un registered will

I have inherited 1/3 rd share of property which is around 1000 sq feet of total 3000 feet from my grandfathers brother ( A ) via an unregistered will who was unmarried and hence had no issue. The remaining parts belong to 1, my father and 2, my chacha (B)who is causing me trouble .

The entire proerty is one building which is lesed out and rents recieved by me, my father and my chacha , it was leased in year 2000 the property 1/3rd was mutated in my favour in year 2002.

Now my chacha is keen on challenging the will, as he has natural right on the property to some extent as there are some other uncles ( A's other brothers sons n total there can 8 claimants ) who also become the natural heirs of the said part if the will is revoked.

my quetion is
1) Can the will be challenged aftr 16 years of the death , as A died in 1994
2)Since 1994 there has been no claim does the law of adverse posseion apply
3) Mutation in my favour 2002 does it make my sitation any better
4) I am drawing rent since 2000 from the same building frm where my chacha is withrawing rent doe it not make obvious that he has accepted m as true onerof the land

Will the law of estoople help
5)I would like to draw your attention on the fact that the property which I have inherited was self acquired by my uncle in 1989 and the unregistered will is type written on the stamp paper of 2 Rs on the back of which the purchase date of the stamp paper is mentioned as oct 1993 and my uncle passed away in march 1994 , the will was executed in oct 1994 .Does this fact make my side any heavier
6)the will is not probated but mutation is done can my chacha alone file a suit against the will as his part of claim 1/8th of the land in question .

What are other legal remedies available to me.

Does any one please tell us how to obtain a valuation certificate for a residential house from Hyderabad Municipality?

1) What documents required to submit to them
2) How many days it would take normally as per rules
3) Do we have any fees for it?

Importance of Khatauni

Sir,
I have purchase a land in city. The sale deed of the seller does not bear the Aaragi No. The seller has purchased the property from a person who has accquired the property under a will. The Will also does not bear the aaraji No. All the deeds bear house no, At the time of purchase it was told that in city properties are purchased and sold on house no . I have received yellow card and got mutation completed. But when I approach Banks for housing loan, they are asking araji no in earlier deed also. Now the question is :1. What is importance of Khatauni 2. In absence of that Whether my title is defective 3.How to get my name on Khatauni records when my earlier holders have not done so and not mentioned araji no sale deeds.
This is very urgent. Please advice

NI 1881 Act on Letter

I have given an LOA to someone in India , who mis-utilized to transfer money by a request letter from one a/c to another a/c.

Contents of Letter wrote to Bank:
-------------------------------------------------------------------->
To
Bank ABC, City, State.

Sub: transfer of funds.

I, "MY NAME" not having check book with me and my A/C no : 12345.
so please transfer 1Lakh ( One Lakh) to Mr. XYZ A/C no : 34556.

As per the LOA agreement document with Bank, the below lines were stated regarding the transactions

1) I/We hereby authorize you to honour all cheques/negiotable instruments drawn on the
above account provided such cheques are signed by "" LOA NAME .." whose specimen signature
card is enclosed by countersigned by me/us.


2) I /We hereby agree that all debits made by the bank in my/our account by honouring cheques/negotiable instruments/ debit slips signed by the said ... "LOA NAME"..... are conclusive and bining on me/us. "

I/We here by futher agree to abide by the provisions of the Non-resident(External)
account rules.

Above in the letter "MY NAME" represent my original name in the content of letter ( first one) , and also the word "bining" is not a typo from me, but it was the actual word in the LOA agreement form.

When the letter say's " I, MY NAME " can bank accepts this below letter to process the transaction. ?

1) Can the LOA holder sign the letter when the contents says " I MY NAME". , as I have not written the letter OR signed.
2) Will this letter falls as a negotiable instrument / Bill Of Exchange category to process the transaction.

Could you please help what options are available and what sections this falls under NI 1881 Act. How to approach them.

Modifications to Apartment

I live in a Apartment Complex in Gurgaon. For the last few months Apartment Owner above mine is getting modifications and amendments done to his Apartment including Tiles and Wood work etc.

All the heavy lifting, cutting and breaking is happening right in the Apartment. We are being subjected a constant barrage of hammering and cutting noise all through the day.

Despite complaints to Estate Manager, all we get to hear that the owner has been "warned" to stick to time schedules. EM is also worried about his personal safety as the owner of the said apartment has threatened him with dire consequences and dared him to stop the work.

Is there a law under which such a social inconsiderate be persecuted and also the association can take benefit of the law to stop the work.

registration with bar council

Dear sir,

I have cleared LLB (Final) this month (June2010).
I want to enrol with bar council of Delhi.
I have heard that one exam is required to be given for this.
But i have been further told that this exam will be mandatory from sept 2010 onwards.
Does this mean that i can register before that with out giving exam?
And will this exam thing remain in force for all states if not then can i alternately register from ghaziabad?/
Is it easier ??/
Pl.advice
Please note that I'm 45 yrs of age and I am having sufficient court experience.
