My friend is a newly advocate who just started his practice has divorced his wife. He does not have any fix source of income having his own separate ration card but lives in the house of his father who is a pensioner .This advocate has no property in his name. Now my query is that being a newly advocate my friend cannot bear his own expences If his wife files maintenance case then who will pay the maintenance amount to the girl. Whether it can be deducted from the pension of his father. If he does not able to pay the maintenance amount then what step the Honourable Court can take.

My wife stayed for 33 days in my home. I and my wife both have accepted in court that we had not any physical relations between us and we both need divorce. Wife has taken her stri dhan back.
Is she entitled for maintenance? She is MBA and earning more then me before marriage. Now she says that she is jobless. Her complaint in CAW cell has been closed as we have amicably settled all the issues between us and we are living separately.
If she is entitled for maintenance how much percentage of my salary. I have my own home. My father is retired govt. employee and my mother is working. I am only son of my parents.

Is it right that to get the maintenance from husband a wife has at least stayed 90 days in her matrimonial home. Only if she has stayed at least 90 days in her matrimonial home she is entitled for maintenance otherwise not.

A muslim girl has married to a muslim boy by Nikah. Where her fathers name is mentioned as Abdul a muslim name & he himself has signed as a witness in this nikah nama by same name the i.e Abdul. But her father .Abdul have all his legal documents such as Aadhar Cards ration card etc by the name of Ramesh Kumar a hindu name.It means the same person is using two different names. My query is that whether this Nikah is valid or not. If this nikah is invalid whether any criminal proceeding can be filed against the father or girl.

Dear Respected Members,
During the regime of Indira Gandhi, KUL Kayda was enacted. According to this Law, the tenant of the agricultural land were made the owners of that land they were working on. Hence, because of this, Land was allotted to the tenants of that time, for agriculture purpose. And the 7/12 extracts contain their name.
Before 20-30 years, the population in that area was not too much. The so called Tenant turned Owners used to give the land to other people on lease for residential purpose. ( The Land is Agricultural Land: Govt had given the land to this tenant turned owners for agriculture purpose)
Now, the population is very dense in that area. And whosoever goes for construction in that area, since they cannot give on lease the said agricultural land neither they can sell it, whatever construction is coming up in that area is Illegal Construction.
Because, the 7/12 extracts contain their name ( Tenant turned owners), this people ( Tenant turned owners) demand hefty sum from the people residing in that area.
This is a kind of EXTORTION AND EXPLOITATION.
So, my question is whether a PIL can be filed in the court of law for the removal of their names from the 7/12 extracts ?

Respected Experts
we are facing a serious harassment issue by Kotak Mahindra Bank.
Home loan is taken by my father and there are several co-borrowers including my mother and two brothers. Father, mother and one brother are co-owners of a property.
my father/mother intend to foreclose the HOME LOAN on a priority basis, however the bank is not allowing us. My brothers had a credit card default for which bank has resorted to arbitration ex-parte fraudulent awards which are filed as decree before court for execution. These execution proceedings are already pending.
Bank does not co-operate to foreclose the home loan, they use SARFAESI ACT & delay foreclosure intentionally. Parallel, they send an official email stating that bank will not release the FLAT PAPERS till my father clears both home loan & credit card dues OF MY BROTHERS.
Please suggest if experts have any reference of RBI guideline in relation to this query or any other valuable input
Thankyou

Dear Sir,
We are the permanent employees of a PSU and an exempted establishment from The Employees' Provident Fund & MP Act, 1952 under requisite provisions of the Act. So our Corporation maintains PF details by its own Trustee Board. We have our self generated pension scheme which is far better than the Govt. Pension Scheme i.e. EPS’95 Scheme. Our query is that can we get exemption from EPS’95 ? If yes/no, then why?
Note : Our contract labour employees have no pension scheme of their own & so they are covered by EPS’95.
regards,
Swapan
