Lease termination

A has entered into a lease agreement with B for commercial purpose for a term of 5 years at rent of 48000/- per annum. Such agreement was duly redistered before the District Registrar. Thereafter B started abusing of leased premises, installed heavy industrial equipment for which A, the landlord is suffering from the vibration and noise of the equipment as his dwelling house is the adjacnt land of the leased area. Just 3 months passed after execution of Agreement. But within the mean time, A requested B to relocate the said machine, therefater requested through Advocate's Notice but B didn't pay any heed rather B threatened A over telephone as there is no condition mentioned for this type of violation commenced by B.
What should be the procedure to terminate the Lease Agreement between A & B. And also to evict B from that premises what type of Suit (recovery of possession/deed cancellation/declaration and injunction/etc)may be filed by A?

Delay condonation

my client received summons in Nov,2012 and accordingly he was added party to the suit.
he had already filed petition in High court against order dated 23/4/2012 by which he had made party for suit for specific performance of contract.

He informed the court on 15/12/2012 regarding filing of suit in High Court and demands adjournment. The court granted adjournment. after the order of High Court passed on 16/4/2013 the client appears in July 2013 for permission of filing written statement. In August 2013 when the written statement was bought for filing the other party take objection on the ground that there is delay. In september 2013, application for delay condonation has been filed and now the court wants evidence on delay condonation. please suggest draft of evidence in delay condonation.

Parking allotment by builder before society formation

Dear Sir,

This is regarding parking space allotment QnA on this site

We have purchased a flat in Kurla East in a under construction building in 2009, agreement date in Jan-2010. The construction is complete now and possession in

progress, the builder personnel approached us for parking allotment through phone call (no official written communication/email). Builder asking for money for parking

without giving any receipt, he will just provide a allotment letter showing that it is a free allotment on first cum first serve basis. Nothing is mentioned in our

agreement about parking. The society is formed yet and may take a couple of years as the construction of other wings is in progress. Also builder is taking a parking

no-claim undertaking from those who have not allotted the parking while providing the possession letter. Some of flat owners already paid him forking and got parking

allotment letter while majority others refused to pay for parking as per SC judgement. I think the builder is legalizing his illegal parking allotment by no payment

receipts, first cum first serve basis and parking no-claim undertaking.
Now I have below queries
1. The allotment is done after 31-Aug-2010 (SC judgement) however before formation of society so the allotment made by builder is legal? As per your answer the allotment can be legal

so have doubt about it.
2. Once society formed can society cancel the builder's parking allotment by laws? Society can decide the llotment rules at that time as per by laws.

Request you to please help to answer these queries. Let me know if you need anymore details to answer it.
Thank you in advance.

Best Regards,
Sachin Timane

Abandoned land

Respected Experts,
My friend is in possession of a property which lies abandoned i.e. there is nobody who claims to be its owner. He is in possession of that property for more than last 33 years and he has electricity bills, water bills and house tax bills of that property for last 12 years. It was an abandoned land and he built some accommodation over it.
My query is that:
1. Which type of suit he needs to file in the court of law to become its owner on the basis of possession?
2. On the basis of the above said documents of possession can he get such a declaration from the court by which he gets treated as owner enabling him of getting sale-able title of the said property?

Hi

I had to leave my previous employer PRECISION without serving the required notice period of 3 months due to some unavoidable personal reasons.

Now they told me that they will take legal action against me & not settle my F & F & they will recover from my PPF Claim.

What should I do? Does anyone know if these companies really take legal action or are they just trying threat tactics?

i am in this co. by last 1 year and they mentioned in their appointment letter that we need to serve notive period 3 months after cofirmation.

I am confirmed also but i didnt get any confirmation letter from co only recd single mail that you confirmed from HR but i have not replying on that that mail or not given any acceptance.
