Employee stock option fraud

Hi,

I was employee of pvt ltd unlisted company. Company has been giving me ESOP worth 3L since 2 years and not I have resigned and asking money back since they have not followed procedures and there is no polocies on ESOP mentioned. I consider this as fraud and breach of rules and regulations of ROC bangalore. ESOP is not in the perview of labour office. Can I approach civil court for this. What is the procedure. How to address civil court.

Ppf withdrawal limit of non contributing account

Hi
I am a software professional currently self employed.

I started my PPF way back in 2000 for tax saving purposes with regular contributions to my PPF till 2015.

However in 2013 I got a good long term job opportunity in US and moved there with my family.

In 2015 my PPF completed 15 years and as I was not in India I made no contribution in that year.

As per PPF rules to continue membership after 15 years the PPF member needs to make a contribution withni 1 year of the maturity of the PPF scheme and if no contribution the member will not be able to continue to his PPF.
However interest will continue to be accrued.
Of late I wanted to withdraw part of the amount from my matured PPF but I was informed by my bank in which I have my PPF account that after maturity and post non contribution part withdrawals are not allowed hence I would have to withdraw the entire amount in one go.
My question to experts is:

1) Is there any such rule that restricts partial withdrawal post maturity of PPF and after non contribution.

2) If I so withdraw the amount will it be considered my income for a FY.

3) If I have to withdraw the entire amount can I move it to the bank account of my family member.

Please help.

Road accident case under 279, 338 & 134(a)(b)

Hi I want to know time limit for RTO inspection and time limit for which car can be kept in custody of police station.

Actual facts..
I met an accident with my activa bike which hit an old lady causing her facture in leg. After accident I took her to hospital and called her relatives. Then left for my classes after leaving them in hospital. As hospital was not admitting her for operation her relatives said its case of road accident to admit her in urgent basis (emergency room). Afterwards police came to hospital and asked for statement, they did not give any statement and said that they do not want to file any case. Next day police came to my classes in search of me and called me to police station. In police station they took my driving licence, bike papers (insurance, bill and rc all in xerox), bike keys and bike in their custody for RTO inspection, they handed me a notice and said i have been booked with police case under section 279, 338 and 134(a)(b).
My question is
1. What is the validity of the police case without patient's FIR .?
2. And time limits for rto inspection as asked above. It has been 3 days my bike is still in police station.
3. Is there any further procedure and formalities?

Filing defence evidence - private expert opnion

respected lawyers,
i am accuced 1 in 498a case "cc430/09 in Additional Junior Civil Judge, Addanki, andhra Pradesh."
sineario:
pw1 has stated i had traveled from chennai to her maternal home on 13/1/2009 and threatned her & her father for aditional dowry
i have summoned attendance register from the college where i was working in my defence,(i am no longer working there)
attendance has my initals on said date,
procetution during cross of DW1 asked a leading question that the initals of said date differ from my other initals, for which DW1 answered " it seems so, but he is not sure"
to support my evidence i obtained court certified copies of attendance sheets and obtained expert opnion from truth labs chennai that "the initals of the said date agree consistantly with other accepted initals"

now APP is objecting to accepting as evidence the expert opnion submited by me

i am requesting to you learned experts for your esteemed Counsel in the following queries
1) can APP object to defence filing evidence
if yes to what extent
if no how can i object her interferences (under which clause)
2) can private expert opnion be accepted atleast as secondary evidence (APP's main objection is that expert opnion is from private person & not gov forensic labs.)
if yes is there any supreme court judjements which have used private expert opnion. kindly help
3)i belive there is a supreme court judgement that stressed " all evidence has to be accepted & if they are irrelevent they may not be used while passing judgement" i saw the judgement while browsing net few years ago, now i am not able to locate it despite my earnest effort, kindly help me with any link for such citations
4) under which claused can i plead my need to add my evidence into the list

Weather mutually physical relation is amount to rape

Dear Experts,
i am married and working as senior level officer in MNC before five month i had physical relation with my female assistant mutually. however i never lied and promised to marry her. but now she is threatening me to leave my wife and marry with her. she admit that if i don't marry her she will file the case of rape against me as first promised for marry only to be physical with her and later denied for marry. since i never promised to marry her it all was verbally hence i have not any concrete evidence for the same that i had promised to marry her or she is lie. pls clarify in this case can she file the rape case against me if so how to get out of this problem any remedies?

One Company in West Bengal has to issue share-certificate.Can any one tell me,what is the stamp duty payable in that state for issue of Share-certificate?

Gumast licence

Hi Experts,

Greetings for the day.

I want to start business as propriator where I will buy products from someone /manufacturer and sell it under my name(online/offline).
And in future I have plan to manufacture the same product.

Please help me with which type of gumasta licence ie shop, commercial or other and anyother documentation required to start business.

N.I. Act jurisdiction

I filed a n.i. act complaint with court of wrong jurisdiction I.e. my bank account was maintained at different branch, but I taken it at different branch by mistake, therefore the jurisdiction of court was different. Summon have been issued by the incorrect jurisdictional court. Whether it would create any problem to me. How I can I rectify , if required. whether I should shift my account to the branch which is mentioned in the complaint.

Settlement and 498a

Sir, my wife filed various cases against me and my family members. Now we agreed for mutual divorce on an amount. She is ready to cooperate in 498a. I am an govt. Employee and my promotion case is under sealed cover.
And promotion and financial benefits will provide only on acqutal on merit.
If there is benefit of doubt or acqutal on lack of evidence then no financial benefits will allowed to me.
My wife's chief is completed and her cross examination is closed due to absent of her.
Please suggest what should iIdo.
Whether she will hostile and if yes will decision allowed me acqutal on merit. Or I should go high Court for quash of 498a.pl. Suggest. If high Court quash 498a what will be there in its decision.
