Procedure in Suprme Court.

Sir,
In our SLP, the Respondents have taken an adjournment for filing counter on our petitions. Accordingly the Court has given 3 weeks time for filing oounter and 2 weeks time for filing our rejointer therefrom. Even now also, the Respondents have not filed their cournters, since 3 weeks time have already been lapsed.

I want to know even now also can they file their cournter or can they ask one more adjournment for filing counter.

I am HM (PIO) of a government aided school, One of my teacher is asking personal information like appointment order, service book etc., pertaining to a Class IV employee.
Do I have to seek the permission from the Class IV employee? If he says information should not be given? What reply is to be given to applicant?

Interest for delay in settlement of gratuity

I married a woman working with Central government with 2 daughters aged 6 & 8,. She died of cancer.I took family pension for 3 years and then asked my bankers to stop it. It took me 8 years to get the Guardianship of minor daughters.Subsequently I claimed for my late wife's benefits like gratuity,family Pension and General Provident fund. Six months have passed since I made claim to benefits. Department wants NOC from CPWD for the flat that she was occupying while in service for releasing Gratuity. Directorate of Estate is keeping mum not giving me the NOC in spite of several reminders.
I would like to know whether I should go for legal option to recover gratuity and whether I can claim interest for the last 8 years as there was no one to claim the benefits because the children were minors.

gift deed format of car to close relative

plz suggest gift deed of a car specimen from wife to husband and tell me whether affidavit for this cause is also reqd. if yes then send its speciman also.
lastly it can be executed on stamp paper of rs.10 also or not?
as per income tax act to claim depr. it is mandatory to gift to sole prop. firm name or to sole prop. name and whether trf. of r.c.under motor vehicles act is mandatory in this case or not.

Section 58A of Companies Act 1956

If a private company borrows from individual (other than its directors, relatives, or shareholders) violating section 3 1(iii) of the Act, it will attract section 58A, what is the consequence of it?

charging of higher fees and syllabus preparation

whether there is any act which stipulates the fees charges and restrict the schools to do not charge the fees above the specified rates.....and any school can be permitted to frame their own syllabus and not give importance to govt. notifications...i m talking about gujarat govt.

advertising tax on vehicles


Dear Lnd members

please clarify that whether advertising on our own or contract Vehicles which are running in the (Bangalore) city for supplying materials to our own outlet needs any special permission/ licenses from any Act? whether if fall under
Karnataka Municipal Act or Karnataka Motor Vehicles Taxation Act?

Whether is there any mandatory to pay advertisement tax on vehicles?

(1) A company wants to equitable mortgage on its immovable assets situated in various States. The Mortgage is to be created in one particular state where registration of equitable mortgage is not compulsorily registrable (say Maharastra). However, the mortgage Document also includes one property of a State where equitable mortgage is compulsorily registrable as per that States registration law (say Gujarat). Whether that equitable mortgage is required to be registered in GUJARAT also. It may be noted that equitable mortgage can be created any where in the Country if that is done in any notified towns. (2) Further what would be the position if the situation is reversed, viz. equitable mortgage is created in Gujarat but the document does not include any Gujarat Property. Whether equitable mortgage is required to be registered since Gujarat registration laws apply to property situated in Gujarat only?
