Judgement

Respected sirs

i was working in a company as administrator.i had been issued charge sheet for false declaration in employment application regarding qualifications. company only conducted departmental enquiry by internal officials and proved the charges and i have dismissed from the service. i have filed Writ Petition in High court. Since enquiry is committed court prepare to remand the matter to civil court.

but, company issued the charge sheet for no misconduct. there is no false declaration in employment application.

one more thing is application filled in the year of 2009 and joined in 2013.

i have taken contention in enquiry that, the rules of the company applicable only upon joining company hence charge for so called misconduct charge sheet should be given. company got power to cancel the appointment letter without notice immediately. but enquiry conducted, which was not necessary.
i am requesting kindly provided me some judgement as

1. for no misconduct, the charge sheet should not be given.
2. even though charges are proved high court can appreciate the evidence and document done in DE
3. company rules cannot be applicable to employee before employee join the company.
4. disciplinary authority and presenting officer, enquiry officer are interested person being employee of company proved charges and high court can interfere with the enquiry findings.

Kept for CAV

In a civil matter in High court, we are petitioner and division bench has noted" as kept for CAV..and matter is pending for 5 months. So what does it means ?is it judgment in our favour?

Grandmother-in-law's will

I am a Christian girl married a Hindu boy according to Hindu rites and customs in July 2014. I, my husband and our two children (son, daughter) lived in the house self-acquired by his Grandmother. My Grandmother-in-law expired in December 2016 leaving behind a will dividing the house in three equal shares one for my husband and the other two for my husband’s two married sisters. In June 2017 my husband expired. Now my husband’s sisters say that only my husband would get the share mentioned in will I am not entitled to it and his share will be divided among them as their names appear on the will. Is this true? After my husband death do I have the right to claim his share mentioned in the will?
Please advise.

Child custody

Respected Sir/Madam, My wife has lost her memory completely, she is physically and mentally abnormal due to the side effect after outcome of suicide attempt(hanging herself). Now she is living with her parents. My in-laws filed a case against me u/s 498(A), case is under trail in court. All this happens in 2013. They kept My twins girl childs from 2013 to for 2017.

In May 2017 they sent my childs to my custody. I admited them in prestigious school by giving huge donation. But now they suddenly forcing me to sent back my child to their custody and they told that they wil take my childs in the month of April without my knowledge when I'm in office. with my in-laws. How can I retain my childs as per law.my childs are ready to stay either with me or with my in laws

Moot problem

sir/madam,
i have a moot problem. it is criminal. this problem is where a doctor consumes marijuana and sells which is ilegal. he complains that his laptop is lost, FIR is filed, police investigates and finds that assistant of doctor has stolen it and found marijuana packets in the laptop. later police investigates and doctor confess all the truth, now doctor, assistant and another accused is arrested, they are convicted under different sections. later an amendemnt comes in narcotic drugs and psychotrophic substances act. now they all appeal. so now who is the petitioner and respondent

in this problem.

Experts and kind people,

received a summons from the AJMC, for a complaint filed by my estranged wife on the grounds that i have stalked and fought with here.

Have received a summons from the court to attend next week. She has claimed that she has witnesses and the stuff, but has not mentioned any names.

could you help me understand the sections and also how to counter them.

Eviction of a person who is not tenant but was in possession

Learned seniors,
In which provision I must file a suit to evict a person from house, who is not a tenant but was living with the permission of plaintiff's father. what is the limitation period. Plz guide.

Passport related query

I have applied for passport from delhi(home town) but my job (GOVT/PSU) in punjab so i have not issued passport from delhi and my file have been close and i want to apply again from punjab .if i mention in it that i applied for passport earlier but not issued is there any enquiry will proceed related to it.? or should i hide it to apply fresh passport application. kindly suggest me.

about murder case

My fathers murder cas is in pending in court..May be soon the judgement will come.. If Judgement doesnt go in my favoure how can i challege in high court...Plzz tell me the procedure
