Challenge

1. Can an arbitrator fix his
own fee.

2. If one of the parties does not pay fee, how can an arbitrator recover such fee.

3. If on challenge by one party, arbitrator decides that his appointment is not valid as per agreement, will he be entitled to fee for hearings done by him.

Complaint against a lawyer for his insincerity in services

I had to file a review petition in the National Consumer Redressel Commission to plead against the judgement of the State Commission, hence had engaged a lawyer to plead my case, but he not only had miserably failed to project even the objectives of the petition, he also could not justify that why he had filed petition in the commission. The Hon'ble judge even had thrashed him for misguiding a client about the purview of this commission. The judge was so much annoyed with his presentation that he advised him to withdraw the case. Whereas he had charged full fee to file and plead the case until final verdict. Now he had refused to refund fee proportionally. What to do now?I think there is a provision in the Bar Association statute to complaint against such non committed lawyers. Pl advise. Thanks.

Restoration of complaint u/s 138 of n.i. act

Sir,

My Client filed a criminal complaint U/s 138 of N.I Act in JMFC VISNAGAR, in 2002.
An advocate fiied V.P. for the accuesed and asked exemption in many adjournments.Ultimately non of the accused present still end of 2005. the case is on adjourn on stage of PLEA.

Due to non appearance of accused and fear of misconduct on request by complainant the case was shifted to Mehsana Chief court.

Also there the accused present not a single time still 2009.

In September 2009 accused hospitalized for Kidney problem and still 2013 he was under treatment of Kidney transplant and infection in that.

In 2010 JMFC Mehsana had passed order DISMISS for default for non appearance of complainant/advocate and acquitted the accused.

the complainant came in the knowledge of this order last week.

Can we file restoration application with delay condonation application.

or have to move Sessions court

or High court?

Please guie

Drt

Dear Respected learned members,

An appeal has been filed in DRT challenging 13(2), stopping the process of 13(4) allowing my client to pay his EMIs as the institution has stopped accepting his EMIs returned the EMI cheque sent by registered post. Due to which the above appeal is filed. The DRT has accepted the appeal and the notices is being sent to the institution to appear before the DRT.

Can I as the lawyer of my client cross examine the institution when the institution appears before DRT? Is there any sections under law to cross examine the institution?

Thank you.
