One of my friend daughter has got married and had a girl child of 4 years old. The marriage was conducted in Aug..2011 and the child born in Nov.2013. Thereafter, the husband has deserted and not turned back to see either the child and the wife. There was some dispute in Stridhana between the two families. The where about of the husband is not known right now. It is an hear say news that the husband has gone to some foreign country on employment. The wife is no more interested in continuing the relationship with her husband. The husband permanent address in India is available. Whether the wife can now apply for divorce in the present scnerio?. If so, how the notice/summon be served to the husband in the absence of his present address? Please guide me.

My neighbor has filed a Civil Suit against us making allegations on water leakage etc. It is DDA (Delhi Development Authority) flat in Delhi wherein Ground + four floors are in one stack, I am living in the 1st floor and my neighbor is living in the ground floor.
On receipt of summon, we attended the court and highlighted that the documents received is not legible. The Court ordered the Plaintiff to give all the documents to us as legible one. However, the plaintiff has given only the photographs (legible) but crucial documents like site plan, copy of the complaint letter given to the authorities were not given.
Suspecting foul play, we inspected the file. The site plan submitted to the Hon'ble court itself is not legible and hence the plaintiff is avoid giving the legible copy to us. Further, the complaint letter addressed to the authorities about the leakage given to us was not the same that was submitted in court ( the court document refers an additional handwritten foot note which was referring the earlier complaint letter but what was given to us was not having he footnote.). Now the questions:
1. Without giving proper legible documents which are crucial to the case (like site plan , complaint letter etc) to the Defendent., how can the defendent can file the replication petition?
2. Having not filed the replication within 90 days, can the suit be considered for trail without giving opportunity for the defendent to file the replication?
3. Can we ask for the dismissal of the civil suit for not giving crucial legible documents to the defendent despite the court's direction? Under which section of the CPC we can request the court to dismiss the civil suit for lack of providing the proper documents to the defendent?
4. Is there any judgement towards the dismissal of the civil suit for not giving crucial and legible documents to defendent?

If you parties being Hindu of different castes, wishes to marry without the consent of their parents. Under which marriage act does the court register their marriage ? Is it Hindu Marriage Act or Special Marriage Act ?

Hi,
My parents live in Bangalore and they were leasing a home in JC Nagar. And lease is valid till January 2019. We came into that home in January 2016. It was a total of 3 years lease. As soon as we joined the home after 2 months, we came to know that the particular home which ever we are staying is in bank loan and landlord is not at all paying the EMI for the home. He lives away from his house, in a rented house. Monthly once bank people would come to my place and they were threatening us to vacate the home as landlord is not paying EMI for the home and there was a huge water problem also. On calling up landlord and saying these problems he was not taking any action and he used to blame us for the complaints.
We got irritated with these problems and told landlord in April 2017 that we are going to vacate home in 3 months and told him to return back the lease money(as per lease agreement). But there was no response. Every month we used to call him up and tell him to return the money. But as usual there was no response. And in December 2017 we vacated the home and shifted to a new home. While vacating he told us he will return the money in 3 months and he threatened us to return back the keys. But we didnot return the key.
Till now there was not even a single penny returned by him. And every month he is saying that he will return the money next month. Already it has been 6 months, we are not staying in the home and money is with landlord only. What action can we take on landlord as the lease agreement is not yet completed.
Even if we take any action, will we get any interest amount by landlord for this 6 months. Could anyone please suggest me on this.
Lease is on my father's name.

In 138 NIA case, surity of accused submitted papers and accused was released on bail. On verification, subsequently, papers such as Land papers and bank fdr were found to be fake. Knowing it, accused submitted another surities and got discharged earlier one. My query is whether accused, surities who submitted forged papers to the court for liable for any punishment even discharged later on.

I lost all the amount in this case , now I have no money to case anywhere any my lawyer clearly told me that no money, no servic.
What can I do for get my money back from the person who is in the jail.

Hello, my appointment order states that Probationary period is six months and employee shall continue to be so until the confirmation is given in writing. Further, during probation, there is a notice period of one month if employee wish to separate from the company.
So, I have been working since 20 months and my services aren't confirmed yet. I have resigned a month back but my HR is asking me to serve three months notice as per new HR policies. When I tried to defend on month's notice, they are not agreeing and refusing to relieve me by putting an induction program sheet that was acknowledged by me. The sheet consists of a list of induction programs from various departments wherein "HR policy rules and regulations" is one of them and they are claiming that the HR policy consists of three months notice which I need to follow. They are also claiming that, my services are confirmed right after six months of my appointment although there is no information about confirmation verbally or in writing.
How do I move ahead? My company is no mood to listen to my requests as the client I'm working for doesn't want to leave me.

my grand father will his own earned house on my name and not included my father name in it. the will document is registered in court. now after15 year of his death
can any one claim on that property or not either my father , brother , father sisters.

Sir my self shivkumar. As we living separately since Oct 2016 till date in mid I had a baby on December 24th/2016.i am feeling mental stress as it is being nearly 2years. I am away from my child. As she use to tell lies and as per mindset she doesn't want to live with in laws. As we had married on 2nd may2015. On the early morning of next day of marriages said that your father asked dowry from us. Thing is even a single rupee has not taken from their end. As they had blackmailing on my father. We tell to media etc her mother is lead role in this matter. For some period we together then I send her to hostel to complete her studies but she didn't studied and made torture that she will commit suicide unless I call or talk to her when she says. My parents tried to in every aspects as possible as they can, by family members, as you know In village Sarpanch and some others members. But they refused to talk or neither coming to stay to my home. As now she had left the baby with her parents and went to study her nursing course. As my son in 1yr3months.though I am not able to understand what should I do now. Sometimes I feel depressed and think to end of life but certain things come about parents and my son for whom I want back with me. I request expert please suggest me what action should be taken.
