Seller not willing to give old deeds...

Respected Sir/Madam,

My uncle has purchased a house in West Bengal through registered sale deed on January, 2013. After registration he asked the seller to give him the old deeds (of that house property), but the seller refused and gave an excuse that those deeds were his ancestral property and he will not part with them.

My uncle and his lawyer tried to explain the seller that, it is customary for a seller to transfer the old deeds of a property to the new buyer, when the property gets sold, but to no avail. He started misbehaving and quarrelling. We left the matter there, and moved on.

Meanwhile, my uncle also did the mutation of that property in his name.

After, all these months recently my uncle has started fearing that since the seller has retained the old deeds of that property, he or his successors may do some mischief such as trying to sell the property again or something like that.

My question is, after a new sale deed has been created and has also been registered, what importance does the old deeds of that particular property has at this moment ?

Is the seller able to perform any kind mischievous act(s) with those old deeds ?

Please, reply…

Thanks in advance.

Service tax

Hi,

We have rented a property and running a fitness centre on it. We have executed a lease deed also. Now the lessor is asking us to pay amount of service tax. In our lease deed, we have clearly mentioned all rates, taxes and cesses with regard to property and incidental thereto shall be paid by the Lessor.

My question is whether, can we construe that "all rates, taxes and cesses" also includes "service tax" and tell the lessor that you are liable to pay.

Cbse denied the name change application what can be done now?

Respected lawyers of this club,

I am in big trouble unintentionally i have been caught in this problem and getting no where out of it.

I did my 10th from CBSE in 2003 which has my mother's name incorrect as Vibha which is her after marriage name but not official) in place of Ramesh Rani. It went all ok till i completed my graduation and other diplomas because it was never asked for mothers name their. Recently i faced a query from the passport office and was mentioned to get it corrected in the 10th certificates. I approached CBSE through proper channel ie. my school but my application has been rejected under 69.(ii) because after 10 years no such request is entertained by the CBSE. I am in big trouble now. can somebody please show me some vision? I am trying for government job and this kind of problem can ruin my career forever. I know its a blunder on my part but is it that big that i have to suffer for it for the whole my life? or should i die because i will be of no where then.
please someone help. where shall i go and what can be done, also i heard of filing a writ but that is time consuming isn't it and i need this to be solved asap. also i am not financially independent so would not like to take huge amounts for lawyers fees from my parents. please someone help i will be really grateful to you.
