Marriage law’s (amendment) bill 2010

I and my wife have accepted in court that there were no physical relations. We both have stated that we need divorce in front of judge. She has also received her striddhan in CAW cell and case is closed in CAW cell by amicalbe settlement of all the issues in CAW cell. She is MBA and earning more then me before marriage. Now she says she is jobless. My wife has stayed in my home only for 40 days.

I have only my home which is in the name of mother. We have nothing else as property. Is she eligible for 50% share in my home as per new Marriage Law’s (Amendment) Bill 2010″?

Reopening divorce case

I filed a divorce case in the they year of 2012.

Four months ago , my wife started talking to me and informed me that she was willing to live with me. As she was working in other city, she visted my house 4 times.

I informed my lawyer that we are thinking to live together. SO my lawyer didn't attend court. so My Divorce case got disposed stating the below reason.
------------------------------------
First Hearing Date 27-09-2012
Decision Date 29-01-2014
Case Status CASE DISPOSED
Nature Of Disposal Contested--DISMISSED FOR DEFAULT
-------------------------------------------

Now my wife stopped coming to my house also doesn't want me to visit her. She is saying we will stay like this for some more time and then decide. I fell like betrayed.

So what to do now? I had file my divorce case at my home town and now i ma working in different city.

1) Shall i reopen my divorce case at my home town? Is it possible to get it transferred to city where i am working?

2) Is it possible to file a fresh case in a city where i ma living by refereeing the DISPOSED case number ? please advice me.

Responsibility of cancellation of registered banakhat in ahmedabad

Dear Sir / Madam

I am a seller. I have done Registered Banakhat (time limit is 3 months) with one of the buyer but now he is unable to arrange loan so he is unable to purchase my flat. Now other buyer is ready to purchase flat on urgent basis.

My question is that what is the procedure to cancel the registered banakhat and who will pay the fees (for advocate and at registered office). Is it like that if buyer will cancel the banakhat then he has to pay 1% registration fee and if seller will cancel it he dont have to pay anything.

Kindly advice.

Warm Regards,
Yagnesh
