After sales deed no possion given

Dear sir,

we have bought property from our uncle(father's brother) . sales deed is registred and we have paid the stamp duty. house is 1st floor we are on ground floor.

still he has not given us complete possion to us. he has his stuff left in the house we bought. we signed agrement on 50 rs stamp paper that we will not use his stuff.

we neven mention of locking any rooms or kitchen in the agreement.

he has locked 2 rooms and kitchen and not willing to give us possion of the rooms. we have given a choise of moving the luggegue to single room and kitchen so that we start using the house.

if we violate the 50 rs stemp and move in the rooms . dose it have a legal implications ?

does a seller has a right to cancel the registration ?

Payment of wages act vs i d act

If an industrial dispute filed by a re-employed employee (less than 240 days) is sub-judice before State Labour Tribunal Court and is at evidence stage and Asstt.Labour Commissioner at District level, claims to have passed an (ex-parte) order (without serving (i) a proper notice and (ii) a copy of the order) under Payment of Wages Act, requires a MSE to deposit whatever was demanded by the (litigant) ex-employee, what course of action is advisable for such / thus harassed Micro Enterpreneur (employing less than 20 employees) ?

Case filed under sec 12 after 3 years separation

hi,
i got married in 2009, after living for 6 years in 2015 wife was separated, due to small issues expanding and final issue of wife caught stealing at her work place after which she shifted to her maternal home and now after 3 years living separately she has file case under sec 12 for domestic violence. kindly advise if the case is manageable and what can be the next course of action by court.

Builder is not providing all documents

I booked flat in 2011 in Bangalore and got flat in 2013 without amenities as promised. Builder built additional one floor from G+3 to G+4 with additional payment to BBMP. Builder took time till 2014 to finish basic works and left .
After much follow up , builder gave us land document, building approval copy .
So far all facilities like STP, Gen set room, Parking floor , main gate, approval of lifts ... not completed.
Not provided completion certificate, Occupancy certificate. So, we are not getting A khata.

Can we file a civil suite now ( after 5 years) against the builder in 2019 to complete pending work and building completion certificate ?

Remove the name of the tenant as bhogawtadar.

Hello,
I own two commercial shops. Both of them are given on rent .
When I gave the shop on rent 7 years back, the name of the tenants has been included as a bhogawtadar along with mine on nagar parishad tax receipt.

Out of that two tenants,

one tenant of shop -1 has left the premises 4 years back and another tenant occupies it now. But the name of the previous tenant is seen on nagar parishad tax receipt as bhogawtadar along with mine. The shop was given on rent by a registered leave and license agreement both the times.

Tenant of shop -2 is still the same. His previous registered leave and license agreement was over 4 years back. And new registered leave and license agreement is in force. There was a gap of one month between two agreements. His name is on the nagar parishad tax receipt as bhogawtadar along with mine.

I want to know how can I remove those names of tenants as bhogawtadar.

Transfer premium in chs

dear sir
i have a flat in joint name with my elder brother
now i want to remove my brother name from the property and transfer my brother shares into my wife name this will be done by gift deed
shall i have to pay transfer premium and transfer fees to my cooperative society ?
only my wife name is to going to add as my name is already present as there is no financial transaction in this case
is stamp duty and registration is compulsory for this case
please guide me

Want divorce from wife

Dear Experts,

I had lived 5+ years together from Feb2009 to Jun2014 and have one 6.5 yrs old girl living with my wife separately now.
in Jun2014 my wife fly away from home for that one FIR u/s 346 registered and CRPC 164 statement recorded after her recovery. In statement she stated that she fly away willing fully and now onward she want to live separately with her husband (means me) and her daughter. Statment recorded in Jun 2014.
This was the ground of Divorce that time because she wants to live separately from her mother-in law according to Supreme court judgment "narendera vs K.meena" but judgment came later in 2016. anyway but now it applies.

After her statement of 164 u/s CRPC she filed a 498A case against me and my family but the case was canceled by Superintendent of police but not registered the case against my wife u/s 182 IPC for fake complaint.Since 2014 police did not represented that case report before court. So that report can be used a ground of divorce now after 5 years of cancellation??

Third ground
My wife filed a DV case against me and my family in the court still the case is at argument level. It might take more 6 months. So should I wait for over this case to be used as solid ground for divorce or should I go ahead now?? coz now I feeling so late for divorce.

For information: when my wife flee away from home then I filed a divorce case but later I withdrawn and the case over.

High court P&H cut the maintenance of my working wife but still I have liabilities of maintenance for the child.

queries:

1. That time I was living in Haryana state so I filed the case in relevant session court but since 1 year I have been living in Delhi Dwarka jurisdiction and wife still living in haryana. So can I file my divorce case in Dwarka Court now??

2. Are these grounds enough to obtain divorce now or should I wait for DV case end.

Kindly guide me regarding the following issue:
The drawer of a dishonoured cheque issued fresh cheques for making payment for dishonoured cheques upon receipt of demand notice from the payee and also sent a reply clearly stating that he has attached fresh cheques with the reply for payment of dishonoured cheques. But the payee of the cheque did not deposit the fresh cheques in the bank and filed a complaint u/s 138 so as to pressurize the drawer and extract entire outstanding dues from him under the pretext of settlement. He has not produced before the Court the reply sent by the drawer as evidence. What should we do in such a case? Please provide relevant citations also. Thanks in advance.

Defence witness calling in state case ipc 326 etc

A state case is 18 yrs old and now for hearing .Most of the witnesses are dead and io/mo are not traceable. One of the prosecution witness is rejected by pp saying he is having same surname of the accused (myself).My query is whether the same witness can be taken as defense witness by me because he is eyewitness.he is not related to me neither he is from my caste.pl advise
