Information indian law & muslim law

I and my wife use to work together. She was elder to me. We had an affair later got married on 7th july 2010. We did not disclose about our marriage in our families and use to stay at our homes. Later i came to know that she was already married with a kid. This i came to know after a year in march 2011.
When i asked her clarification she started abusing me and arguing with me.
Later i got her birth certificate and ration card xeroxed which had all details of her daughter.
Immediately i consulted advocate and filled a case of nullify our marriage.
She never turned to court when ever there were dates.
All the dates given by family court she was absent.
Judge required more details as xerox of ration card was not valid and enough document.
As her daughter name was entered after she was 4 years.
When we went to court for registering our marriage. She submitted her birth certificate but the age written was wrong.
Second she was already married but written unmarried at the register application form.
I am muslim and she is parsi by birth.
Since 3 years and 7 months we have never been together.
Last time i met her in 2011 June. Till now i have never met her nor kept any contact.

I want to know does Indian Law will allow me to marry as well as from the Islamic Law?

The case was dismissed and hoping to go further again.

Will there be any problem if I marry someone now?
will there be any kind of criminal charges against me my family or the 1 whom i will marry?

As we never been as a husband wife under one roof. Does the marriage gets nullify naturally?
What caution should i take for my future?

What to do if trial court do not follow high court speedy justice order

Hi,
6 months back high court did not admit my quashing of 498a. But an speedy justice order was given and the trial court was asked to dispose the matter by 6 months. The six months are getting over in next week. In last 6 months trial court judge was very careless in dealing with the case. He never showed any intentions to dispose the case. Now recently he has been promoted and transferred. The new judge has not been coming since last 15 days. The trial court do not have any judge for last 15 days. And my wife's cross examination is not finished yet.
Now, my question is what action I should take to get speedy justice. I am innocent and trial court had been too reckless to finish off the case and each day I feel frustrated. When must I approach the high court again to quash the 498a case against me. My wife comes to the court according to her wish, she comes once in 3 to 4 dates. Other witnesses have been missing despite Police sent them summon and many NBWs have been issued against them. They never bothered to appear.
If the trial court new judge does not come in next few days what action I can take? where can I complaint about this?
My life is completely getting ruined due to crawling reckless judiciary where not even high court order is being followed seriously?
How much more time I must wait before going to high court again? Kindly advise me.
Regards
Mani

Appeal against maintenance

My estranged wife salary is more than mine, yet the court has awarded 40% of my salary to my wife for my 2 kids in sec 125 as interim maintenance. In the order, the judge noted that wife is earning handsomely, yet awarded such high maintenance stating that kids are joint responsibility. After 30 days of order, she filed for enforcement. Now the judge is saying to pay within 3 days in court itself otherwise she will attach my salary and put me in jail. I want to appeal against such high maintenance but the judge is effectively ensuring to close that option. How can I exercise my right to appeal because the order has been given only 31 days back ?

Regarding service bond break of my company

Dear sir,
I was working in a construction company with a service bond of 3yr. Due to non-availability of job at recession time,i was forced to sign on the 1OORs Judicial bond paper along with my parents.

It was written on the bond paper that "IN CASE THE UNDERSIGNED COMMITS ANY BREACH OF DISCONTINUATION OF JOB FOR ANY PERIOD,THEN EMPLYER COMPANY SHALL BE ENTITLED TO RECOVER FROM THE PERSON OF THE NNDERSIGNED A SUM OF MONEY WHICH THEY HAVE SPENT DURING TRAINING PERIOD & IT WILL BE 2 LAKH & UNDERSIGNED WILL BE LIABLE TO PAY WITHOUT RAISING ANY DEFENSE".

The reason for my job quit are
1. very less salary than other companies
2. 12 hour duty imposed without assigning adequate employees,no sunday as holiday
3. not provided proper facilities
4. rude behaviour of manager for any work to all employees
5. other confidential things

So i quit my company after 10th month assighning my leg fracture.
After 1 month,i got a parcel by post from my company. I didn't accept that parcel.

please give me your kind advise (if confidential, you can give in my mailid- lulu.srk@gmail.com) to tackle this situation

How to find out the ownership change of my parental property

Dear Sir / Madam,

We are three sisters and one brother. Brother is eldest, i an the second daughter of my parents. We were resident of Delhi. I got married on 2002 and came out from Delhi along with my husband.

We have one property which was in my mothers name. My mother was expired on 2002. After my mother passed away, my brother was asked us to sign in a blank paper stating that this will be required for withdrawing the Post Office small deposit which my mother had and she did not have any nominee declared in that deposit scheme. We did the sign.

Now, all the three sisters having a doubt that our brother have transferred the ownership of that property in his own name. Please note my Brother and Father are staying in that property. As far as I know, all children having the equal rights in Mother's property.

The first step has to find out whether the ownership of that property has been transferred to my brothers name ? PLEASE GUIDE ME HOW TO FIND OUT WITH OUT MY BROTHERS / FATHERS KNOWLEDGE ?

Then we will decide for the legal option. If we go legally, will it help ? Please suggest.

Some points to be noted :

1. All the sisters got married and staying in their in-lays house.

2. My brother is still unmarried. Aged about 45.

3. My Brother and Father are staying in that property only.

4. We are normally visiting there once in a blue moon.

Please suggest me on the above.

With regards,

Mamtha

In the meanwhile, the notice sent to my client U/s 13(2) giving 60 days time to pay the amount has been lapsed.

Can t he financial institution proceed against my client U/s 13(4) as 13(2) itself has been challenged by my client which is with DRT.
