Declaration of self acquired property.

Sir,
My husband has filed a suite for declaration of his self acquired property at his native. The said property is occupied by brother in law who is disputing and claiming for share. In the primary court judgment was given as the case is partly disposed and declared my husband as sole owner of the owner of property in 2013 April. As against this my brother in law has gone for an appeal before next higher court and the case is pending there since from 2013. His advocate is simply taking time before the court and pulling the case. He is not completing his arguments since from 4 years. How long the appeal case can take for finalization. Is there any time limit for completion.

Mental harassment at workplace

Hello, My team of 6-7 people facing mental harassment due to one of reporting authority.No one is daring to complaint as the person is closely associated with a political party.He threatens to use power to throw everyone out of company and also harm them personally.I feel bad for everyone.Need some help what should we do?

How to check RERA authentication

I have booked a 1 bhk flat in Jan17 and it's registration is still pending.
I asked builder about rera number. But he doesn't give me number and says he is rera registered. And evenif he gives me RERA number, how do I know that rera number is authentic.
Or could i check builder is RERA registered from builder name.

Please guide me.

Possession of property as legal heir

my husband made a will in which he gave a house to our daughter and son in law. but last year our daughter died in car accident. my husband also expired after few months. now my son in law is having the possession of that house . so can i get the house back from him. as i read that if beneficiary dies before person making will. the will gets cancelled.

Conflict of interest in managing committee of housing soc

Hi, and Seasons Greetings
Can AB,an employee of Co uvw, which is part of Group XYZ LTD, be a member of MC of a CHS, under following conditions:
1. A sister-Co CDE, also in the Group XYZ, has developed the Soc, and has failed to deliver
2. Conveyance is not given, even after 5 years of initial occupation, and 3 years from completion
3. Deficiencies of Service, will cost upwards of Rs 100 CR to remedy / rectfy - besides compromises to lives of
property & equipments
4. Claims by MC have been raised very scantilly, and shabbily - and mostly without acknowledgements
5 AB is currently Secretary, and the Soc has to confront Co CDE
6. A lawsuit seems inevitable
Grateful urgent advise please - as Chairman & other MC-members do not see any problem, in AB continuing on MC

Cancellation of engagement

Dear Sir/Madam

Kindly advise if there are any legal challenges to cancel an engagement?

I had an engagement last month( not took any dowry).... on our every conversations, I am realizing that behavior/attitude of the girl is very stubborn. I am afraid to marry her, as her attitude does not let me live happily and my parents (as I am single son for my parents)

We had an engagement in a party hall with our relatives, and there was a photo session arranged? would it create legal issues ?

question regarding doctrine of Lis pendens

Hello experts,
I want to ask a question regarding a property I purchased recently 6 months ago.
The details of the case are as below
A (petitioner) filed a perpetual injunction suit in year 2000 against B (defendant) and the case was dismissed with costs in year 2010. A then filed a appeal against the decision of the judge in the same court which is still pending in the court. B has already sold the part of suit land to C in the year 1995 which is 5 years before the start of the suit in year 2000. C has then sold the same land to D ( which is me) in 2017 as I got it registered under sale deed in.my name and I am also in possession of the property.

So my question is as below
1) If A (petioner) the appeal is allowed in the court. Is the decision binding on me? do I also have to surrender my property to the petitioner? I am asking because B has already aleniated the property to C 5 years before the start of suit date and I heard doctrine of Lis pendens does not apply if the suit property was alienated before the start of suit.

2) If petitioners appeal is dismissed in court, can he start a fresh suit against me to recover the possession of the land?
I heard from some one that he cannot file a fresh suit making me the party because it will attract principle of resjudicata as the matter of the suit land has already been decided by court. Please can you experts clear my two doubts for which I will be ever greatful to you as it will ease my mind of tension.

Want divorce from my wife because she is mental disorder

Hi Sir/Madam,
My wife is patient of depression & is taking medicine to control depression, which she is caring with her as daily dose. My father in law had never informed me about her daughter disease before my engagement or before my marriage to her daughter. As I was not familiar of the disease & symptoms�. My marriage was done 1 year 8 month earlier. My father in law has cheated me & my family by not informing about her daughter disease before the engagement /marriage & had taken the marriage in place as scheduled.

On reaching My place she started quarrelling with me on daily basis & breaking the kitchen items & cell phone. Now, she is threatening to me & my family that she will file a case against me & my family. In the mean time my father in law Mr mother in law and brother in law are also threatening to me.
In this situation if anything happens to my wife then myself & my family members will not be held responsible. as she is patient of depression & is undergoing treatment for last 5 years and before my engagement date.
Note:- I have all doctor prescription and threating call by her.

Please suggest, what can I do?

Receiving property allowed by sessions court

It is about one of my friend who is a Sr. Citizen, about 67 yrs old and have no income for many years due to a criminal case (Police PW). After arrest all his properties, Bank A/c were seized by Mumbai Police. Complainant while the accused was in custody, able to obtain from MM many of his properties including cash money. After released on bail, accused challenged the order of MM in Sessions Court Mumbai and this court allowed return some properties to accused on submission of bond. Complainant filed a petition in Bombay High Court and was able to obtain a stay order. My friend being penniless and dependent on well wishers for living, did not follow up after stay order as he shifted to home town. Bombay High Court dismissed the complainants appliication in Jan 2016 but neither Mumbai Police informed him on this decision of Bombay High Court knowing well that he (accused) attending trial in Addl, CMM Court nor the complainant who represented High Court through his advocate returned the properties ordered to Mumbai Police knowing well of the rejection of his petition by Bombay High Court.
The accused came to know only a month ago about dismissal of the complainant's petition when as a matter of curiosity he went through Bombay High Courts website. How he can get back the properties allowed by Session Court Mumbai to him? How much he need to spend for certified copy of the session court & High Court orders ? He is penniless but to some extent we can assist him financially but we also have limitation as we, friends of accused, are also retired. Any sympathetic advocate will help and advise on the above on humanitarian ground?
