My friend is a Non-tribal who wants to purchase Tribal land in Maharashtra. As per Sec. 36 & 36A of Maharashtra Land Revenue Code non tribal can purchase tribal land with the prior permission of Collector. But I heard that currently Bombay High Court has been passed the judgment which stated that Non-Tribal can’t purchase Tribal land, Only Government is a right to make compulsory acquisition of that land if situation demand.
My query is that is this type amendment / judgment has been passed by any Court?

i was married to lawyer by negotiation 6 years back. She stayed with my family only 6 to 7 days within this period we had s*xual relation once. After that she left our home with giving me a allegation that i cannot satisfy her s*xually,so she does not want to stay with me. After one month she called me up to inform me that she was pregnant. She gave a birth to child(boy) after nine months. After that she continued to stay with her family till date.
Now my question is how can i get rid of this unfaithful woman? She is not willing to give me divorce because she is using my name as her child's father.
Please give me suggestion how to get rid of this woman with her child

We have paid maximum amount of stamp duty @Rs50,000/- on Letter Evidencing Deposit of Title deeds about two years back as per the amended Stamp Act. The loan amount was Rs.30.00 Crore. Now, we have availed additional loan of Rs.5.00 crore thereby the total loan revised from R.30.00 to Rs.35.00 crores.
The banker is demanding stamp duty @0.1% on the additional loan of Rs5.00 crores.
Our objection is as under:
1. Art. 6 of the Karnataka Stamp Act is applicable.
2. No additional security given.
3. Since, the loan is an extension to the existing loan and we have paid the maximum stamp duty of Rs.50,000/- in the initial stage, there can not be additional duty on the additional loan of Rs.5.00 crore.
4. The agreement for additional loan is a link agreement to the original one.
5. The agreement for enhanced loan can not be LED as demanded by the Banker and is only an extension to the main agreement.
Respected Members are requested to clarify the above issues.
Thank in advance.
Can son/daughter of a deceased employee raise an industrial Dispute under ID ACT on the ground that he/she has not been provided the employment on compassionate ground? It is clarified that the establishment do not have any rule for proving the employment on compassionate ground for dependent of deceased employee.
There is a provision under EPF Scheme under para 26-B which deals with in case of doubt on the date of eligibility to becomes a member of the Fund, the RPFC has the power to conduct an enquiry and decide the same. For this purpose he will have the power of CPC. Normally it is applicabe in case there is difference of opinion between employer & employees regarding the date of joining. My query is whether there any analogous provision is there under ESI Act?

Hi,
i wanted to know your view on my following issue.
i did purchased a site in a layout which has been approved by BDA, but the problem with my site is that it falls under CA area in the BDA plan and the society still went ahead and registered for its original member, later they had colluded with Revenue department and obtained the BDA katha as well and subequently sold it,i am the fourth owner, after BDA katha, subsequently BBMP katha had been issued and all relevant tax paid.subsequently i applied for house plan approval to BBMP and it also got approved.
so now my question is what will be my hold on this property? will i be able to fight it in court and legalise it?
or else what alternate options.
Please udpate me in detail on this.
thanks - prashanth
Dears,
I had given an advance of 6lacs to purchase a house in Feb'2013, and after 4 months, due to my inability to get the required loan, I have entered into an agreement with builder in Jun'13 that he can please return my money and sell the property to some one and agreed to a refund of 4.7 lacs, and he has given a cheque for the same value, Now, he is not repaying the amount and threatening me to do whatever I want. Now, what are the options for me? Can I present the cheque(I am sure it will bounce) and file a complaint with Police or Can I directly approach Police and raise a complaint? Please help.
Registration and stamp duty application_west bengal for assignment of agreements for sale
The Company (listed public limited company) has agreements for sale (signed in the year 2009) registered in its name and now it wants to assign such agreements for sale to other companies as per the assignment clause in the agreement.
Section 17 of the Registration Act, 1908 lays down different categories of documents for which registration is compulsory. The documents relating to the following transactions of immovable properties are required to be compulsorily registered;
(a) Instruments of gift of immovable property
(b) Lease of immovable property from year to year or for any term exceeding one year or reserving a yearly rent.
(c) Instruments which create or extinguish any right or title to or in an immovable property of a value of more than one hundred rupees.
Please note that the title of the property was not transferred to my company being only Agreement for Sale (an intention of future performance) signed between the seller and my company (in the year 2009) and the transfer was in the nature of part performance then after amendments in Transfer of Property
Act, Stamp duty and Registration Act after 2001, the Company was required to register these documents for the purpose making a legal binding part performance as the Agreement to Sell cannot be enforced for any specific performance unless it is registered. Additionally, it was required to pay 90% of the stamp duty before registering the sale agreement which it did.
And now it intends to assign its interest in such land contracts (assign agreements to sell) to other companies (under the same group) as per the assignment clause in the Agreement.
In this regard, please guide, whether the company is REQUIRED TO REGISTER such agreements and PAY APPLICABLE STAMP DUTY as per the Government of West Bengal on such Assignment of Seller's Interest in Land Contract or not?
