Car park in common land

hi,

I was having a land (common on all names) I and my family was using my share for long 25 to 30 yrs.
I used to park my car below the shade from 10 yrs .now some other people kept the car and not removing it.

what you can suggest.

Transfer of property

We are 4 brothers. My mother is staying with my younger brother. My two elder brothers are staying separately. After my father's death, my younger brother managed to make a GIFT DEED in his name transfering the property. The property was on my mothers name. My mother did not know about this. My younger brother managed to get the flat transfer in his name from the society.

Keeping the above in view, what I can do to take my share?

Ex parte husband not attend court

Dear Experts,
As my earlier query I brief some points, like affidavit mtade as on 4th Jan 2019, Judge Waited for evidence , evidence present as on 16th of Jan Judge gave today's date for evidence... but judge told that neither respondents lawyer nor respondent both are not present in court since last 2 to 3 months, hence judge told that we will take this matter on next week and we can take oral evidence (jubani)... and passed stay order on respondent.

judge told that after jubani will take 2 or 3 hearing and than we passed decree... but which decree ?
without ex parte ?

Exparte order

Dear experts
I filed a suit for recovery of money and summons were sent to the defendant but he did turn up on the date of hearing and the honorable court passed an exparte proceedings.
There after filed an EP along with attachment of amount of Jdr lying in a bank.
Even then the jdr did not attended and court passed an exparte proceedings and posted hearing on 01.04.2019.
It is learnt that the jdr is going to with draw the entire amount from his bank knowing the above with in a 15 days .
At this stage the Dhr filed a petition for advancement of the case for hearing with an out of order.
But court is pressing for notice to other side.
In the main suit the defendant set exparte though summons were served and in EP notices also served but not attended though notices were served. In both times the court passed an exparte proceedings.
Now for ADVANCEMENT PETITION COURT IS PRESSING NOTICE FOR OTHER SIDE.
I AM NOT ABLE TO UNDERSTAND IN BOTH TIMES MADE AN EXPARTE PROCEEDINGS.
HENCE I REQUEST YOU ALL THE LEARNED EXPERTS GIVE AN ADVICE ON THIS REGARD AND IF IT IS CONVENIENT FOR YOU ALL GIVE ME A CITATION.

Sale/possession of un-partitioned land parcel

I live in Kolkata. Around 7 years back, I've purchased a land parcel in Sonarpur-Rajpur Municipal Area. I've muted the land parcel in my name at SOnarpur-Rajpur Municipality as well as in BLLRO and regularly paying both the taxes. Recently, when I started site mobilization for house building construction, I got an objection from third parties, who claimed that the aforesaid land parcel is a part of an un-partitioned land and there is no registered partition deed. Therefore, third parties claimed that they were co-owner of my land parcel also and they were not ready to allow me any construction work on the above land parcel.

The blue print of the land parcel was a part of the present registered sale deed as well as the former chain deed and the land parcel is clearly indicated in the map. In this regard please note that the land parcel is a part of plot no (daag No.) "X" say, mentioned in both the deeds.

Now, as per the ROR, the whole property under Plot No. "X" was belongs to Mr A initially in C.S. Parcha. After his death the same was distributed amongst his four sons (Mr B, Mr C, Mr D & Mr E). Mr C has muted the property on his name by which the land parcel has got different Khatian No under R.S. parcha. But daag no. remain same as "X". The partition of land was mutually agreed between Mr B, C, D & E at that point of time but having no evidence today. After death of Mr C, his land parcel is inherited to his only son Mr F.
Mr F has sold the above land to Mrs G form whom I've brought the aforesaid land parcel. Mrs G had muted the land parcel on her name before sell the same to me. Now, all the sons and grandsons of Mr B, Mr D & Mr E (third parties, mentioned above) is objecting me to construct house building to above land parcel. Presently, Mr F was died but Mrs G is still alive and the land parcel is laying vacant.

Now, my queries:

1. How can I get possession to my land parcel for construction of House building? (if not possible)

2. Can I take any legal action against Mrs G from whom I purchased the land for not getting possession of my land parcel?

3. Can I sell the land to anybody else in this condition to recover my investment? Is there any legal issue may arise thereafter?

Please suggest any options to recover my investment.

Property rights

Hi,
My Brother in law have three brothers and two sisters, Their father died without making their will of property. Now his elder brother is too smart, he sold some land without taking consent from my brother in law. He just take signature from rest of all. Now he is transferred other property to mothers name without taking signature of my brother in law. And now he told my brother in law that you don't have any wright on property, mother will transferred all property to us.
Is this possible, please suggest, now what we do, so that my brother in law will get their property what he deserve.
Please help us.

Builder not issuing noc on transfer of home loan to another

BUILDER NOT ISSUING NOC ON TRANSFER OF HOME LOAN TO ANOTHER BANK,AS HE IS SAYING IT IS LEGAL FRAUD, HOWEVER I AM READY TO SUBMIT ORIGINAL NOC WHICH HE HAS ISSUED EARLIER.

Release of FD given as surety

Hi All..

I gave a surety in form of FD in a criminal case..now the person is acquitted from the case and i have furnished fresh bail for 6 months as per 437A crpc but the CMM has denied to release the previous FD surety for another 6 month....is he right...if yes how and if no what to do in order to get the FD release asap..
