I am presently residing at Kolkata since 6 months. I was out of my native place for 10 years doing a job & now I want to start a business as a building promoter . My childhood friend, has a piece of vacant land measuring about 2000 sq. feet at Bright Street, park circus, kolkata which falls in ward no. 65 of Kolkata Municipal Corporation. I would like to know the following:

1. what is the per sq. feet cost for new construction in Bright street, park circus ( Ward no. 65) as of date?

2. what is the per square feet buy price of ready possession flats newly constructed in the same municipal ward ?

3. How much money I have to pay to my friend initially on signing the agreement to start the construction if the plan is G+4 ?

4. Since, my friend won't invest a single penny, what will be the share in this venture?

5. where to get a proforma of such agreement draft ?

Need advice of law profession:-

Hello to all Advocates and Experts,

I am just writing this time not to take any legal advice rather need guidance to get some hope within me to do something else related to the same field, hope your advice help me somewhere to take a final decision,,

I have got experience only of 2 years that's it, not exposed fully into this field that's the reason still not confident enough, being a mother of 3 and a half year old son who need me most of the time don’t feel like to avoid him therefore it’s been very difficult to concentrate or focus into this profession but after getting degree of LLM before my marriage I never thought of any other job to opt, therefore I am adamant to stick to Law profession only.

Now I would like to take advice on:-

As per my age (35) I can go for ADJ exam,,
Can I prepare at home if yes how? (suggest m books etc)

If I fail once then I go for coaching classes (suggest me classes also where etc plz)

After knowing my situation do you all think that I should go for it or not, what I think is that I have not much practical experience so not able to judge but what I have been suggested by my father is that I get all knowledge once I am into ADJ position, the pressure being onto that seat of JUDGE make me learn everything.

Thank you very much in advance

Delivery of posession of flat & registration

Dear Sir
I had booked a flat at Guwahati in DEC 2008 through finance from LIC Housing & as per agreement with builder, it was supposed to be handed over to me by March 2010 ( within 15 months from date of booking) .Till date some work is left for completion & despite my repeated requests ,to complete the work & hand over the possession ,it has not been done, where as the total time elapse is now more than 60 months.
Even in reply to one of my letters written in Dec 2012, where I had mentioned that it is acute deficiency of service on his part & that I am suffering both mentally & financially on day to day basis, the builder has written that this delay is not intentional& that due to circumstances beyond his control ,he is unable to complete the work & sought time for 2-3 months to complete the work & hand over possession in March 13,which also he has failed to do.There has been no progress & now a days he is not receiving my phone calls & meeting him personally is not possible ,because once I go to his residence ,he is not available or does not come out.
Further recently ,I came to know that the land in which construction of flat has been done falls under urban ceiling act & that the flats cannot be registered .
However while making the agreement ,the builder had shown us non encumberence certificate ,permission from metropolitan development authority to construct the building etc. LIC had also sanctioned the loan & I think so they verify all documents before approving housing loan.
Now please suggest what should I do .
Should I complete the remain work myself & take possession or wait for the builder to do so.
Also please suggest how should I legally approach to claim compensation for such delay & should I first take possession & start the legal procedure.
Further will registration of the flat be possible ,if not what should I do .
Also pl suggest name of a reputed lawyer from Guwahati who has expertise in such cases for us to approach .
thanx
rajib

Registration of partition deed of agriculture land

For one of my client when he wanted to offer one of his immovable property as collateral security in bank for loan purpose bank refused to accept the same, facts of the case are as follows:-
1. Property is a commercial property on diverted land which is registered one with proper stamp duty paid. (No issued with latest registered title deed in the name of the aforesaid borrower).
2. However seller of this property got right on the aforesaid property through a partition deed executed among their family members in 1997. At that time this was an agriculture land (Non diverted) and partition deed was presented to Tehsildar for mutation purposes. Tehsildar at that time after examining the facts of the case and verifying the partition deed executed muted the names in revenue records accordingly and partition done. However this partition deed was not got registered with sub registrar and same is unregistered (Executed on rs. 50 stamp paper). property is situated in MP.

Bank contented that since the aforesaid partition deed is a chain/link document to latest registered title deed which has not been registered and same was required to be registered compulsorily u/s 17(1)(b) of the IRA same is not enforceable and same can not be admitted as a valid evidence.

However our contention is that since this is a land which at the time of partition was assessed for agriculture, and partition was duly noted by tehsildar in land revenue records based on the application made by the partition holders at that time, process of section 178 of MP land revenue code 1959 were duly followed.

Now kindly please clarify that whether aforesaid partition can be regarded to fall under the exemption categories defined in section 17 (2) (VIII)where registration is not compulsory.

Question is - whether registration u/s 17(1)(b) of registration act of a partition deed of agriculture land where the same has been duly accepted by tehsildar and mutation also done in his records, is absolutely compulsory for making this admissible/enforceable.
