hi sir
my uncle stayed in a corporation house.and then he gave that house and borrowed a sum of rs 200000.as a debt they dint write any documen.but they just wrote in a document that he has borrowed a sum of amount as a debt so he gave it like a leese for two years .after that he had some problems so he was not able to recover it .and that person also stayed there for more than two year for about five years .but now when we ask for our home he is not giving it he says that he needs 800000 for that home .but the house is in my uncles name ,even the ration card and eb bill are in my uncles name.and he also threatens us that he would sue us to tthe court .and the document that he has also declarehe house has t that to be returned after giving the amount of 200000.what should we do now to save our house. we have changed our address
but still the eb bill and corporation bills are in my uncles name.in that document we have mentioned that the interest is 2 percent.but we dint collect rent from them we said that interest shall be the rent.
now they have sent us yesterday a notice from a lawyer which states that they would file a case against us under section caveat 148_A of c.p.c.
will this affect us or what we should do to get our house back.

I Joined NHAI on deputation in 2008 and the authority invited applications for Absorption on the same post on which I was working. I applied and was selected by selection committee for appointment subject to Vigilance Clearance from Vig. division. Afterwards 4 months later, offer of appointment on absorption was given to me in July 2013 and I took voluntary retirement from my parent organisation on the grounds of absorption and joined NHAI after acceptance of VRS. Appointment Order was also issued in Sept. 2013 subsequent to acceptance of my VRS. Now after 5 months of joining, Admn. division of NHAI has issued me a showcause notice in Feb. 2014 for withdrawal/ cancellation of offer of absorption on the ground of some problem in vigilance clearance, which I am not aware of. Neither any memo/charge-sheet/seeking clarification on the so called vigilance matter has ever been served to me in my career in NHAI since my deputation. I have never been asked any question by Vig. division and admin, division in any matter in the past.
My queries are:
1. Can the appointment be withdrawn after such a long time on ground of vigilance clearance for which I am not responsible and in a situation when i have taken VRS and my VRS has been accepted due to absorption?
2. Can the vigilance clearance be denied for a person who has newer been asked any question in any matter/inquiry which is more than 2 yrs old?
3. Can the Competent Authority who approved Absorption on the recommendation of Screening committee & Selection committee can himself change its decision after 5 months and withdraw its offer?
4. Can the offer of absorption be withdrawn after issuance of appointment order on the grounds that the offer of appointment is provisional and the employee is on probation.
4. What are legal remedies available to me suppose in case offer of absorption is withdrawn? Because I have taken VRS and withdrawal of offer of absorption shall amount to termination of my services.
Please provide me your valuable advise.

hi sirs
i just want to know that is there any provision is there in the law for a son to get right in the property jointly held by the father.
now the father had died
there are two brothers both are willing to have right in the property but the mother who is second wife of the father refuses them any right saying the property is solely hers and they (Sons) don't have any right in the property.
the details of the property is as follows its a residential flat on which the father took loan from the bank and and after some emotional blackmail from the mother he also made her joint holder in the loan as well as in the property.
this is the second marriage of the father
until the death all people were living together in the said flat but now the mother refuses the sons to live there stating this is her house and you don't have any right in the flat so you move out some place else.
when sons asked about agreement copy of the flat she refuses to show
and she is also threatening that she will make sexual harassment case on the sons and send them in jail.

if there is any conflict between lawyer and police officers and the "Bar" of a district court passed a resolution not to co-operate with any police person. it has been also decided by the advocates of the 'bar association' that they will not allow any police person to enter in the court premises neither any accused will be produced before the court by any police from any police station.
what is the power of police officers which they can do within court premises?
The lawyers of the 'Bar Association' has agreed that if they say sorry to the lawyers for the wrong they did than everything will be resumed but police officer denied doing so.
Now the question is what they can do?
Is there any provision police can utilize?

I had bought about 8 ghuntas of Land in Pune for about 28 lacs in Aug 2011. The sale deed was executed and duly registered with the Seller called as Sawant. While executing the Sale deed the 7/12 did not have Sawants name but the name of the earlier owner called Sethi. Sawant promised that he had applied and once his name appears he will also get my name registered on 7/12. Later after an year Sawant informed that he has been duped- the Sethi from whom he bought was an impostor and not the real Sethi. He has agreed to cancel the sale deed and return our money.however he is dragging the matter and unable to collect the money he promised to return us.I also later ascertained the matter and confirmed that he was really duped .He owns a flat worth 35 lacs where he stays currently which he says he can sell it to us in exchange of the money. The flat is mortgaged to a bank and about 4 lacs needs to be paid to release the flat from bank. I can either pay this or transfer the loan on my name. My question is : Can Sawant and self execute a sale deed of the flat ? is it legally possible since no money will be transacted ? Looking forward to your valuable advise. In the above case as yet I do not wish to go for litigation but try to sort out the matter amicably at first.
My aunty filed a money suit against my father for 4 lakhs rupees in May 2013 by creating a forged promissary note. My uncle(aunty's husband) & some one else are the witness. How can I file a case or lodge a complaint against this cheating. our advocate filed reply petition. Until Now I could not get copy of promissary note , they say i will get it only when it is exibitted.I have placed a Grievence petition in july 2013 before superintendent of police, still it is under enquiry at local police station.
