Builder is selling his flat without NOC from Association

Dear Sir,

Builder is not paid maintenance since 2014 and now he is selling flat without taking NOC from apartment Association.

Sale is allowed as per law even though he is not paid maintenance for 3years.

What process we need to follow to get maintenance money from builder.

Sibgle NIA complaint for 6 cheques

I received 6 cheques of different dates . I presented all cheques together. and after dishonour all cheques, issued single notice for all 6 cheques. Whether I can file single complaint for all 6 cheques.

Respected Sirs,

My cousin Mr. Rajesh ( 41 years ) has a collegue at his office Mr. Palani ( 46 years ). They both are very close and Jovial. Secondly Rajesh and palani also shared their dais on Drama competition sponsored by Company cultural activities a very long back.
Recently Rajesh posted in FB message as " Veeradi veera Raja marthanda Raja Gambira Palani Maharaj ki Jai" on palani.
Since it's being social networking Palani though jovial all these days now become very serious about Rajesh and is on the way to file police case against Rajesh. More over Rajesh has send friend request to palani just a month ago and was accepted by palani.
Last week only Rajesh posted meesage to Palani and that too only once and not to hurt him mentally. It is just a drama lyrics practice only. Inspite of several requests but palani is adament to suit the case against Rajesh.

I request you to guide us sirs

Tresspass at burial ground

Tahsildar, filed false case again me tresspass at burial ground under ipc section 297, 427.

The some portiotion of land belongs to my father name and remaing land on the name of my uncle.

In records there are not mention any burial ground in records

How to get relief from these.

Please suggest me

Advocate commissioning

I purchased a butted and bounded land about 50 years ago and constructed my own house as per municipal sanctioned plan. Since then I am residing here with good possession, title, right and interest with proper government revenue records.
Recently, all on a sudden one of my neighbors’ who is in possession of a different C.S., R.S. and L.R. claimed that they own a piece of land inside my boundary and started creating nuisance and threatened to dismantle my 50 years old boundary wall. In consequence I was compelled to start a title suit and absolute injunction was granted in my favor. After several years of court proceedings my neighbor’s prayed for survey commission and the court appointed advocate commissioner. My queries are (1) Do the advocate commissioner now has the absolute power to settle my neighbor’s claimed piece of land inside my butted and bounded property or is the commission report will be a part and parcel with the previous evidences that has been already placed in the court. (2) What are my options if I feel the submitted commission report has not been executed properly?

Tenancy agreement & landlord

Our landlord is a Trust. Property is in Mumbai. The Trustees have been randomly transferring premises without entering and registering Tri party Agreement and thus pocketing the huge Transfer Amount without showing it in trust account/income. Apart from Charity Commissioner, which are the other Government Authority offices with whom a beneficiary can file a complaint against such unregistered transfer of Tenancy?

Major penalty proceedings-any admissions under duress to cbi

Learned experts,

In a criminal trial, any admissions/confessions by accused, extracted under duress by CBI (Police) is hit by section 25 of Indian Evidence Act. But In Disciplinary inquiry, what is their evidence value? As in the major penalty proceedings and Inquiry, though they are quasi-judicial in nature, the strict rules of Indian Evidence act is said to be non applicable.

In my case, my admissions form part of the surprise raid proceedings by ACB, countersigned by 2 independent witnesses. Can delinquency can be ascertained solely on their basis,in the absence of other proofs. Please help me!

Validity of marriage

marriage performed in Arya samaj, vermilion applied, garland exchanged but
Saptapadi has not been performed.
Is Saptapadi is essentially a requirement if both are Hindu (Jatt & Baniya)
There has been No cohabitation at all(both living at hostels separately, even after marriage).
Physical relation established prior to getting the certificate & continued afterwards also for some time.
marriage not registered in court, Boy now wants the certificate cancelled but the girl doesn't.

is it a valid marriage if customs not performed &
who has the burden of proof if the boy wants the certificate to be cancelled. can the boy get married to some other girl without getting the Arya Samaj certificate cancelled?

Purchase of Land

A husband purchased a landed property of his wife saying that his wife was in need of money and she announced to sold a piece of land for her need and as such he purchased the said land from his wife. Whether it is right or wrong act of husband as per law.
