N.I.ACT

zyZ Company wind up as per the order of high court.Official liquidator appointed. The necessary legal consequence was discharge of all the employees and officers from the services of the company including the Board of Directors. Xyz company before wind up has filled case against a EFG company under N.i.act.What will be the legal status of the case filled by XYZ company :
1. Who will pursue the case viz Ex board of Director or Official liquidator
2.If ex board of director, in what capacity.
If EFg company is also wind up , whether such type of provision are covered under N.I.act/ companies act

evidential valueof noterised documents in criminal law

In the absence of original notarised document, whether a xerox copy of such document can be used as a secondary evidence in N.I. Act as a proof of consideration? and if yes ? how?

Notarisation/Registration - Difference

1. What is the difference between notarisation and registration of documents with sub registrar in regard to transfer of property? 2. Can a document which is required to be registered compulsarily, be notarised? 3. Is a document which is required to be compulsarily registered, is not registered and notarised, is such a document required to be subsequently registered? 4. How such a document be registered subsequently? What is the procedure? What will be the stamp duty and registration charges in Maharashtra?

Repudiation of a Vehicle Insurance Claim

The Driver of the vehicle was holding both a fake and also an original Driving license but unfortunately the fake license was submitted with the Insurance Claim and the Insurance Co. has repudiated the claim. Later on submission of the original license the Insurance Co. is repudiating the claim again saying that as per Motor Vehicle Act "no driver can possess 02 license at the same time". Please help.

Supreme Court Judgements - Citations

Under Karnataka Money Lenders Act, Complainant obtained license to do business of money lending. The licence expired after certain period (5 years). The complainant did not renew his money lending license and closed business due to loss & inability. Does the complainant has provision to file civil suit or under 138 of NI Act, against the borrower for recovery of money lent when money lending license was valid and in force, even after the money lending license has expired?

Closing evidence

I am in need of urgen advise form all Ld Experts in my case, I am praticing advocate having 2 years experience. I am appearing for accused in case u/s 138 of N.I Act before Magistrate court Dadar Mumbai, On 11th Feb my maater was kept for futher cross of the complainant but due to ill health i couldn't attend court and magistrate rejected adjournment application filed by accused and even closed the evidence. Now the matter is for recording statement of accused but i want to cross examine, Is there any way to re open the evidence. Thanks and regards Adv Sujit Pathak

validation of partition deed done at panchayat level

hi everybody
my ancestral property got partitioned at panchayat level, wherein the said partitioned was reduced in writing on a plain paper by the panchas bearing the signatures of parties to partition and all the panchas. the property is situated at bihar and is agricultural land and also residetial village house. The said partition was done some where in 1982 at the time of father. Now what is to be done to validate that patition deed and whether that partition done at panchayat level of a plain white paper has any legal validity so that i can claim title over the said property. PLZ SUGGEST AND ADVISE.

Pagadhi system

Hi all,

I am Roshni Verma and wanna advise for the following civil matter.
Mr. A is in exclusive physical possession of shop admeasuring 250sq.mt. from last more than 50 years. The Owner of the land is expired now leaving behind 2 sons. One of his son approached Mr.A asking for NOC to redevelop the place. Mr.A is not having any rent receipt being a tenant as he was never asked for rent after the landlord expired. Apart from rent receipt he have all the property paper's on his name i.e., income tax recipet of every year, water and electricity bills, Challan of shops etc...Mr.A had also file Declaration suit in small causes court asking for declaring him as a tenant but since nobody appeared as summons were not accepted case was disposed.Now landlord's sons has taken all the required permissions and sanctions from BMC to redevelop the place without obtaining Mr.A's NOC and he is threatening Mr.A to vacate the place.

In such circumstance, what Mr.A as a tenant should do? Will he get the possession if filed case in court wihtout having any rent receipt on his name?
