What action can a landlord(a incorpotared company) take against a tenant (a incorporated company)after the termination of lease deed, which has become a illegal trespasser?
The VAT audit report to be filed within 31-12-2009. But it was filed on 31-3-2010. The jurisdictional vat officer has issued notice to pay the penalty of Rs.5000/- for delay in filing the audit report and also penalty of Rs.50/- per day to the date of filing for the said offence.Is it not double punishment for the same offence. The penalty provisions are different in the Act.Can we file a writ petition in the High Court against this provision. Please give reference of any Advocate appearing for this case in High Court at Bangalore.

I am working in a central govt. organisation for 10 years. I would like to apply for a fresh appointment/deputation.
My application is being turned down again and again giving the reason "shortage of employess" / "public intrest".
Kindly suggest me way out.

Respected experts,
I resigned from my company in January 2009 after giving my company due notice as per company rules, but since the company did not have enough funds the company did not paid me my 4 months salary at the time of my resignation. But the company had given me written assurance that they would pay my dues at the earliest.
The company after numerous requests, in this year around January 2010 sent me a mail asking me to collect my dues on a given date, but on reaching there they informed me that they will give me another date for settlement of dues.
Now the situation is that they neither attend my calls nor respond to my written requests via email asking for settlement of dues.
1) Please guide as to the next step that I need to take ?
2) Is there any limitation period for claiming the arrears of salary ?

Hi
My paternal grandfather had a site in west bengal but he expired 15 years back without a will and my grandmother also expired 5 years back. They had 3 daughters and 2 sons, my father being the eldest. Only one daughter and one son are alive. Details of the ones who expired are as follows:
1) Eldest daughter expired and had no kids and husband expired as well),
2) Middle daughter and husband expired as well leaving their daughter who is married and
3) My father expired 5 years back leaving me, my mother and my sister (both of us are married).
My uncle decided to give for flats and we all three (me, my sister and my mother) gave a GPA to my uncle to build flat and sell the land on our behalf.
Now the flats are ready and my uncle, my mother, my aunt, and the daughter of the middle aunt (who expired) are getting one flat each. As I know, my mothers flat would be in name of me, my sis and mother. Can you please tell us, what would be the registration process and what documents we should take from my uncle like share of land etc so that our flat can be registered perfectly? In gist what documents should my mother have to have a possession in the flat? This is in Siliguri, Dist Darjeeling, West Bengal.

According to agreement to sell sale deed is to be executed on 31.10.2005 . On 31.10.2005 plaintiff was present before sub registrar but defendant failed to execute the sale deed. the plaintiff lodged FIR against the defendants in which defendants filed bail application. the defndants in that bail application admitted the execution of agreement to sell and payment. the plaintiff again sent a notice to defendants to execute the sale deed but in reply on 3.10.2008 the defendants informed the plaintiff that agrement stand cancled . the plaintiff files suit for specific performance on 31.10.2008. whether the suit of the plaintiff is barred by limitation.

There is one joint family ancestral property. There is one minor son. Father want to take loan by mortgage the property. 1) Can he?
2)the permission of the court is necessary?
3) In what case the property can be mortgaged without going to court?
