Real Life legal issue, please help!!

hello all,
I want your advise on a legal issue that has come upto me through a real life situation involving a very near and dear relative of mine. Here is the question-
A government servant, Mr.X was wrongfully arrested while discharging his official duty, was sent to judicial custody for 40 days. His department extended and financed all the legal help, including lawyer's fees and bond for bail. The fact that the ministry, under which the department comes, did not suspend Mr. X and also recruited additional solicitor general for his defence, shows that the his department and the ministry consider Mr. X innocent.

Presently Mr.X, who is out on bail, after being defended by additional solicitor general himself, is facing a problem. The problem is, that though the department expressly considers him innocent, they are unable to decide whether the period spent under judicial custody be treated as period spent on duty or not.

According to me, under the given circumstances the period spent in judicial custody should be treated as period spent on duty and not as extra ordinary leave, as labelling this period as extraordinary leave would be same as taking a punitive action against Mr. X, which he is not liable for. As the fact that he was WRONGFULLY ARRESTED while DISCHARGING HIS OFFICIAL DUTY, and DEFENDED BY ADDITIONAL SOLICITOR GENERAL, and NOT SUSPENDED (as is usually when a government servant is arrested for criminal charges he is suspended), show that he is considered to be innocent by the department, and the department has taken on itself to defend this person.

Please give your legal advise as to how should the 40 days period spent in judicial custody be treated, and if you could back it with case laws or rules and regulations on the same, I would be highly obliged.

GPA to defend the civil litigation.

“A” (landowner) has received total sale consideration from “B” (purchaser) in the year July,1995 and executed an un-registered “Agreement of sale” for a landed property. Since the said land is in dispute before the Government (Urban Land Ceiling Authority) with regard to surplus land and hence “A” has given oral assurance to “B” and agreed to register a Sale Deed, only after clearance from the government side and thus “B” has waited for all these days. Now the Government has recently cleared the said land.

Now “B” approached and requested “A” to register the sale deed in his favour. But “A” is refused to register the same on the ground that the land value is hiked. “B” is now in abroad and whereas “C” is in India. Now “B” want to give a General Power of Attorney to “C” to pursue the said dealing ie., for filing a civil suit etc. works, if necessary.

In this, if “C” wants to pursue the case, what documents he needs from “B” and how such documents are legally bound on “C”, in case if “A” challenges. Pls. clarify.

Child Education

Child education is not being done at mothers place after her 498a, citing no income.

Do we have any provisons to father to make child education going on.

Its very saddened these laws like 498a is making family disintegrated.
True convictions of cops say that all 498a in their PS go for divorce?

No mercy to men in this particular law.

Our trade mark used as domain name (Infringement)

Dear sir,

We have 46 registered tradmarks and copyrights.
We are a well known SUPER BRAND.
One company in Mumbai is using our registered trade mark as their domain name.
eg. bajajmotors@yahoo.co.in

We gave them cease and desist letter.
It did not work .They ignored.
We took interim injunction but they remained absent from court.
We have ex-parte interlocutory injunction with us.
Unfortunately in our plaint we didnot specify domain name thing we stressed on Sign boards, visiting cards, letterheads etc.
Even judgement shows that court relied on these only to issue the order.
court did not take in to consideration the domain thing.
Now how do we prove in court/what is acceptable in court as evidence,if we were to put on record that this company is using till date our name as domain name despite court's order/injunction??
Should we produce a print out with affadavit etc ??
Will this be admissible in court as evidence?/
What are other ways of ensuring/proving our domain name fact in front of the court so that court issues a restraining order for domain name as well??
Thanks
