sir/madam,

While interpreting a legislation made in furtherance of dpsp of state policy, what method of construction the court should adopt .

Plot development scheme under rera

Dear Expert,
I have booked a plot in monthly payment scheme in 60 Equated amount. Scheme started for the period from April 2011 to March 2016. Developer neither registered allotted plot to me nor developed land, which was promised at the time of booking. My query is whether RERA is applicable , if yes then what are the legal proceedings..

Education loan

Respected Members of Club,
My brother had taken a education loan from PNB in 2010 , he died (quitted) , after 8 years the bank is now keep asking for the settlement , but there are 3 elder sisters of mine who are ready for marraige , my father has a job but can't afford the current condition of my house with this loan , is there anything we can do to avoid paying the loan . there is another thing that whenever we ask about the current interest , current condition of loan account and the balance sheet of the loan account , , they try to avoid it and keep asking to first meet them , plzzzz , help me ??????

Prospective lessee threatning stay order

I signed a LOI with a prospective lessee and he deposited cheques towards the 3 month security deposit. Upon repeated reminders the lessee did not sign the lease for one reason or the other and after 1 month of signing the LOI he informed me that he is not interested in taking the property on lease and asked me to refund his money. I agreed to this but told him that I will deduct amount equivalent to one month's rent as that is the time my property was engaged with him by the virtue of LOI. He is disagreeing and now he is threatening to take me to court and get a stay order so that I would not be able to lease my property to anyone else. My question is (a) can he get such a stay order from the court and (b) is it not fair for me to cut the rent for the amount he kept my property engaged and purposefully did not sign the lease.

Please provide your expert guidance. Thanks.

Self earned property partition

we r 2 brothers A&B.WE HAVE CERTAIN SELF EARNED PROPERTIES IN BANGLORE.MY PARENTS X & Y ALSO HAVE THERE SELF EARNED PROPERTIES. IN BANGLORE.ALL R ALIVE & EVERYTHING IS GOING PEACE FULLY.
MY FATHER X WANTS TO DIVIDE PROPERTIES WHEN EVERYTHING IS FINE.
MY QUERY IS:-
1. CAN V DIVIDE SELF EARNED PROPERTIES AMONG OUR SELVES IN A REGD PARTITION DEED & MUTUALLY EXCHANGE & DIVIDE THE SELF EARNED PROPERTIES among ourselves{like x self earned prp to A,B SELF EARNED PRP TO A ETC}
2.WE ALSO OWN THREE PROPERIETOR SHIP FIRMS WHERE A,B,X areTHE PROPERIETORS.
X wants to divide shares of this properietor ship to Y & there after to B.can this be done in a simple familypartition deed.
3.WHAT WILL B THE STAMP DUTY & TAX IMPLICATIONS ON THE FAMILY MEMBERS.

Correction of caste

Dear sir,

My grandfather had given my caste as Jennu Kuruba(SC), but I belong to Halumatha Kuruba(OBC). My father does not have any caste certificate, but his bothers are having certificate. I did not get any Caste Certificate from Talk office due to problem in my transfer certificate with wrong caste. How do I get correct it? because I applied for my daughter's caste certificate twice, it was rejected. I really upset up on me. Please advise.

Repair work not carried out by society member.

I own a house in a CHS, about six months ago i had asked the house owner (member) staying above me to do repairs of his bathroom because my bathroom ceiling was leaking and a lot of paint and some cement had come off. The owner asked me to wait for three months as he will carty out the repair works. Now its been six months he is not willing to do any repairs citing excuses. Even after repeated reminders and intimation by society secretary has gone in vain.
Because of his delay i am not able to carry out renovation work in my bathroom and kitchen which has got damaged by this leak. What should i do?

Can i leave my job before 4 days of notice period

My resign period was 7 to 10 days but when i sent mail for resigning but my officer told me to serve 15 days and i acknowledged the same but now i served 11 days but i wont serve the last 4 days.

is my decision can affect my salary, full n final and incentives?

Can a Coop. Housing Society enroll new members after the approval of managing commitee and after passing the resolution in the managing committee meeting. Is any other approval is required from any other authority in UP.
