Hi,
My wife filed DVC and as part of that asked for residence in my house.
The house is though owned by me was never inhabited by me or my wife. We argued so and claimed it's not a shared household as envisioned in the act and instead are willing to pay her rent.
Lower court has ordered in our favor asking me to pay rent and saying that my wife is not entitled to live in the house though under my ownership.
My wife appealed against it in Sessions court and that court has given order in her favor, saying she can reside in that house.
That house from the beginning has been given on rent to tenants. My wife forced them to vacate and then locked the entire house and left.
We filed a revision in HC and HC has stayed the order in her petition in the lower court.
My questions:
(1) Why has the HC stayed her petition in the lower court?
(2) Does it mean that her original petition itself is in question and the status now is that of not having any orders for that petition?
(3) If so, can I ask her to vacate the house?
(4) Can I now sell/gift the house?
(5) If yes to (4), how will HC see my selling/transferring the house? Will HC have an adverse opinion? Can it reverse the sale/transfer if it thinks that my wife is entitled to the house?
Thanks

Sir,
My land and buildings has been acquired by NHAI under NHAI act. I have received award dated 01.01.2014. The compensation is very low compared to market value. I have been suggested in this forum that, the present right to fair compensation act 2013 is applicable in my case. Also, I have been suggested to approach lawyer and seek justice in District court invoking section 18. But, the lawyers I met are not confident.
Further, I requested them to go for writ for enhancement of compensation as NHAI act section 3g(7)clearly states that, the competent authority or arbitrator should consider the loss component while determining compensation. The competent authority has not considered this aspect. The arbitrator who enhance the compensation due to the facts which has not been considered by the competent authority will not become an enhancement than eye wash. I am not able to convince this to lawyers as I am not able to find the lawyers expertise acquisition matters.
Sir, I want to know, is my doubt expressed above is correct? Please, suggest me what should I do?
