I was faced some matrimonial issues. Now I got divorced from my wife.
But before any cases I have have gifted my Flat to my dad 2 yrs back by paying 50000/- stamp duty. For GIFT DEED, I have not informed the ICICI bank. And still paying loan for the same flat.
Queries :-
Now what should I do to take that flat on my name again?
Should I cancel the GIFT DEED?
or
Should wait as after my dad it will come to me again. Should I need to pay that time again?
Which will be more convenient way to follow?
Respected Advocates ,
Pls advice
@The Hon’ble family court dehradun granted Restitution of Conjugal Rights in favour of the wife in Sept 2010 duly giving several opportunity to the Respondent. The case was moved ex-partie several times and was restored several time as evident in the Order sheet. However respondent in the Habitual manner spoke several lies and taking cognizance of the conduct of the opponent Hon’ble court passed the judgement EXPARTIE in favour of the Petitioner.
@ The husband had meanwhile obtained an expartie divorce decree my means of fraud in Vishakapatnam in Feb 2009 and was disclosed to wife in June 2009.Thereafter the wife fought the setting aside of Judgement of Vishakapatnam and finally won the same after the intervention of Hyderabad High court in Oct 2010.
@ The Divorce Decree was set aside in Oct 2010
@ Husband filed the case in High court Uttarakhand in Nov 2010 and got the RCR case(in Dehradun) remanded back on the basis that there existed the valid Divorce Decree in the month of Judgment of RCR in Sept 2010.
@ In the month of Oct 2011* Husband for the first time confessed in front Judicial Magistrate (DV case in dehradun) that the entire Divorce Proceeding was incorrect. It was pertinent to note that the Divorce Decree was used in every court of law and in army to curb the rights of the Wife.. Infact the Husband tried to take full advantage of the Decree and Attempted Bigamy with lady Capt with whom he had extra-matrimonial affair.*I could not approach High Court Nainital due to financial constrain and as I was busy fighting against the harassment in multiple cases.
@The Divorce Decree was set aside and when the Husband was about to be caught red handed he filed the Petition for withdrawal and was subsequently withdrawn .
@ The Use of Wrong Decree of Divorce which was void-ab-initio, in Hon’ble High Nainital court in 2010 lead to remand of the case of RCR . The confession of the wrong in Decree Divorce had come much in Oct 2011. In such circumstance can I request the Hon’ble court tin dehradun to quash the further proceeding in the RCR case . Can I also request the Hon’ble court to seek proper explanation from the Husband of the whole cheating that has been executed by him in order to harass me ?
What remedies do I have ? Do I need to contest the whole RCR case again as now the case has rekindled in the court ? Please Guide ?
Regards

Sir, we 23 flat owners have purchased flats in a single wing in d year 2009, it was agreed in our agreement that possession and completion certificate will b given at d last till end of dec 2013, however, that builder has given us oral possession in 2012 on d oral committment that water connection and electricty meter ill b given 2 u till may 2013. Subject to that we had taken possession. Now sir almost 1year has lapsed we r been provided borewell water and temporary electricty without our own meter. Except this 2 factor rest of building work is totally completed. N on last week we come 2 know that our builder has ran away from his office and residence. Now sir even I ill approach in consumer court and order is passed in our favour, how would we get CC from corporation and electric meter as as all d requisite papers for obtaining CC AND METER is with builder only, n without complying documentary works how can we get CC AND METER IN OUR favour. Advice me how would we resolved our grievances in this situation. D builder is not traceble
I have asked the question earlier as well as a member of this 2 Lac plus social site. Now I am engaged myself as my Advocate without any degree in law as PIP WP 21313/2013 in HC AP. As someone has foretold that my writ will be posted in the routine manner. But it has to be posted. So I need to be up-dated and fight it out.
As my daughter was offered a Cat-C MBBS seat but declined and was offered a BDS seat in GDC&H in Hyderabad and admitted I think there is no hassl;es as far as candidate is concerned.
My appl for CAP cert (Children of Armed Forces Personnel)for a MBBS seat as per her EAMCET 2013 rank under CAP quota ( 1 %)stands denied by Zilla Sainik Welfare Officer on my DOMICILE issue.
I am an Ex Servicemen retired after 30 years of service to the nation. That's settle my domicile of India issue.
Apex Court has settled the issue conclusively that an Indian is a domicile of India and there is nothing as " Domicile of West Bengal or Domicile of AP ".
If that be so it is incorrect on the part of Zilla Welfare Officer to deny me CAP cert on not being DOMICILE of the State of AP. But he has cited the auth of a letter from his immediate superior auth i.e Director of Sainik Welfare AP which has asked him not to issue CAP cert to any ESM who is not a DOMICILE of the state of AP.
The Director in turn has quoted some extract of a Judgement of the Chief Justic e of AP in Writ Appeal No 951 & 952 of 2006.
In that order The Division Bench headed by then Chief Justice has stated that as per the EAMCET notification "mere residence of 5 years in AP is the only criterion for an ESM to obtain a CAP quota for his ward" should be revisited as various proceedings issued by Directorate of Resettlement Min of Def GOI prescribe DOMICILE as the main criterion for claiming benefits by the Ex servicemen.
I am ready to dis-count the claims or prescriptions issued by the ZSWO, the Director Sainik Welfare AP and the staff at the Directorate of Resettlement at the DGR MoD GOI as those were not legally trained to uphold the constitution. What about the Hon-ble Judges who wish to uphold the claims of the legally untrained officials. By citing the proceedings where those officials have prescribed DOMICILE OF A STATE as the main criterion to avail benefits offered by that state?
Is it not a case of contempt by the hon-ble judges of the high court against the settled order of our APEX COURT on the issue of DOMICILE of a state in India?
I am ready to accept that use of term DOMICILE in this case is simply to indicate BELONGING to a state in addition of being a domicile of India. And DOMICILE of a state simply means a resident of a place in that state. Now the term Resident when it means or to be used at par with " belonging to the state" is to be defined by the state itself. In the instant case the state in its wisdom with due deliberations and weightage to all the proceedings issued by the DGR Min of Def GOI ( referred to by the hon-ble division bench) had published GO 370 of 1994 on eligibility for availing CAP cert from the respective ZSWOs which is in vogue and has not undergone any amendment as on date. That GO states "Any serving or retired armed forces personnel who has resided for 5 years in AP is eligible for CAP quota for his children".
Can any body help me to give me a counter so that I am doubly prepared?
