Hi sir, i have a query. My father got a gift for being a prisoner of war during indo-pak war from govt. Back in the 80's my father morgaged the property to a relative for rs10000 without having to pay any interest and to be redeemed at any time. My father signed in a blank paper for POA and handed over to the relative only to take care of the property of which till date we never got a copy of it despite repeated requests. Now he is asking 1lakh for us to get back the property at present. Now that my father has passed away, he even claims that
My father sold it to him ,He also says he sold it to someone else and even claiming to have all the necessary documents when all the time we the original docs. Your advice in details will be much valued and remembered. Sincerely
John

X was adopted by y about 50 years back the adoptive mother purchased a property jointly with the natural father of the adopted son long back by a registered sale deed unfortunately the school records of the adopted son shows the name of the natural father only now the sister of the adopted son denies that the adopted son has a share in the property of his adoptive mother since the records of the school do not bear the name of the adoptive mother. My question is can she raise this question after a long lapse of time she agrees that he was adopted but denies share in the property.

THE DELHI COURT HAS GRANTED THE LETTER OF ADMINISTRATION IN MY FAVOUR IN RESPECT OF A PROPERTY IN DELHI , IN A PROBATE CASE . THEREAFTER I APPLIED FOR THE MUTATION OF THE SAID PROPERTY IN MY NAME IN DDA BUT THE DDA REFUSED TO MUTATE THE SAME BY SAYING THAT THE SAME PROPERTY HAS BEEN ALREADY BEEN MUTATED IN FAVOUR OF ONE “X” WHO CLAIMED TO BE THE ONLY REAL BROTHER OF THE DECEASED . ON FURTHER ENQUIRY IT WAS REVEALED THAT THE SAID “X” WAS NOT THE REAL BROTHER OF THE DECASED TESTATOR/OWNER BUT HE WAS THE COUSIN BROTHER OF THE DECEASED . BUT IN ORDER TO GRAB THE SAID PROPERTY HE ( “ X ”) HAD SUBMITTED FORGED DOCUMENTS SHOWING HIMSELF AS THE REAL BROTHER OF THE DECASED AND FRAUDULENTLY GOT THE MUTATION IN HIS NAME IN DDA RECORDS .
NOW MY QUERY IS 1). CAN AN EXECUTION PETITION BE FILED FOR THE EXECUTION OF THE LETTER OF ADMINISTRTATION GRANTED BY THE COURT , IF YES UNDER WHAT PROVISIONS OF THE LAW ? .
2. WHAT ARE THE LEGAL REMEDIES AVAILABLE TO ME TO GET THE SAID PROPERTY MUTATED IN MY NAME IN DDA RECORDS . ?
THE DATE/TIME BORROWING FRIENDLY LOAN IS NOT MENTIONED IN LEGAL NOTICE, NOT IN COMPLAINT AND NOT IN EVIDENCE WAY OF AFFIDAVIT. IS IT A GROUND FOR ACCUSED FOR ACQUITTAL. I AM COMPLAINANT. I HAVE SOME RECORDED PHONE CALLS AND MESSAGES OF ACCUSED WHERE HE ADMITTED THAT HE HAD BORROW MONEY FROM ME. CAN I TENDER THEM IN MY WITNESS. I HAVE SOME WITNESS ALSO WHO GIVE THEIR EVIDENCE.
NEED GUIDANCE AND HELP.
THANKS
Respected Sir
This is Sanjit Sarkar, resident of West Bengal. I want to put a quarry on this forum regarding the importance and probate of a will. We have a property in the name of my grandmother who died 2 years ago. She made a will on registered stamp paper before her dead where she mentioned my father as executor or beneficiary of that property. Here I want to inform you that my father has one brother and two sister and they all are married.
Now I want know, is that will valid? Whether my father will be able to claim for that piece of land based on that will? Is the probate necessary? How to do probate of that will? On which ground my uncle can challenge against my father’s claim for that will.

I am an assistant teacher of a Govt. aided school in West Bengal. This year I was instructed by
the concern Government authority to enroll my name for the registration of Aadhar Card on
6/1/2014. As a consequence I failed to attend my duty in the school. Can I get the option of on-
duty leave for participating and helping the Government duty? Please inform me the rules that
will help me to avail the opportunity. Our Head Master is reluctant to provide the opportunity.
