Resignation procedure from trust

yself, my father and wife are member of a trust consisting of total 7 members.

The other mmebers are also part of family .

The sister is chairman .

My problem is the chairman and members are non cooperative and never conduct any meetings.

We want to withdrawn our name from this trust my resigning .

in this case how do we gracefully and legally resign , even if there is no response from the chairman and other members to our resignation letter.

The bye laws says that approval of working committee of trust is required for member resignation.

I need to know if we can legally resign without having to take approval of other members.

Requesting for your advice on same.

retirement of co-operative society secretary.

My dad, our society secretary, has resigned from the post due to health reasons. There is still a long time to go for the Society Managing Committee elections. In such a case, what should the committee do to appoint a secretary in place of my dad, who would carry on the activities n duties of a society secretary. What procedure should be followed. Thanks.

Car loan company agents harassment

Hello,

This happened with us. My wife took a Car loan on her name 5 years back. Due to some issues we felt back on the payment which was through ECS. But as soon as our situation improved we started clearing the payment.

Just three months back we had some 4 installment pending, I called up the Collection person from the bank and asked him for a closure amount so that I can pay the entire outstanding in one go. He told me to pay Rs.68k and I paid the complete amount.

Later, as I didn’t get any loan clearance mail from the company, I called up the collection team for an NOC, but was shocked to hear the officer saying that two of my installments plus some exorbitant interest amount is still pending. I told him that I was given a commitment of a closure and why now this two installment plus Interest demand. The Collection officer did not reply back but started sending recovery agents after us.

Today my wife got a call from one guy stating that he is a Senior Police Inspector from Delhi HIgh Court and he is preparing to send us a Non-Bailable Warrant so wanted to confirm the address. He said that in a day or so they will send us a warrant to arrest my wife.

My question is … is the Non-Bailable warrant possible?? We bought the Car Loan in Mumbai and the Non-Bailable warrant call is coming from Delhi. So can the Car Loan Company issue a NBW from Delhi? What are the actions can we take against the harassing Collection officer? How can we save ourselves from paying the exorbitant extra amount that the Car Loan Company is asking? What are the legal recourse that we have?

Please advise.

Cultivation on land can be stopped by seperation suit

Hi
We are 2 brothrs and 3 sisters

One of my brothers who stays in a diffeent state since last 30 yrs want his share now ..we have asked for 2yrs time for my daughters marriage

Now he is threatening to file partition suit and file injunction and other laws so that i cant cultivate the land .

I am a poor farmer..
queries:

Can he stop me from cultivation as other sisters are with me

Can he stop me from havin tenants in the ancestral house

Pl help me urgently

Punjab rent act

tenancy of urban property in 2014 but document of tenancy not registered as per the punjab rent act.

document of tenancy should be registered. now what is the remedy for the landlord. in view of citation 2016 (1) RCR (R) 525 CR number 3509 of 2014 decided on 9-5-2016 by justice ajay tiwari punjab and haryana h cthe provision of east punjab urban rent rest. act are not applicable to the tenancy commenced after 30-11-2013

Criminal intimidation and threat

Hi,

I am a professional working in Gurgaon and belong to Nepal (a Nepalese Citizen).
I had some issue with a girl over relationship that I was dealing on personal level with her and her parents. I asked Mr X (friend of that girl) on one-on-one basis to discuss few things and sort out the matter as agreed between X and me. However X brought a gang of 5 people including himself along with the girl to beat and threatened me. I asked him to leave me and talk some other day as I sensed the mood of the gang was violent. I was about to leave but caught by a member of the gang, to talk out. I was manhandled, assaulted without physical injury and racially abused. Two of them caught me by hand and another person snatched my mobile. They made adverse comments threatening in nature like “Nepal ka hai na, yahin kat ke gar doonga”. Some of them called me with derogatory term and racially charged words like “Miya hai, maaro saale ko”. They released me after 30 minutes of ordeal and returned my mobile.
Next day I was about to file a case against them but I was stopped by some common friends because of their career and friendship.

On next two, regarding the girl, I was in contact with her papa and I used to discuss everything with him. The girl filed a complaint against me for harassment which was later compromised between the girl and me vide police record. On the day of compromise, one of the gang members was staring me unusually and with threatening intention inside the police station. I asked him “ Ghhoor kyun raha hai bhai”. Then he replied “ To aur kya karun”. Anyhow I left the police station and came to office. There has not been any compromise from these guys. I am very scared and mentally depressed. I fear that I will be beaten again on some pretext. I applied for special leave from the office to stay safe. However I am afraid to join office now because this gang scouts everywhere near my office premises and can physically assault me on any pretext.

Is there any way I can file a complaint against them and get written assurance from them for my safety and well being?

Can c.a of defendant conduct cross examination?

Hello Respected Experts,

The case is regarding evac of a old rented house which is filed by plaintiff based on false grounds. We are the Defendants, landlord being the Plaintiff. I am the C.A of Defendant (son) and defending my own case. Not that I am a lawyer but circumstances has forced me to do it myself. Defendant being very old person (90+) cannot come to court to take cross examination of Plaintiff. For 2 hearings the cross examination happened which was taken by me. But in 3rd hearing, suddenly Plaintiff's laywer brought a point that a C.A of Defendant cannot take cross examination, it needs to be Defendant himself. Is this correct?
Even if this is correct, and Defendant is old and cannot come to court so what can I do to tell/convince court that let me continue to take the pending cross examination?

Please advise. Thank you.
