Development Rights of Occupant of Land

We are holding around 4500 sq. ft land which we are holding since 1981. We are paying NA tax from 1993 with retrospective 1981. The actual owner is not tracable. Our name is not there in 7/12 as occupant (Kabjedar). It is only there in NA tax receipt along with owners name.Now case is that Owners was having his land around 18000 sqft which he sold to builder and builder has build a building leaving our fenced area. So we are assuming that he left that much land of which we are pretending to be occupant (Kabjedar).
So do we have any right of development on this land. Because one of the builder (Who is not registered developer) is asking us to enter in to agreement of development.

Nullity of marriage under section 12(1) of HMA

Following r the facts of the cases. plz give me decided cases in regard of this

kiran arora has passed her MBBS from medical college on feb 20,2001. a proposal for her marriage was made through their neighbour sh Jai. he told them that the boy has passed his mba from commerce dept GNDU amritsar & is employed as executive in a big concern at chandigarh. the same was affirmed by the brother in law of the boy. the girl gave her consent in the representation & they got married on March,01.
AFTER TWO MONTHS of their marriage the wife came to know that her husband had passed BA with diploma in business mgt & was undergoing trainig in factory.

So she field the petition for nullity of marriage u/s 12(1) of hindu marriage act ..

Share Transfers

Mr. A has some shares in a Public Ltd Company.
Mr. A dies. No Will made by him. Death Certificate available.
Mr. B, son of Mr. A wants to get these shares transferred-transmitted in his name.
Wat procedure?

Slum Rehabilitation Query

Hello Friends,

There's a slum redevelopment project going at my place from last 5 years.As per the SRA law, the developer should provide transit camps to residence... But the developer is not providing the same.Instead, telling the tenants to take cheques & settle at other place till he rehabs the area.
for which he is making agreement (Notary),but not making us registered. Is it wise to move on with Notary???...
And the most important question, Notary is valid for how many months or years???
Pls suggests...

Power or attorney

the a, b, c, and d are joint owners of the property, the property is agricultural field, Mr. a, b. c, and d are made a sale agreement with Mr. E and give irrevocable power of attorney to Mr. G, after one year Mr. E was paying the full amount of consideration of GPA of Mr.ABCD, and Mr. G had executed the sale deed in favour of Mr.E. Before executing the said deed Mr. a was expired and his righs are devolved into Mr. b c and d and they are become joint owers of said property.

In above case the entry of said sale transactoin is rejected by Mamlatdar for giving reson of death of Mr. a, and note that power of attorney is automatically cancelled and thereofre sale deed is void.

Is there any reported judgements under Powers of attorney act, for showing - declaring that, in any case of death, righst of deceased donnor (one of the executor of Power of attorney) are automatically devolved - survives into its co-owners.

In this case I think b, c and d are survivers of Mr. a.

To SUE ex Employer for negligence&irresponsibility & SALARY

Hi Sirs,
I was working for a company in bangalore.
Pune based company (ABC) arranged interview(Two technical rounds) with bangalore wipro as ABC recruits and deputed to wipro.

ABC gave offer letter and forced me to join in a week but with relieving letter from (then)current employer.

Since ABC does not have office at bangalore,ABC instructed me that i should report my joining directly at wipro on 27'July2009.

But they issued deputation letter/Letter of undertaking on 29th July.With that i joined in wipro.
Then End of August 1,2009 they asked me to not to go to wipro till they intimate further and asked me to stay at home.

After few days ,ABC HR Manager called me that wipro is not satisfied with performance so they rejected my candidature.

When i questioned(how they measured my performance as no work was assigned in that 3 days & no one talked technical things), then Hr told they did not give Positive feed back(after interviews).

So i informed that i am ready to face further technical interviews if scheduled.HR requested he will try to arrange further interview with wipro.But they did not come back.

After 10 days(around 2nd week of August after repeated mails),one of ABC HR contacted me over phone and checked about my willingness to work in Pune.
But i have not agreed as i have family in bangalore.

Then after no communication from ABC though i have mailed them repeatedly.

In October i received terminated letter but dated 18 Sept,2009 thru email and gave salary for 3 days.

1.ABC issued offer letter without getting proper feedback from interviewer(wipro).Its their negligence. Forced me to resign and join by 27th July otherwise it will expire.So i got relieved on very much difficulty before 27th july.

2.They issued deputation letter by 29th July.(But they did not paid for 2 days(27 and 28 july).After 3 days in office, i
am out of office and no proper communication after that.

3.I am job less because of their(ABC) irresponsible act.

4.What ever, they should relieve/terminate me immediately.But send terminated letter in October with pre dated(Sept 18).
They mentioned that i am terminated w.e.f.August 1, 2009.
It is not fair i think.

i want to SUE them for the below issues.

1.Its their fault/irresponsibility to give offer letter without confirming by interviewers.
2.They delayed to terminate me.If they terminated me immediately at least i would start searching for new job.They spoiled
my career.

3.I am demanding salary at least till the date(Sprt 18) on which they issued termination letter though i received in October

Hope these are comes under cheating and negligence.
How can i sue or proceed.

Will legal notice serve my problem,This comes under labour act or civil act?
Any time bound is applied in this case?

Maintenance

In a certain case a husband filed a divorce petition against wife ( Both are Hindus) on the grounds of adultery and the judgment came in favour of the husband and they were legally divorced.after all its a relevant fact that she was still continuing sexual relations with other personal though there is no solid proof. In such a situation the wife came up with the claim for Maintenance > Could it be allowed?????????????

Development of Trust Property and Partition Suit

X created a trust with respect to one of the properties he owned and the beneficiaries named therein were his grandsons namely A and B (sons of Y). X & Y were the trustees. As the income of the trust property was not sufficient and the trust was earning a loss, X filed an application u/s 36 of the Trust Act and obtained the necessary permission to develop the said property to prevent loss and injury to the estate. However before the property could be developed X expired.

The trust deed mentioned that on the expiry of A & B and in the absence of lineal descendants of A and B the property would vest in favour of C&D (sons of Z, another son of X.) or their lineal descendants.

Z, C & D filed a partition suit claiming half share with respect to the said property. The court granted an order of status quo.

In order to minimise the loss of the estate and to fulfill the desire of the settlor to develop the property, Y alongwith his co-trustee intends to get the property developed for the interest of A & B.

Under these circumstances:

1. Can the court stop the development of the said property?
2. Does Z, C or D has any valid claim at this stage?
3. What are the remedies available to Y or A and B so that the property could be developed so as to minimise loss of the estate and benefit of A & B which was the intention of the trust?
