Sir,
I am the advocate for the petitioner/plaintiff. Have filed a Order V and Order VIII Rule 1 Application for the defendants to have not filed in the Written statement in 90 days. The court had taken my application and on the next hearing date when the defendant had filed in their written statements had returned my application stating that the written statement had been filed by the 6th respondent. Meanwhile Respondent 1 - respondent 6 have been termed exparte but ad-interim expert orders have not been passed for the other pending application but only R1-R5 has been termed ex-parte but failing to pass ad-interim orders. I wanted to file a petition before the Hon'ble High court with regard to Transfer petition under section 24. Will the High court in my transfer petition give ad-interim orders to my pending injunction applications where my orders are still pending after court hearing the said application as forcing me to withdraw my applications. Secondly can i file a petition under article 227 of the constitution of indian for the court to have acted in excess of its jurisdiction for not only numbering my petition but later returning it on the next date stating that the 6th respondent filed in their written statement without stating any reason nor even have they filed any time extinction application stating reasons for the failure to file within the time period of 90 days. What petition to be filed for returning my petition under order V Rule 1 and Order VIII Rule 1 whether A petition under article 226 or whether a petition under section 115 of C.P.C. Will a petition under article 226 be maintainable?

I am 65 years old senior citizen. I am staying with my wife in my own house at Cuttack Orissa and have clear title. My son and daughter in law are also staying in the same house. In recent years they are regularly torturing both me and my wife in any manner. Last year my son who is practicing as a junior advocate, filed a civil suit against me claiming the property belongs to him. In his suit no evidence available in his support and claim is purely imaginary. He have also filed an I.A. to prevent me from any alienation, which was rejected by the Honorable Court . After that he is regularly getting violent and torchers us. He also threating to drag the suit for years and after my death he will automatically gain the ownership. We have reported it to police no. of time about the violence but police is not paying any attention to us. We have filed an I.A. with prayer for eviction of my son and daughter in law and to allow them to fight the legal suit by staying outside. My son is not contributing anything towards maintenance of the house rather he have captured a major portion of the house. Honorable Court have rejected our I.A. as my son is a prima facie on the suit land (by means of cable TV connection in his name). Should we go to the upper court and then what are the possibilities, as the suit is under trial court. We have submitted written statement including counter claim for eviction. My son is not filing the reply to drag the suit and the matter is pending since last 3-4 months. Is there any other better way for eviction. If you have any suggestion for me please share.

A private complaint has been filed in magistrate court. Magistrate ordered for enquiry and referred to police and IO opened FIR and subsequently filed chargesheet.
In chargesheet he mentioned that accused are staying in area of his jurisdiction where as scene of offence is located in a place which is not in his jurisdiction.
1. My question is this chargesheet valid in the eyes of law to proceed with trial ?
2. Since IO has no authority to investigate crime which does not fall under his jurisdiction he should have referred this case to PS which has jurisdiction which he did not do and can i go for quash of chargesheet citing this reason?
Appreciate any suggestion

In qualification
They Have given :
Bachelor of veterinary science as basic qualification
Master in veterinary and PhD in prefential criteria
Now
They have called students for direct interview by way of one notice in which:
General category -above 75% either in Bachelor or master degree students are called
For other categories like sc/st/bc all are eligible irrespective of their percentage
Now my query is:
I am having bachelor and master degree both but under 75%
The student who is only having bachelor degree but scored above 75% is eligible for interview
But on other hand I am having master degree of same course but under 75% is not eligible for appearing in interview
And moreover their is no bar on percentage of other categories (Sc/St/bc)as they have said their are so many applications for general category so they (state commission)have to call all students above 75% only
Can they put this bar only on general category ?
Can bachelor degree students having more than 75% is above the person having master degree( having less then 75% in bachelor & master degree)?
Now where is the Prefential benefit to master degree students as they have called PhD students directly for interview but they haven't given any preference to master degree holders and put them equal to bachelor degree holders by saying (having 75% above either in bachelor or master degree)
How can I be eligible for interview ( as I have to file a writ), kindly give me some better grounds to file a writ in above mentioned circumstances

Respected all my senior sir,
I filed a. Criminal revison against the order of interim maintenance ordered passed by judicial magistrate Asansol of Rs 10,000/- per month to a minor child of the petitioner.
I am on behalf of the opposite party i.e husband , the main facts is both husband and wife are job holder in Bengal police service where the salary of husband is Rs 18,000/- per month and wife salary Rs 27,000/ - per month.
So for that reason petitioner wife file 125crpc for her minor child and not herself.
When I filed a criminal revison against this order then the session court reject my petition that I can not filed revision petition because it is a bar by kolkatta high court judgement.
Sir I am on behalf of the husband and his 65% income is going as a maintenance to his child ,
As per my study the court may order only 25% income of husband as an maintenance to wife, child etc.
So please give me any Supreme court ruling so that I filed a rescission at Session court Asansol,
Please sir help me and send me some major judgement.

now when time to marry he refused said that parents not accepting u because u r belong to lower cast his nd my family also knows about our physical relation
his family come to meet us also but come with politicians of our area and he is from rich family
also his family offer money to close this all matter what should i do now ?

Hello, I took a cunsumer Loan from Capital First in may and my first EMI was due on 05/06/17 which i had paid on time but they reproduced the cheque against my bank on 07/06/2017 for the same EMI which i had already. Due to that my bank charged me 575 rs. for cheque bounce charges when i mailed them regarding this they were not keen of understanding the point or even contact a customer. (even they mailed after 5 working days) After this incident very next month in July i had appropriate balance in my bank account for EMI but i got the Text from Capital First that no EMI will be cut from my account in July month while i had enough balance in my account and after 25 days i got the text from their side to pay the July's EMI on immidiate basis or else my CIBIL score will be affected. Now if my repayment option is auto debit mode then why i should pay directly. & Their recovery agent came to my home by asking everyone in society stating that i havent paid my loan"s EMI while i had enogh balance in my account and after this very next day they deducted the amount from my account, So if they were able to deduct the amount then why they defamed me for not paying the EMI ehile amount was there. (I have the SMS & all the conversation mails as proof) I tried to contact their customer support team but i haven't get the reply yet. So i want to make a case of lake of services and defamation please advice.

Hi, My son was born on oct2011, but due to some issues we did not get the birth certificate. This year only we applied for it and to our shock, the officers reported that someone else has got the certificate with different names. The father's name and baby name are completely changed. I need to get a certificate with correct name. Plz help

Partnership of ngos
Can 2 different NGOs registered as society, form a Partnership togather to run a school, whereby the management will be handled by the jointly by the partnership.
Case is:-
There is a school named*********** and 2 different NGOs are AWEWS and Aurora, which are registered as society with the concerned authority, have jointly founded the school and are willing to form a single entity which will be jointly owned by these 2 NGOs and a team of academic and administrative has been put in place and the management is to be controlled by any single entity, which in turn is be jointly owned by these 2 NGOs. Hope I made my point clear. Looking forward for your response.
