Settlement deed

Dear Sir,
I a have a question.

When A (Father) & B (Son) Jointly purchased a property. Subsequently A (Father) made a Settlement Deed in the name of B (Son) giving away his (Father's) Share with a life interest of A's Wife and A's Daughter. A had no ancestral property during his life term.

After A's Death, A's First Son's Son is contemplating to demand a share in the A's Share given to B. A had Four Sons & Two Daughter. All the sons are separate. B was staying with A. First Daughter is married.

Before A expired, he had took on a stamp paper NOC from all his sons and daughters for the Settlement Deed.

Now what is the Position of B? Can a grand son challenge the said Settlement Deed in question ? Whether such claim is sustainable in a court of LAW ?

Additional non occupancy charges levied by society

Dear Sir,

I have a flat in Mumbai at Charkop Kandivali west which I used to rent. One of the member of Society Committee has called me and demanded 1 months rent I am getting from Tenant for each year starting from 2012. He has also threatened me that they will not issue NOC and will not allow a new tenant to step in the society.

When I demanded the copy of resolution they are saying that it was passed during one of AGM. The member has asked me to take appointment of the committee to discuss however not giving any appointment. Due to this I am unable to rent my flat to a new tenant and loosing rent. I don't want to pay as already paying 10% non occupancy charges. Can you please advise future steps to avoid harassment by the committee in this regard.

Letting flats in residential complexes for guest houses

Our residential association registered under the "Travancore - Cochin Literary Scientific and Charitable Societies Registration Act, 1955" bans letting flats for "business/ commercial" purposes. See Please see the relevant clause below:

"The apartments are not to be used or caused to be used, either in expressed form or in any disguised form as business/ commercial/ entertainment place and should only be used for residential purpose. And apartment owners are not permitted to let out their premises wholly or partly for short stay to any person/ authority."

Does letting one's flat for Guest House purpose for a company/ organization constitute a 'Business/ commercial' purpose?
