Strange Case

In a C.R there are 6 accused and all have been granted bail but one accused has not arranged for surety demanded by the court and thereby is still in custody for the past 2 months. Now the case has reached of charge framing and Magistrate is giving short dates of 14 days stating that as one accused is in custody he needs to be given prefrential treatment. The present case is in goa and all accused involved are residents of mumbai so they are forced to attend matters at such short intervals just because of one of the accused. Is there any provision or judgement contrary to what Magistrate is stating.

husband transferred ancestor property to wife thru sale deed

Sir,

We are two brothers and one sister all married. My father lives with me and my mother with my younger brother.

We have an ancestor property in delhi, Which was not registered. It was a simple agreement between my father brothers, which stated the details of devision.
Six years before my mother registered property in her name using sale deed without our consent. My father signed it in good faith also to save stamp duty.

Now my mother denies to gives us share and want to sell entire property. My brother-in-law(Jija), sister and younger brother has eye on entire property. My mother and younger brother does not allow my father to enter house. They are giving threat to us.

1) Now my question is that can my father get back his property?
2) Can this property divided? How?
3) Can we stop her from selling property?

Disposal of writ petition

When I joined my present employer, I found that some of the writ petions filed by some parties on different subjects, had not listed for hearing for quite a long time: even for more than 10 years.I was given to understand tha due to change in advocate pleading for our company the cases could not be followedup. I took the following steps to know the status.
- checked with our advocate's office but they have no record.
- Compuerised queery availqble in the High Court , but there was no record available in the computer.
- Went to the web based querry provided by the High Court but found no record,
- applied to the high court as per the High court Rule but found no result.
- Planning to take recourse of RTI Act but it is pretty expensive as per the Rule framed.
- I cannot simply delete the cases from my list as in one or two cases interim order is passed.
I want exper opinion as to how I should proceed to trace the cases and to dispose the same.
Regards

dying in harness rule

In one of the writ petition, applicant prayed for compansannte appointment due to death of his father who was employed with the opposite party. It is wothty to note that thefather of the applicant had not died out of and during the course of employment .It was a natural death. The Hon'ble High court in his interim order said".... meanwhile opposite parties are directed to consider the application of the petitioner for his appointment on any suitable post under the dying in harness rule and pass appropriate order within one month."
I want to know
-what is the dying in harness rule?
- Is it different from state to state?
-Is it a statutory obligation?
Can I get some literature or web link on the subject.
