Jurisdiction of criminal appeal in session court

Hello sir/madam
Sir I want to know...Under section 378(4) of crpc whether session court have jurisdiction to entertain appeal in case of cognizable nd non bailable offence?
Or suggest me what is proper interpretation of section 378 of crpc

Squash of FIR

False FIR is registered in PS covering section 498a and 420. If squash petition is filed in high court how much time does it take for squashing FIR. Please advise.

Certificate of sale

A person is claiming a land as owner with the help of a certificate of sale which is of the year 1970 and it's auction is done by custodian and it is not registered so what legal action could be taken against him

Gift deed execution on equitable mortgaged property

Dear All,
My Dad is sole owner of a residential plot.My dad age 59,my mom age 51 and myself age 33 we jointly applied for a home loan in year 2015 for construction of a bungalow for self use.We took the loan from a nbfc and its on equitable mortgage,we submitted the original sale deed of 1986 and the original municipal corporation sanctioned plan of the bungalow as title deed deposits.
The construction of the bungalow is nearly complete and we want to shift in the bungalow by November 2017.
My query is
Can a Gift deed be executed by my father to myself even if the home loan is still going on?or will i have to clear the home loan first and then get the gift deed done.
If we can't close the home loan can The nbfc grant us permission or something in writing to go ahead with the gift deed?whats the procedure for the above
Also is the completion certificate from municipal corporation compulsory before getting the gift deed executed or can the gift deed be executed and then the completion certificate be applied for.
What will be the charges incurred for the gift deed father to son in Pune Maharashtra?

Please help me to solve the following problem.

Amit had taken loan from Shyam lal by mortgaging his house for rs 300000 in march 2012 which he had promised to pay by Jan 2013. A year passed after the
expiration of time limit given by shyam lal for repayment of loan, Amit failed to
clear his debt. In Jan '2014, after non repayment of loan, Shyam lal threatens to sell his mortgatzed property (i.e. his house) by 3rd April 2014. On 3rd Feb 2014, Amit writes a letter to his friend, Rohit (a backer), stating his current condition and requests him to clear his debt from Shyam Lal before 3' April. Amit assures Rohit that once he had finished clearing of all the matters he will repay the amount of' debt to Rohit in due time. Amit requests Rohit to clearthe loan as soon as possible. Meanwhile, Amit was accused Dishonest Misappropriation of property U/S 403 of IPC, the trial of which had already instituted inJan201 3, amit is found guilty of the offence and on 23' Feb, 2014 he is sentenced for two years. Unknown to this fact, Rohit sends a letter to Amit on 24`. Feb, 2014 agreeing to pay the mortgage amount and save his house from resale. But the very next day he comes to know about Amit's conviction and thus decides to take no action regarding seting off the mortgage from Shyam Lal as a result of which Shyam Lal sells the house on 3 April, 2014 as he declared. On 4th April, Amit's brother, Sumit (who lived in the same house), informs Amit that Rohit did not clear his mortgage and thus Shyam Lal sold his house to some other person. Amit then asks Sumit to file a suit against Rohit for Breach of Contract .Thus on Amit's instructions; Sumit files a suit for Breach of Contract U/S 73 of Indian Contract Act, 1872.
Note: Indian Contract Act, 1872 is to be referred and give arguments. defendant side.

Widow Remarried selection govt job in widow category

Sir tell me if a candidate apply vacancy in widow category in 2013 exam. Result announced in jan 2015 and she select but still she is widow. After some time is get remarried in July 2016. Revised result announced in aug 2017 same vacancy she select in widow category. My point is that she still take compansiate/advantage for this vacancy or not. Need your suggestions for this matter. If there is rules please tell me.

Adopting husband surname after marriage

Dear Experts,
My wife has adopted my surname after marriage. I got my surname added to her name through central gazette. After that, We Registered our marriage under Hindu marriage act. The marriage certificate bears her name with my surname as well. My query is 1. will she have any problem while doing any higher education or private sector job with her new name. 2. Can we buy joint property now with her new name without any fear?? 3. Will she face any problem in future in inheriting my wealth including mutual funds, epf, ppf etc if I nominate her with her new name.

this agriculture land is said to be ancestral or not?

I have given all the required detailed information of that land in the following. This is very difficult case so I have not decided the land is ancestral or not.it is very interesting and more difficult.Please read carefully and guided me as soon as possible. My mother's father have land. my mom's father has got that land by his father's of father(great grand father) in 1964 by will. Because of my mom's grandfather was died after the birth of my mom's father.my mom's father birth in the year of 1949.and my mom's grandfather is died in the year of 1952.at that time my mom's Great grand father not partitioned of his land.The great grand father had two sons my mom's grand father and another one. Here the matter to be mention that my mom's great grand mother was joined with my mom's great grand father by SECOND MARRIAGE. And that two sons my mom's grand father and his brother borned by 1st marriage of great grand mother.after the 2nd marriage of my mom's great grand mother giving birth 1 GIRL(my mom's grandfather's sister).after some years The great grand father of my mom had made the will in the year of 1960. The great grand father had made that will on the two name. 1st the another guy who is my mom's grandfather's brother and 2nd on my mom's father because as I know before my mom's grand father is died at that time .And the small part of land giving to that girl by will.(my mom's grandfather's sister which is borned by 2nd marriage of my mom's great grand mother). My mom's great grand father had gotten that whole land by inheritance by him father( means my mom's great grand father's father) in 1924.so definitely at that time the land is ancestral.then how they were successful to make will? The will was executed in 1964 after the death of mom's great grand father. and the land were divided into two large part and one small part between my mom's father , my mom's grandfather's brother,and mom's grandfather's sister). Now my mom's father is decided to sell that land and will buy some new property on the name of their two sons(my mom's brothers).He want to neglect my mother. Now my mother can claim on that land before my mom's father will sell the land??? It is said to be ancestral property till now????The land chain start from 1924.(my mom's great grand father's father's time) Please give me some information as soon as . The land is situated at the posh area of the city. it's market value is in the crores now.

Validitation of degree according to supreme court

respected sir, i want to seek information regarding my SMU Degree. I have done my graduation in Bachelor's of art through distance mode from Aug'16 to Apr'17 from SMU. I was denied admission in IGNOU this year so please make me clear regarding the judgement of Supreme court, whether I can use my degree for central and state government Grade A jobs and whether i can go for higher education using this graduation degree.
I will grateful to you if you can solve my problem.
