Recover of interim maintenance (dv act)

Hon'ble Court has awarded interim maintenance of Rs. 7000 p.m on May 2016 under Domestic Violence case being filed in May 2015. Other party appealed regarding above interim maintenance order and we settled for Rs. 5000 p.m mutually in Lok Adalat from the date of filing.

My husband is in Admin Branch in Government School of Mandi (H.P) and earning Rs. 40000. Despite of being govt. servant and having that much Salary, he has just paid interim maintenance of 7 Months (In Parts) only out of Due 28 Months.

We filed Recovery Petition U/S 125 (3) an year before in Sept 2016 but he has paid only Rs. 32,000 out of claimed Rs. 80000.

We are going to file another Recovery Petition to claim Pending last 12 months i.e Rs. 60,000 as one more year has been passed without payment as he hasn't paid any current maintenance at all (Even partial recovery amount only as stated above for earlier 125(3) Application.

Please get response to following :

1. How to resolve above. Can we just keep filing Recovery Petitions like that
2. Can we get his Salary Attached. If yes, then it will be great if you can tell me the procedure for filing that.
3. My Advocate is not helpful so it will be great if you can share Salary Attachment Application with me. I will be ever grateful to you. Thanks very much.

What are the chances of bail.

In posco cases with 354 CPC, if accused is ready for compromise and ready to give affidavit stating no such incidence happened. What are the chances of getting bail after filing chargesheet on the basis of affidavit in high court.

divorce

Hi all, My sister is married in November 2016. Recently we came to know that the boy is impotent and unable to do sexual intercourse. It was a cross cousin marriage. Now we are asking him to do thorough checkup and get proper treatment. But they are not accepting their mistake and boy is also told do whatever you can do but i wont do any medical checkup. We tried asking through mediators but no result. What is the way out for us. If we go to court with a divorce petition how much time it takes for entire process. Can we get divorce sanctioned on impotent issue as the main criteria

False dowry harrasment case

Hi myself a doctor from haryana ,, my marriage was held on 26 Oct 2016 ,, my wife gave a false dowry harrasment complaint to haryana woman commission on April 2017 which was marked to ssp hisar and then to women Cell ,,, I got a caĺl from woman Cell on 22 july 2017 ,,, I gave my statement on 25 july 2017 in women Cell,, my wife did not turn up on the day and send an application to women celĺ that she being a lady can not come as she lives in punjab and wants to drop the proceedings,,,, and further said that she has moved an application to ssp roopnagar on same cause of action and same manner,,, she has used the word drop instead of transfer and I joined the investigation ,,, now shall I have to go his place in police station for the same application,,,, I further mention she has used the word drop not transfer or anything,,, kindly suggest

Will vs arbitrator (self acquired or joint family)

A Hindu female had self acquired property X in Pune Maharashtra is bequested by Will to 5 GrandSon in 1975 jointly.
This property is undivided and un-partitioned, 5 grandsons property who all are Hindu male.
This same property put in family settlement by private arbitrator (who are family relatives). Arbitrator had allocated same property in 2003 to these same 5 grandsons jointly as undivided share jointly.
Still no partition yet.

Q. What is the status of Property X, Self acquired (Indian Succession) OR ancestral property (Hindu succession)?(Any citation if possible)

Hindu family 2 GrandSons sold there undivided share in property to Muslim family by registered conveyance sale deed in 2014.
Remaining 3 Gransons has possession of whole property. Yet No possession delivered to Muslim family.

Q. Will it governed by Hindu succession s.22 preferential right or Muhammadan law Shufa OR Indian succession any other law?

sir,

Service tax was not applicable to industrial canteen. my question is, whether GST is applicable to industrial canteen of PSU, or is this exempted for GST.

Forgery in a property card

Dear Sir/Madam

I was staying in a chawl at malad (mumbai), many years ago i sold my room, but recently i came to know builder has made a forged documents and in government records he is showing my father as imla-malak in about 269 sq mtrs of area and developing that area in a city survey land records from 1970 it is showing in my fathers name its all forged documents index 2 and pherfar its all rubbish in a latest property card my father name is showing m very shocked i want to file a criminal case on developer as well as city survey, how should i fight and under which section?

Settlement in criminal in case property seized by police

1) Can CJM modify/change his order ?,(first he imposed condition of bank garuntee, after on the application moved by applicant that applicant is unable to submitt, he relaxe the condition)
2) Propeerty (i.e. FDRs in the Bank) seized by police and deposited in the court. Now, complainant and the third party from whom FDRs seized can settle the matter out of court.
