Dear Sir
6 months back all 3 cases filed by my Wife
1) day 1 we got Bail from court to all of us
2) in DV case nothing is happening, only dates are postponing
3) CRPC 125, immediately court ordered interim maintenance on me to pay as wife demanded my account statement, Salary slip etc
4) we applied in high court for quash of 498a but we got stay orders from high court so in lower court nothing is happening
Now whatever movement is happening in 125
1) as per order from court, wife asked for details & i provided the same & based on it, interim started & i'm paying from last 3 months
2) i too demanded my wife account statement, ITR & property details on her name, but till date court is not ordering to give & everytime her lawyer is misguiding
As i am aware that my wife has done lot of illegal transactions from her account & in court she told that she has closed her account but from some sources we came to know that before closing itself wife has transferred almost 10 lacs & closed the account & in court she is telling that she has no income & not even sharing property & ITR, my wife was staying with me & not working anywhere still from last 6 years she was filing ITR, from where the income came
Please suggest what action should i take
1) can we apply in high court for same
2) is it right time to apply for divorce
3) as i'm paying maintenance, can i apply for child custody or visitation rights ( child age : 5 years)
any other steps to be taken please guide

My Passport is getting expired in next month & i have applied for Re-issue of passport online 2 months back.
The Problem is recently a case of 498a & domestic violence is registered on me from my wife.
So same i have given as declaration in GSR form as consulted by passport call centre
Upon my visit, passport officers are now demanding for NOC from Court which is very difficult to get
But in 498a, i have got stay orders from high court that there will be no proceeding in lower court.
As i have to travel abroad in December month on company tour & passport getting expired on nov,
Can the certified copy of stay order will be accepted by passport agents

I have filed the transfer of criminal case arising from an acquittal, from one session division to another session division before the High court u/s 407 crpc, as Judge made certain remarks against which gives me apprehension that he will be going to convict by overturning the order of the lower court. The High court has dismissed the Petition
We have still the apprehension, as certain new developments taken place, that session judge will overturn the order,
can we subsequently file the transfer petition under section 408 crpc, from transferring the case from his court to another court within same session division?
Whether dismissing of a petition under 407 crpc is a bar of filing the fresh petition under section 408 crpc?

My grandfather was Pujari of our village mandir and we got Agri land gift from raja rajvada, after my grand father passes one bad thing man wrote his name in record in 1969. in our family not any faced to them. They paid hafta of 519 and becoming owner and our name removed from record , I have question that Mandirs land are liable to names of other people? I heard that Mandirs land not sell or name to other so now what I have to do? And opinion of yours that for mandir related land act if any please

Sir, I live in an Apartment Association in Pune. Residents from the neighbouring buildings and visitors park their vehicles during the day, on the road outside the ground floor flat having 2 gates. Both buildings have insufficient parking. The ground floor flat owner claims that except him, (or residents of the association) no one can park on the road outside his house, even if they are not obstructing the gate.
What are the legal rights of the residents and outsiders with respect to parking on the road outside the building?

Hi.....i have a query.there is a property withhold by my late greatgrandfather-in-law but he had no 'will' that the same will be used/transferred to the future generation.Now as i want to rebuild the same property .The property tax was till now paid by my grandfather-in-law who died in 1950.My question is that is the property transferred to his wife without any hiership certificate and succession certificate.

there was a tri-partite consent terms entered between Accused, Complainant and daughter of Complainant ... Where consent terms are made on a rupees hundred stamp paper.
As per main conditions of consent terms, Complainant will withdraw a criminal complaint and civil money claim against Accused in return of which Accused will give rights to daughter of Complainant in another civil suit...
Now Complainant has expired. Deliberately Accused says that Consent terms ARE BOGUS FRAUDULENT AS CONSENT TERMS NOT STAMPED..
But Complainant and his daughter had complied with their terms as laid down in that document, when that time there were no discussions of stamping registration.
ALL LITIGATION WERE WITHDRAWN AGAINST ACCUSED FROM SEVERAL COURTS. DAUGHTER OF COMPLAINANT ACTING AS CONSTITUTED ATTORNEY OF COMPLAINANT WITHDREW PERSONALLY LITIGATION AGAINST ACCUSED.
Purposefully to resile from consent terms, Accused says that consent terms ARE VOID, BOGUS AND INADMISSIBLE AS EVIDENCE BEFORE ANY COURTS SINCE CONSENT TERMS NOT STAMPED REGISTERED..
REQUEST YOU TO PLEASE GUIDE ME.. AS IM THE VITIM AND DAUGHTER OF COMPLAINANT AND HAVE BEEN HARASSED AS ACCUSED IS VERY POWERFUL

I met an accident a year ago and I have been charged under IPC 279 , 338. The case is settled by out of court settlement. After that I wasn't summoned to present before the court. My lawyer said that the case is now between MACT and victim and he gave me a paper that shows 'finding' and 'plea' as 'Not guilty'. Can I apply for a passport now? Did I need to mention the case details?
