Revocation of retirement funds and benefits

Dear Sir/Madam,

The query is related to my elder sister who got married about 32-33 yrs back to a Govt. Employee (BHEL Hardiwar), Since last 5 years my sister is residing with me in Ghaziabad as she was facing domestic voilance thru her husband and widow Bhabhi and extramarital affiars of her husband with his Bhabhi.

In the current year my Sister has lodged a court case in Ghaziabad Court for maintenance , contrary he served the court notice U/s 9 of Hindu Marriage Act.

Further, it come to know that he is going to retire in coming year, now my concern is that his retirement benfits/funds should not be released to him in any circumstances till the decision of the Maintenance Case filed by my sister.

I would be greatful if you could please guide me what course of action should be taken in this regard, I understand that an immedate action is need to be taken as he is going to retire shortly.

145 crpc

A piece of land is shared by three co-owners where two of them being musclemen have divided it into half between them and have dispossessed the third ie. me from it. I want sec 145 imposed on it since there is tension between us for it. So do I need to hire a lawyer to file a case in SDM's court for it or should I simply submit an application on plain paper requesting 145 to be imposed? What will be the subsequent procedure? (note: It may sound an academic query but its my genuine personal problem.)

Salary slip/certificate

Is it mandatory for the employer of an organisation to issue salary slips every month? can the employer refuse the request of employee for salary slip? If the employer refuses to issue salary slip even after repeated requests from the employee, is there any legal recourse available to the employee?

Court order not implemented for 2 years

I filed first writ petition in april 2016 before high court and single judge directed to consider my representation within one month which was sent to Secretary.
Thereafter Secretary passed an order in July 2016 to me state that due to administrative reason, dispose of my representation was in fructuous.
I also filed contempt in March 2017 but Secretary produced same reply in court. Again I filed second writ petition in nov 2017 and got dismissed stating it is hit by res judicata.
Secretary not disposed my representation as per court direction but contempt was closed and second writ petition dismissed, I dont know what to do.
I want to implement the court order passed in first writ petition to consider my representation. Please suggest me to solve this problem.

Is ndpl or tpddl covered under rti act ? Any reference of judgement ?

Timeline of the action ndpl or tpddl is duty bound to take in cases such as removal of electricity meter of temporary electricity connection stated in any govt order.
And supply of new electricity connection as stated in derc act are not adhered to. Phone numbers of higestst official are not on the web site except help line number.
What is hierarchy of written representation with address as helpline number gives vagues timeline of action to be taken by them, whereas derc act states otherwise ? How to represent and to whom and move the court 's name?
Which court is to be approached? And before moving the court where to submit the notice with address is prayed for here.
Any court judgment, where ndpl or tpddl is imposed fine for not adhering to time line ?

Criminal case when access to roof is restricted by one owner

I am living in 4 floor building where i am the owner of one of the 4 floors. Owner of top floor has the roof rights mentioned in the sale deed and basis that he has put a lock on the entrance of top floor. As a result, other owners of the building are deprived of checking/cleaning their water tanks kept on the roof.

I have already complained to Police but police is not helping stating that this is a civil case?

Need help in this matter as to what can be done under which sections of various acts?

Can conditional transfer of roof rights legal as per law?

I have sold the top floor(Third floor) with roof rights to one person(Say person X). However in the sale deed, i have mentioned one clause which reads as below:
''Vendor has restricted the right of construction above third floor''

I wanted to know is above clause valid as per law and whether permanent injunction restraining the purchaser not to do any construction can be obtained in case purchaser starts construction on the roof. Assume municipal bye laws allow construction of 4th floor.

Service matters

Dear Sir’s
I was working at a senior position in a Pvt Bank and my services were terminated in June 2018 to which I filed an appeal to my MD in Aug 2018. Having kept the appeal pending and informing me via HR vide various communications that appeal is under consideration. In one of the last communication in Nov end wherein they informed me that appellate authority has gone thru the appeal and the decision is reserved and shall be informed to by a particular date.
Finally I got a reply on 4th Dec that appeal in not maintainable for want of jurisdiction of the appellate authority and hence being returned.
Kindly advise what really it means and how to proceed further legally.

NOC for applying in other departments

Respected experts,

I am working in a PSU on contract of 3 yr. I have signed a agreement for 3 yr which bound me with 2 condition like if wants to leave organization then i have to serve 3 month notice and also have to pay 3 monts of sallry.

Now i have completed 2 yr. Now i wants to change job. But if i applied in other PSU then is it compulsory to take NOC from present employer because i am a contractual employee. So if i directly attend interview in other PSU or govt org so is any NOC or through PC procedure required for me.
