Ancestral property

Dear sir/s

Would like to get clarifications on ancestral property rights

1.My father had willed agricultural properties inherited from his father through will and partition with his brother. My grandfather had inherited these properties from my great grandfather. Could my father write a will these properties as per his wishes? As a son what is my right over these properties?

2. my father had also purchased a property on his own from the income only from the inherited properties as mentioned above. Can my father will this property as per his wishes?

3. we are four legal heirs (mother,2 sons and a married daughter (1983-marriage date)

regards

Ram

Pil

I am Raviraj, (Social Worker) and would like to file PIL in the Supreme Court of India related to Election matter.

I would like to file PIL on the following matter:

Whether already elected MLA (just after completing 1 year),can contest for the Loksabha Election. In case he gets elected, he would resign for the MLA post and Re-election will be held for that Constituency. Once re-election held, Crors of rupees would be spent and people time, resource & money etc. would be wasted.

I would like to know whether above cited issue comes under the PIL or not. If PIL can be filed the follwing issues also may be clarified please :

Whether any Lawyer is available to help me to file PIL at free of cost & nominal amount.

When I asked with a few Lawyer, they told me that it would cost me around 50,000 to 1 Lakh. I find it it is very huge amount to be spent for Social Cause. I cant afford it.

Please guide me in this regard, because we people (educated) should stop all these unwanted things.

Sir,If I don’t file it, he may win the MP seat and try for the Minister Position. If he gets the Minister post, he would resign to the MLA seat and his Son would contest for that seat. It is really heights of anything and National Waste.

I am just 32 year old person, but i feel very uncomfortable when all these unethical things happen in front of me sir. In my state alone 4 to 5 MLA's are going to contest MP seat. If we educated people can’t stop all those things, who will change the system ?

Please guide me.

with regards,
Raviraj

Contested case vs judicial separation

Hi,

I am a 35 yrs man, separated from my wife 5 years ago living in same city but different houses. Since after numerous attempts she is unwilling to go ahead with mutual divorce, I have no other option but to file it 1 sided. My lawyer suggests that we file a Judicial Separation case as thats easier and quicker to get, as compared to contested divorce.
Whereas I was under the impression that by living separately for 5 years already, theres no point of JS and its better to go for contested only.
Kindly suggest which one do I choose and what the pros n cons of both options.
My wife and kids stay with my parents only, and my parents are on my side and are supporting this case so the divorce happens soon. Please suggest.

Arrest warrent for non payment of interim maintainence denied due to jurisdiction

Sir,Madam

I was awarded a maintainence of 11kper month for myself and my minor daughter in april 2013 from the date of application i.e march 2012. Since he did not pay we filed an Execution petition, notice was served to him. In novemeber 2013, the Belgaum family court sent a arrest notice as he does not have any property on his name to be attached(property in his parents name worth 10crores at Hubli, Bangalore, Belgaum nd sindhgi). The arrest notice is in await till today. My lawyer asked for reissue the arrest warant, but the judge said that since my husband is residing in bangalore the Belgaum family court does not have the jurisdiction to order the Bangalore police to arrest him and bring him to the court. My Query
1)If this is true, In India most of the husband wife belong to different cities and the wife goes to the husbands place after marrisge. How can this particular problem be tackled.
2) what other means can be used to make him pay the interim maintenece.
3) The judge asked us if we could make arrangements to take a constable from belgaum and accompany him to bangalore to the police staion under which his residence falls and then take a constable from ther and go to his residence and bring him to belgaum wich is practically impossible for me to do. what other way can be employed.
4) Can salary attachment be done to claim the accumalated maintenance?
