लिए कठिनाइयों का सामना करना पड़ रहा है .वृद्ध दम्पति(मृतक के माता –पिता) की बहु(Daughter in Law)को मृतक पति से कोई बच्चे भी नहीं हैं तथा उसने( मृतक की पत्नी) पुनर्विवाह(Remarriage) कर लिया है और उच्च शिक्षित है.वृद्ध दंपत्ति पुत्र (मृतक) की शिक्षा (Education)के दौरान इनकी जिविका का आधार कृषि(Agriculture) था वो भी सिर्फ इतना ही था कि किसी तरह जीवन यापन हो रहा था ,बेटे की उच्च तकनीकी शिक्षा(TechnicalEdu.) प्राप्त करने जिद तथा उसकी लगन के कारण उन्हें अपनी जमीन पढाई के खर्च के लिए बेचनी पड़ी .यद्द्य्पी ये वृद्ध दंपत्ति स्वयं अनपढ़ है .अपनी खेती की भूमि को बेचना उनके लिए बहुत बड़ा Risk था वैसे ये उनका साहस भी माना जा सकता है .ये भूमि मृतक के पिता ने अपने भाइयों को बेची थी .भाइयों ने इन्हे भूमि के मूल्य के अतिरिक्त एक बड़ी राशि उधार पढाई में सहयोग स्वरुप इस आश्वासन के साथ दिया कि वे(मृतक के पिता)पूर्व की भांति बेची गयी भूमि पर भी खेती करतें रहे और उधार की रकम जब पैसे हो जाएँ तो लौटा दें .पढाई के दौरान पैसे की पुन: कमी पड़ने पर इनके बेटे (मृतक )को शिक्षा ऋण (Edu. Loan) का भी सहारा लेना पड़ा ,जो गाँव के एक सहयोगी की गारंटी पर प्राप्त हुआ.खैर पढाई पूरी करने के कुछ समय बाद इसकी नौकरी भी लग गयी और सबकुछ ठीक चलने लगा इस बीच उसकी (मृतक) की शादी (Arranged Marriage)भी हुई किन्तु दुर्भाग्य से नौकरी लगने के ढाई (2 वर्ष 6माह )के पहले ही उसकी आकस्मिक मृत्यु ही गयी. दुखद बात यह भी है कि मृतक के अंतिम संस्कार के अगले दिन ही अपने मायके(बहू के माता-पिता का घर) चली गयी और दोबारा अपने सास –ससुर के पास नहीं गयी .हाँ ये बात अलग है ,अनुकम्पा के आधार पर नौकरी पाने तक उनसे संपर्क बनाये रही.फ़िलहाल मृतक की माता गृहणी (House Wife) हैं और पिता मनरेगा(MANREGA) में काम करने वाले मजदूर .यहाँ सवाल ये नहीं है कि वृद्ध दंपत्ति का भरण पोषण कैसे हो रहा है या कैसे होगा ?सवाल ये है कि ये जो कुछ भी हो रहा है इन वृद्ध दंपत्ति के सम्मान और मानवीय गरिमा के अनुरूप है ? न्यायसंगत है? इन Senior Citizen को न्याय (Justice) और उनका हक दिलाने के लिए Civil Court मेंCase File की गई है. माननीय न्यायालय ने अपना फैसला (Decision)सुनाने के लिए निम्न तीन प्रश्नों पर जबाब माँगा है -
1- क्या हिन्दू बहु(Daughter in Law),Hindu Law के हिन्दू दत्तक एवं भरण पोषण अधिनियम(Hindi Adoption And Maintenance Act-1956) कि धारा -22( Section-22:Maintenance Of Dependants ) के तहत सास –ससुर( Mother in Law And Father inLaw) को भरण –पोषण ( Mintenance) देने के लिए कानूनी तौर पर बाध्य है ?
2- धारा 22 (1) में वर्णित सम्पदा(Estate)शब्द से क्या तात्पर्य है ?
3- क्यामृतक( Deceased) की पत्नी (Wife) को अनुकम्पा (Compassion)के आधार पर मिलने वाली सरकारी नौकरी (Govt. Job) और अन्य क्षतिपूर्ति की रकम सम्पदा(Estate) कि श्रेणी मे आता है ?
उपरोक्त से सम्बंधित यदि कोई Suprem Court ,High Court या अन्य किसी सक्षम न्यायालय का कोई Decision और Case Law हो तो उसकी जानकारी देकर मेरी और वादी Senior Citizen कि मदद करें . इससे सम्बंधित किसी law की book में कोई उद्धरण हो तो शीघ्र बताने कि कृपा करें अनावश्यक नए सवाल न पूछे क्योकि Court में अगली सुनवाई की तारीख़ निकट आ चुकी है .

