Dear All,
I am facing the problem with my wife she is missing / Run away from last 10 months.
Here are details. We got married in May’2007 & had Son in May’2008. There were always small fights in between us like normal husband wife. But in month March’2013 I found she was having affair with his office colleague (she joined office in Sept’12). I informed to her parents & they have taken her to their home in March’2013. Then we had 2-3 family meeting with both the family members & taken the decision of mutual divorce. Previously wife was not accepting her mistake but I have shown some proofs from her phone, facebook chat, call records & info from other people and asked for definite divorce. During our family meeting her family members & she has given Son’s custody to me as her father say his daughter is not good mother for kid. Then we waited for her family reply for divorce process for one month time with follow-up on phone but one day we got call from her father that their daughter (My wife) got missing while they were travelling by Train. So they have made complaint in Mumbai Railway Police in Apr’13.
I am continuously following up with Police for finding her but unable to find her. Given ad in paper as well as posters also but still she is missing. We are not getting any positive response from her family members also. Not sure about her presence.
As I am defiantly looking for divorce & no further life with her can you advice is there any way to getting divorce.
I am looking for second marriage as I am finding difficulty to give good time to my son for his care. Can you please advice on possibilities for second marriage with above situation? I know 7yrs missing law but anything beside that is possible.
We have still not sent any legal notice for divorce to them. Please let me know what necessary things I need to do in this case.

Dear Experts
Thanks for your replies earlier
We were continuously following our in laws to know about their demand as they were keen to get divorce from me first instead of initiating the act from their side and also threatened us to dissolve the issue and pay the said amount or else get ready to shift to jail, but i was on my stand that i need my wife back so i filed RCR.
Now my wife's uncle after filing of my rcr (they dont know about my petition as they are in other state) recently called my uncle asking for Rs.10 lacs and gold they have given to us on marriage they are also giving us an discount of Rs.2 lacs if matter is resolved and payment is done immediately.
i was shocked hearing about discount are they giving their ladies on hire or what?
I am against to pay even a single penny as i have taken nothing from them except my wife and i am very clean hand person earning only that much which satisfy my families needs.
Please guide me what move should i play now as i am still firm on my decision to bring her back.

Due to prejudice my neighbours living in the 1st and 2nd floor have joined hands in harrassing me by using police influence. Being localites they have mob strength .. after exhaustive visits to commissioner's office, women's commission and human rights commission ..... and finding no alternative .. I have gone ahead and filed a civil suit asking for permanent injunction against these inmates ,so that they may not interfere with my peaceful possession of my property. My case has not even come up for hearing the past 4 months. Recently, these inmates have again gone to the police and filed false complaints against me. The police continuously call me to close the complaints. Having done this for more than two years, I am put to agony having to visit the station to close these complaints. What is the solution to this? Please suggest on how to end this wilful manipulation of public authority by these inmates to harrass me and drive me out of my house and job.

A case is pending with District Consumer Forum. One of the Central Government officer has filed proof affidavit in English on behalf of opposite party. When crossing, it becomes known that the said officer knew only English & Hindi. I don't know Hindi and as the questions are very minute, I would like to cross examine him only in my mother tongue i.e. Tamil. There is no official translator in the Forum. What is the rule governing the language to be followed in Consumer Protection Act or any other instructions available in the Civil Procedure Code.
Please clarify.
Brief note on ptcl case
Dear sir,
We have purchased 7 acre of land which was granted to one of shivappa kallappa naikmakkal in the year 1966 with a condition of non-alienation of the land for a period of 15 years. The grantee alienated the land during the year 1982 and 1985.which is after completion of 15 year.we is the 3rd purchaser of the land.
The grantee filed a case with assistant commissioner dharwad (Karnataka),during the year 2005 stating that he belongs to HINDU VALMIKI caste which has been classified as scheduled tribe community there by lending to violation of clause 4(2) of the PTCL act with contention of resumption of land back to original grantee.
The assistant commissioner dharwad heard the case and rejected the petition standing that the caste of the grantee has been classified as scheduled tribe community W.E.F 19/04/1991.the grantee filed and appeal to deputy commissioner dharwad during the year 2006-07 .the D.C dharwd has heard the case and upheld the judgment of AC dharwad.
The grantee again preferred an writ petition to the High court of Karnataka during 2009 the court had heard the case and again remanded back to the case to the DC dharwad for hearing and for passing appropriate order. Now the case has been called for hearing by the DC on 25/02/2014.
In regards to the judgment issued by the high court single and double bench the following points have been brought to perusal the constitution scheduled tribe order 1950 has been issued as per the provision of article 342 of constitution classifying the community under ST and several amendments have been issued to the presidential notification 1950 by adding caste of person inserted to the ST list w.e.f 19/04/1991 “Naik,Nayak,Beda,Bedar &valmiki” (constitution 2nd amendment 1991 copy and bill passed by Lok saba copy enclosed )
As states above caste every Amendments to presidential notification of 1950. Thre is a specific Effective date, month & year on which the caste for to be considered as ST.
In such circumstances the judgments have been issued by the Hon’ble judges considering the caste added to the ST with “Retrospective effect” with revert back to the presidential notification 1950.
Without considering the effect dates, month,&year of amendments by issue of judgments considering as Retrospective effect of 1950, injustice has been caused to the purchaser of the land there by resumption of purchaser land back to original grantee.
In view of the above the necessary classification requires on the following points
1) Whether the constitution scheduled tribe all amendments & modification amendments are Retrospective or prospective?
2) On what bases the judgments have issued considering the constitution amendments to revert back to presidential notification 1950?
3) If the all amendments are Retrospective effect for this any of the notification issued in this regards?
Dear sir kindly as soon as possible necessary legal advice on the above the doubts may please I communicated.
We are waiting for kind advice
Thanking you sir
