Child custody for nri

Hello Experts,
I am posting below query for a friend who is really in need of help.
She got divorced contested one 3 years back in US, where it was mentioned that the children would come back to india with the mother and was granted alimony for only for 2 years.
However, now her husband has remarried and has also managed to get complete custody of the two boys in case the mother has to come back to india once her visa expires. The father is also not agreeing to renew the children s passports.

She really wants to come back to india and wants to know if there is any way she can get her children s indian passports renewed without the father s signature in the US? They are all indian citizens.

Regarding name change.

Respected Sir,

My daughter name is S.BHARKAVI@KIRUTHIKA.In all her school 10th standard and 12th standard marksheets, college degree certificates her name is as S.BHARKAVI@KIRUTHIKA.But in her voterid and aadhar card her name is printed as S.BHARKAVI ALIAS KIRUTHIKA.When we contacted the corresponding officials they are saying that you cant have alias name in voterid and aadhar card.They said that @ can not be printed in the voterid and aadhar card.Sir can you please give us some suggestions regarding this.

Fate of consent terms filed in courts

Happy Diwali to all experts. I have a tricky query as under:

What happens to Consent Term Order passed by the court if the agreed terms are not implemented within agreed period ? Do we need to court again for extension ?

Society formation by builder

1. I purchased a flat in a multi buildings scheme of Builder in Pune in 2013, possession of which I got in the month August, 2014.

2. It is in a scheme of 16 buildings of which 12 building are complete & possession has been given to the buyers.

3. Remaining buildings are either yet to commence or half completed.

4. Initially builder had verbally mentioned that he is going to form single society.

5. However, now builder has officially proposed to form 12 different societies and later 4 more societies will be formed i. e. everey individual building will be independent society.

6. There are many facilities and amenities those are shared by all the buildings commonly e. g. Garden, Parking, Swimming pool, Internal Roads, Society Hall etc.

7. For the operation and maintenance of common amenities, builder has proposed formation of an apex body.

Now, My questions are:

1. Is the decision of the builder of forming the different societies is right and correct in law? Does he enjoy the absolute right to form a single or multiple societies at his will?

2. What are the pros & cons of forming a single society viz a viz multiple societies?

3. If majority of flat owners are for and of opinion 'Single Society should be formed', can Builder go against the will of Majority of Flat owners and still form multiple societies?

Please help me with expert advise. Thanks in advance.

Stamp paper

A stamp paper is purchased in the name of Advocate "A".
The same is used to execute a Sale Agreement of Land between Vendor "V" and Purchaser "P".
Advocate "A" has signed as 'identified the parties "V" and "P"'

Who are parties to the agreement?
Is this document admissible in evidence?

Employement

dear sir

in the year of 2009 i have applied for the post of admin in PSU. as per advertisement education qualification required was university degree. i have applied as per this giving university degree. but, in employment application format they have mentioned i do not have any other qualification than specified in prescribed application format. but, i had LLB at the time of applying, but applied on the basis of BA becasue in advertisement clearly mentioned selection on marks basis. now company has given charges sheet on suppression of fact. since in advertisment very clearly mentioned i have to have university agree and have to meet eligibility criteria, what are the relevant for the post only i had given, now how extenet company is right to give charge sheet for false declaration. please advise me

Taxation on registered will of non blood relation.

Hello Respected All,

If the executant of a registered will is not a blood relation to the receivers in the will, then will any taxation be applicable on the fixed deposits and saving account amounts or any other such amounts mentioned in the will to the receivers after the demise of the executant? Besides the will all above mentioned accounts and amounts are jointly in all the names of the executant of the will and the receivers as either or survivor.

sale deed

Cheque has been bounced due to insufficient balance which is mentioned in sale deed, but we made payment through RTGS and we have got the bounced cheque with me . I want to know is there's any problem for us or we want to make rectification deed.