इसी तरह का एक मामला Smt. Bhanwar Kanwar v. UOI & Ors _10 July 2012 ( Civil Writ Petition No.-11813/2011 _Rajasthan H. C. -Jodhpur है .

125 crpc

sir my wife left me on march 2014 and also my 4 month old son and Fir against me and my family in april 2014 u/s 498a/406/323/506/34.now case is under trial and she also file 125 crpc for maintenance but she dont want to take my son in her custody nor she file for child custody till date.is she liable for maintenance even she also deserted her infant child.

Not giving original certificate back to employee

Sir i am working in a shipping company for the last 3 years and now after coming from ship I had to undergo three courses which are very important to be done if I wish to sail again on any ships.For that I have to take a letter from my company stating that I have worked with them for the last 3 years and please issue him the certificate.This letter has to be given to me from the same company where I have sailed my last 2-3 contracts.Accordingly my company issued me the letter and I submitted the letter to the concerned authorities to obtain my certificates.Now my company has received my certificates which I had applied and it is in their custody.Now after three years of service in this company I am planning to switch over to some other company where I will be getting more salary than I was getting here in my previous company.Now when I called them and asked for my certificates they are saying that we gave you the letter to obtain these certificates and now when they are ready you want to back out from us.I told them that I am changing the company just for more salary because I have taken 2 loans and it is become very difficult for me to cope up with the old salary.But they are showing no interest in giving back my certificates without which I cannot sail in any other company.They are saying that u sail one more contract and then u go somewhere else.But next time when i come from ship again there will be some course or certificate to be obtained and again I will have to ask them for letter to obtain that certificate and again they will tell me to sail once again and I wont be able to quit the company for ever.Sir I would like to know whether can any employer hold back my certificates if i want to quit the company,and there is no bond between us in writing and I have not given anything in writing also that I will sail with you again after getting my certificates. Therefore I request you Sir to please advice me course of action in this matter so that my certificates can be obtained and I can sail back in some other company

Opposing Bail of Inlaws

I have filled a case under section 498a/323 and 3/4D.P.act against my husband and inlaws. Chargesheet has been prepared by police on all the above sections. And going to submit it to the court in a week time. My inlaws are very powerful people. I just want to know that how can i assured that the accused would not get bail. Whether i can file some writ petition in highcourt for opposing bail. As my inlaws are very powerful people, they will apply all their efforts to get the bail. Please suggest what to do now.

father's Second marriage

My father is planning a second marriage which i do not approve of, after death of my mother. The house we live in is in my name. If he gets married do i have legal right to ask him to vacate my house. Can he make any claims as per family law for sustenance etc. I also want to ask what liabilities does one have towards step mother and step brother or sister.

too much delay in settling my full and final settlement

Sir I have joined a telecom company in oct-2015, I joined this company same day when thay interviewed me on the aggrement of 1 month basic by back policy but unfortunately I didn't took it on writing but after one I have mailed them for pending 1 month basic salary as they committed, they asked me old Employers appointment letter that also I gave them, one more issue is as per new joining policy I'm eligible for 15 days hotel stay or own accommodation I took 10 days own accommodation approval from reporting manager, I sent all those printed copies to finance but they asked me hr head approval I went for approval but hr not approved said he did not promise me for that accommodation, I disturbed because they did not settled 1 month basic now own accommodation also rejected then I went to my immediate manager he also tried but get positive response, I have requested fighted with them many times one they called me office asked me to Resign so I have Resigned , as per company policy 3 months notice period has to be served or Company will pay you 3 months salary they recovered all things from me payed 2 months salary my last working day was June 18th, after 18th and within 45 days f&f must be settled but still settled, Please suggest me shall I go legally? ?

Transfer of right of deceased female

My question is under Hindu succession act property of female or right of female in ancestor property is one of the same thing?

For example Mr A died without any will having a one house property. Mr. A has only 2 daughters i. e. B and C. C is also pass away withot will she have a 1 daughter and her husband as a legal heair.

Now Mr. A's property how divided between his 2 daughter one of them is died?

Vat on under constrution property - final amount

Our builder continues to ask for VAT on flats purchased in 2008 from 2012 onwards . His amount has remained constant and at approx 5 % from 2012-2016 despite various trade circulars providing clarity on methods all the way upto 2014.

1. His requests are only in form of letters
without any computation

2 Through RTI i know he did not pay vat
in time and received notices and
finally an ex parte order with
interest and penalty exceeding the vat
amount .

3. He only claims his method is under Sec 58 but at 5 % his amount is 3 times what we think it should be

4. Society has been conveyed and possession letters given long back

Questions for experts

1.Is he within MVAT law to claim a figure from buyers without giving any backup or tax invoice

2.Is he oblidged to give proof of payment if i insist .

3. if there is a vague clause in contract that service tax and all other taxes to be borne by buyer ... does it become a perpetual surviving clause or it has a time limitation of 3 years fro his demand
