Hello,
My Grandparents constructed house in Rajasthan in 1930's, but due t some reason he registered that property in the name of his second son and his brother. Name of second son was wrongly mentioned and his actual name was different than what is registered. after death of my grandfather and mother... and grand uncle... all 4 son of my grand father and only son of my grand uncle decided to share property equally and make a note in plain pare and signed that. Now second (in whose name property was registered) passed away... now his son is claiming full right on whole property... and put a lock ... my grand mother has make a will in my father's name (third son of my grand parents) and gave him her father's property as he is the only son who has taken care of her till death. Can my father demand equal reights in the existing property??? Please guide us about the legal rights...

can a wife who has filed a suit for divorce after complaint u/s 498a which is pending in the court,claim for maintenance if the 498a is decided in husband,s favour or for alimony?

i am working patner of our firm,my firm is registered in delhi,i have one shop in mall in u.p.i have service tax number but i am not paying service tax because some person said do not pay service tax because service tax on immovable property has abolished.please advice me sir .thanks

land allotted to the plaintiff in Andhra Pradesh of 2.35cents by the government and he is peaceful possession. recently the same site has been resumed by the govt and allotted to the Municipality without any prior notice. plaintiff approached the court for grant of injuction restraining the defendants for construction of dumping yard in the site and declaration of title.
court asked to submit the valuation certificate from the sub registrar and asked the court fee for two different prayers. already he paid the court of Rs.119/- on notional value of Rs. 2,000/-. file not taken on to record. decissions of any court regarding the submission of valuation certificate is not necessary/mandatory is required. what is to be done. the said site in the recors of sub registrar was mentioned as private land the value exceed the value of 1lack which is out of jurisdiction of junior civil judge. site in revenue records mentiond as government land and issued to the said plaintiff 30years ago issued title deeds and pass book regarding that. suggestion is urgent.

My wife had taken loan from pvt bank and invested 1 lakh in Money Mantra Pvt Ltd company run by Mr Navin Sharma in Gurgaon/Dwarka. He promised to give monthly profit on the invested amount, but we received only 3 months and after that he ran away in Dec 2008. Recently we came to know that he is behind the bars by EOW. We have a bounced cheque of 1 lakh given by him. Is there any option to get back the invested money?
Similarly she had invested 1,34,000 in City Limouzines Nehru Place Delhi. Coy promised to give monthly profit on the invested amount, but we received it only 8 months and after that he ran away in Aug 2009. We have 3 bounced cheque of 7,775 each given by him. Coy had also given a share certificate duly signed by Notary of its property worth rupees 50,000 in Mumbai. Is there any option to get back the invested money?

Dear sir,
I have recently taken possession of an apartment which I had booked in 2004. 90% payment for the same was made by 2006. The apartment was however alloted to me by means of a computerized draw in July 2007. The final 10% payment was made in July 2009 and the possession of the house taken in Dec 2009.
I have now sold the apartment in Jan 2010 on power of attorney(the house cannot be sold until 03 years of possession as per the society rules).
I am investing the complete sales proceeds from this house in buying another apartment from a builder.
Could you please tell me that the gains by virtue of selling the apartment after applying the indexation factor will fall under long term capital gains or short term capital gains ? Am I liable to pay any tax ?
