territorial jurisdiction


Respected to all,

this is sampoorna, many of you know about my case, my husband is upscanding since four years and a non-bailable warrant is pending on his name on dowry prohibition act in nampally court,from 2005 to till date, where as my in laws are coming to the court and giving attendance,
i had given the complaint to women police station begeumpet,in the year of 2005 because i live in hyderabad the police after investigation they have filed charge sheet in the nampally court on cc no 473, my father-in-law went to high court to quash the fir, in the year of 2005 but the honerabel high court had dismissed the case, after vacating the stay my in-laws are coming to the lower court, now gain my father-in-law had given the petition to the high court asking to quash the 498 case in the lower court. which is pending on cc no 473,stating that,i am living in hyderabad, and my in-laws stay in warangel, and the offence took place in warengel, so, the courts in hyderabad had no territorial jursdiction to entertain the case.

i request you all to pls clear my query, since i am in hyderabad i had given a complaint to my near police station, and my marriage took place in the year of 2003 in hyderabad,is there any such rule passed that the compliant should be given at the place of offence,do nampally court had no right to run the case?, will high court will quash the case in the napally court based on this?

daughter right in father and mother property

sir,

my grand father has the property which is acquired after his father's death(agricultural lands ).
my grand father has 2 sons and 1 daughter.
my grand mother also has some property of her own(agricultural lands,sites,houses) .

now both the sons alive ,but the daughter is died, i am the son of the daughter ,who was died ,

does i have any right in the above properties of my materal grand father and materal grand mother).

can i go court in this regard.

ESI Coverage

Hi,

we are coverd under ESIC by ESI corporation where few of our employees fall under this purview and we also have a sophisticated mediclaim policy applicable to all our employees .

we are hiring some employees who would be earning less salary than 10k intially when the resource is on training but covered by our medical policy and later when he is released in to project he would be out of ESI limit .

Should we cover these employees under ESI For these intial period , are there any exemptions (case law citations available to )to not cover these employees .

A worker Age 20. Died with accident at wrk in the course of his employment in a steel and power manufacturing company.
For how much compensation his family is entitled to.

strikes and lock outs in Private Sector

Sirs,

I have got an elaborate explanation regarding legality and illegality of strikes and lock outs in PUBLIC UTILITY SERVICES.

In case of private enterprises, what is the procedure adopted for strike and lockouts.

In case, workmen has an industrial Dispute and resort to strike, whether two notices as mentioned in I.D Act is necessary?

In case, an employer resort to lock out, what is the procedure, whether the two notices are needed.

Does Standing Orders of an industrial establishment in Private Sector, contain any procedure for Strikes or lock outs.

I hope I have clarified my question. The earlier question in this connection still remains unanswered,and I received a mail saying that the question is not clear.

Hope I have clearly expressed my question.

Date of execution of partnership

One of my client is having partnership business. It is basically family business having father, his son and his grandson and grandaughter as partners. The father died on 11th March,2009 devolving his share to his son through a will.Now the remaining partners want to reconstitute the firm. Stamp duty can be paid only today and the maximum amount according to delhi stamp act is Rs.5000/-. Is it required first to file dissolution of parnership on Rs.200/- stamp papers. Secondly what will be the date of new partnership agreement as the stamp papers are available of today itself.

Can anybody provide me reconstituted partnership deed after the death of one parner, leaving the other three partners by giving his share of profit to one of partner through a will.

I am purchasing agricultural land in karnataka state. so what are precuationery measures i have to take before going registration.Like there is any department which is issuing no due certificate ect. becuase framer usually takes loan on their lands.

how to start?

I'm getting my enrollment done after that i plan to join some firm and im really interested in corporate law could any of you tell me what are the things i should keep in mind and things that will help me and if any of you could give me few law firms name in mumbai that specializes in corporate law it would be great,and i know its asking for lot but if any one of you could refer me that would be wonderful.:-)
